COMPLAINANT’S POSITION Complainant, who suffers from severe tinnitus, anxiety, and depression, alleges that Respondents failed to accommodate his disabilities when they failed to take any corrective actions to decrease the noise levels from his neighbors, which negatively impacted his disabilities. Complainant states that he moved into a new apartment building owned by the Chicago Housing Authority (CHA), at 2020 West Schiller for a quieter place to live and help alleviate his symptoms. Complainant states that the CHA knew the reasons why he moved. Complainant states that, on or about November 10, 2014, he moved into 2020 West Schiller, Apartment 1306. COMPLAINANT’S REBUTTAL 9/10/15 After making numerous noise complaints, Complainant admits that the CHA finally accommodated his disabilities and moved him into 2020 West Schiller, a “quieter” building, owned by the CHA. Complainant states that within two weeks of moving into 2020 West Schiller, he encountered a lot of noise which kept him up. Complainant acknowledges that the CHA was not making the noise, just noisy neighbors. Complainant explains that he complained to East Lake about the noise and the Property Manager Edwards sent the maintenance worker (Clark Bullock) to the 13th floor early in the mornings to investigate his allegations. Complainant states that Edwards was unable to substantiate his noise complaints. Complainant admits that he accused the resident in Apartment 1301 of making the noise. However, Complainant notes that he was mistaken. Complainant states that the tenant in Apartment 1307 was intentionally slamming the cabinet doors to make noise. “Please be advised that the CHA Housing Rights and Nondiscrimination Department is approving . . . Abadi’s request for a transfer to another senior development as a reasonable accommodation. Mr. Abadi is a person with verifiable disabilities as certified by his physician, Dr. Jack Clemis. The physician states that a transfer is necessary to abate Abadi’s disabilities that stem from anxiety developed at his current development.” August 5, 2013 through January 23, 2015: The notes show that Complainant filed 23 noise complaints while residing at three different CHA complexes. January 13, 2015: The notes indicate that Property Manager Edwards spoke to the residents on the 13th floor regarding the noise complaints for Abadi. None of the residents complained about the noise. However, the residents complained about Abadi knocking on the door at 1 a.m. January 23, 2015: The notes show that Property Manager Edwards directed the janitor to stand on the 13th floor at 6 a.m. to determine what apartment was making the noise Abadi claimed. b.
