1. The competent authority should, on the basis of an assessment of safety and Health hazards and in consultation with ship owners’ and seafarers' organizations, adopt National laws or regulations to ensure the safety and health of seafarers working on Ships. 2. A practical application of these national laws or regulations should be provided through technical standards or codes of practice, or by other appropriate methods. 3. in giving effect to 1 and 2 above, the competent authority should have due regard to the relevant standards adopted by recognized international organizations in the field of maritime safety. 4. The competent authority should provide appropriate inspection services to enforce or administer the application of the provisions of national laws and regulations and should provide the necessary resources for the accomplishment of their task, or satisfy itself that appropriate inspection and enforcement are carried out. 5. The inspection and survey of ships should normally be carried out by the competent authority. If inspection and survey are delegated to classification societies and other bodies, the competent authority should ensure that its international obligations4 are fulfilled and that national laws and regulations are enforced. 6. As a consequence of this development, the Commission on Higher Education (CHED) in in collaboration of Maritime Training Council (MTC) revised the curricula and syllabi for Bachelor of Science in Marine Transportation (BSMT) and Bachelor of Science in Marine Engineering (BS MAR-E) to comply with the requirements of the STCW’95 Convention for implementation.

In conclusion, the ability for sailors to better their career has been taken out of their hands, and relies too much on external entities. Advancement is not based on one’s abilities to excel at his or her job, but by hoping they earn more money for the commands Navy Day Ball, they must have faith that the standardized test will cover their job field, and that the writing ability of their superiors is good enough to keep them competitive. Once these aspects under the advancement criteria are changed, the navy as a whole will start seeing more effective leaders who understands their jobs, understand their people, and more closely reflect the ideals and traits required in today’s leaders.

US ports and waterways have historically performed a role as the critical lifeline for our nation’s international and domestic trade since the birth of our country. Like any other national resource, it must be cared for and cultivated to meet the growing needs of its users, which include not only the direct users, but also each and every citizen. The needs of the United States Coast Guard has grown invariably since its establishment in 1790 by Alexander Hamilton. One major which seeks to meet the needs of the Coast Guard is Operations Research and Computer Analysis (ORCA). LT Dougherty, an instructor in the math department of the Coast Guard Academy describes ORCA as a “scientific way of making decisions” to take the best course of action, whether that includes improving efficiency, optimizing resources, or maximizing profit (Dougherty). Classes such as Probability Theory and Optimization teach cadets important theories which they can apply in the operational Coast Guard for it to run efficiently as possible under constraints of resources, such as money, time, or inventory (Dougherty).
More than forty thousand merchant ships, and countless number of smaller coastal craft, ply world oceans which comprise nearly seventy percent of the earth’s surface. Each year approximately ten million containers of cargo, containing raw materials to finished goods are transported by seas. The ships are owned by different states, private companies or individuals and manned by mixture of seafarers from different countries, mixed together from various nationalities. These ships are perhaps the most autonomous entities on earth as rule of law allows frequent change of their allegiance or identity by choosing a flag to suit their requirement.

Illegal, unregulated and unreported fishing, or pirate fishing, is a huge threat to the marine environment, it's bio diversity in food development is dependent on it. Losses due to pirate fishing are estimated to be between 10-23.5 billion U.S. dollars per year. Representing 11-26 million tons of fish. West African waters are estimated to have the highest levels of pirate fishing in the world. Fish is a crucial source of protein for millions of people. Fishing is the major coastal employment along the coast's. During a dramatic two year investigation, the Environmental Justice Foundation (EJF) has documented mass amounts of pirate fishing on the West Coast of Africa. Pirate fishermen are literally out of control. They are fishing in protected areas, destroying local fishermens nets and sabotaging them, hiding their names, and shipping their catch illegally at sea. They evade arrest, attack local fishermen, and abusing their own crews. The catches of these pirates have been entering the EU. the worlds largest import market for seafood. This is despite a new EU regulation. The regulation requires all fish imported into Europe to be accompanied by a catch certificate that asks for name, address, validating authority, fishing vessel name, license, and homeport. This is all declares that the catches have been declared legal.y 90% of the vessels documented by EJF fishing illegally are bottom trawlers. Bottom trawlers are are vessels that drag heavy nets across the sea bed catching all marine life in their path. Ensuring the health and safety of employees is of primary importance to the Organization. Organization is committed to maintaining safe facilities, sponsoring appropriate training programs, and providing necessary safety equipment. In addition, Administration and staff shall cooperatively develop appropriate procedures and regulations for ensuring employees' health and safety, with special emphasis on the handling of potentially hazardous equipment or substances and for investigating and reporting any accidents and mishaps. All newly employed staff shall be required to comply with the physical examination. Every employee must provide annually, at a minimum, an updated health history of current health problems.
