Employers have a number of responsibilities to their employees at the work place. The Occupational Safety & Health Administration has helped to develop laws that list a number of responsibilities that the employers have toward their employees. Besides the laws that have been developed by the Federal and State governments there is also an ethical obligation for employers to provide a safe workspace for their employees. To help create this safe work space employers routinely conduct back ground checks during the recruitment and hiring process. Employers have an ethical obligation to their employees, their customers, as well as to the communities it services to ensure that they do all they can to prevent acts of negligence or damages caused by staff in their employ. And employer also has some obligation to the employee being accused of conduct violations and so on. The employer has to train its staff on the acceptable conducts and policies it has created for the company. Once all staff have been trained on the policies and an employee fails to adhere to these policies, and continuously displays a lack of consideration for other employees and their safety it is important for the employer to take action. If an employer fails to protect its employees, customers, or community from a known threat the result can be potential lawsuits for negligence and or liability. If an employer knows that an employee is dangerous or poses a threat to the community or other employees and does nothing that employer can be held responsible for things done by that employee while working. Employers can be charged with negligent retention or negligent hiring. Negligent retention refers to an employer not terminating the employment of an individual who was known to be violent, or who continually exposed his or her dishonesty. Negligent hiring is when an employer hires a person without checking to see if that candidate has a history of violence. “Negligent hiring suits are founded on an obligation to hire only safe, qualified employees.” (Walter, 1991).
