Civil Disobedience Civil disobedience: “Refusal to obey civil laws in an effort to induce change in governmental policy or legislation, characterized by the use of passive resistance or other non-violent means” (Houghton, 2000). Although this definition seems broad enough to cover any aspect of a discussion, there is still much to be said about the subject. Martin Luther King wrote a fifty paragraph letter about the timeliness and wisdom in such an action, while Hannah Arendt managed to squeeze her definition into six (extra long) paragraphs regarding Denmark and the Jews. But, regardless of the fact that people relate this topic in many different ways, they always seem to end up with the same basic principles: civil disobedience is the resolve of a just conscience; it is a means through which mountains can be moved quietly and strategically; and if applied correctly, it can permanently alter the course of a single individual or an entire nation. In ancient times those who chose to undertake the perilous act of civil disobedience—the early Christians who defied the Roman Empire, Socrates, Shadrach, Meshach, and Abednego—did not do so lightly, for in these times such acts were generally met with an immediate and often painful death (King, 2000). In effect, it took a strong conscience to resort to such actions. This same ideal held true in more recent times, as demonstrated by Denmark in their defiance of Nazi ideals and Martin Luther King Jr. in his actions against racial segregation in the United States. History has encountered many different individuals whom have each impacted the 21 in one way or another; two important men whom have revolted against the government in order to achieve justice are Henry David Thoreau and Martin Luther King Jr. Both men impacted numerous individuals with their powerful words, their words carried the ability to inspire both men and women to do right by their morality and not follow unjust laws. “On the Duty of Civil Disobedience” by David Henry Thoreau along with King’s “Letter from Birmingham Jail”, allow the audience to understand what it means to protest for what is moral.
Martin Luther King and Henry David Thoreau each write exemplary persuasive essays that depict social injustice and discuss civil disobedience, which is the refusal to comply with the law in order to prove a point. In his “Letter from a Birmingham Jail,” King speaks to a specific audience: the African Americans, and discusses why he feels they should bring an end to segregation. Thoreau on the other hand, in “Civil Disobedience,” speaks to a broader, non-addressed audience as he largely expresses his feelings towards what he feels is an unjust government. Both essays however, focus on the mutual topics of morality and justice and use these topics to inform and motivate their audience to, at times, defy the government in order to establish the necessary justice.

According to him, “In any nonviolent campaign there are four basic steps: collection of the facts to determine whether injustices exist; negotiation; self-purification; and direct action” (King 262). The first step, which is “collection of the facts,” clarify whether the matter requires civil disobedience from the society (King 262). The second step, “negotiation,” is the step where civil disobedience is practiced in a formal way; to change an unjust law, both sides come to an agreement that respects each other’s demand, (King 262). Should the second step fail, comes the “self-purification,” in which the nonconformists question their willingness to endure the consequences without any retaliation that follow enactment of civil disobedience (King 262). The fourth and the last step, “direct action,” is to execute it; coordinated actions such as protests or strikes to pressure no one, but the inexpedient government to conform to them, and advocate their movement, and thus persuade others to promote the same belief (King 262). This procedure along with principles of civil disobedience is one justifiable campaign that systematically attains its objective. Martin Luther King, Jr. defines “civil disobedience” as a way to show others what to do when a law is unjust and unreasonable. As King stated in the letter from Birmingham, “Any law that uplifts human personality is just. Any law that degrades human personality is unjust.” When Negros were being treated unfairly, Martin Luther King, Jr. stepped in to show people how to peacefully protest and not be violent. The dictionary definition of civil disobedience is the refusal to comply with certain laws or to pay taxes and fines, as a peaceful form of political protest (Webster Dictionary). That is what Martin Luther King, Jr. did when nothing was changing in the town after the law for public school to be non-segregated. In Antigone, Creon created an edict that states that nobody could bury Polynices’s body because he was a traitor to Thebes and his family. Under Martin Luther King’s definition of an unjust and a just law, Creon’s edict is unjust and degrades Polynices’ right to be buried because of lack of information and favoritism of one brother.

Henry David Thoreau, a philosopher and creative artist as well as an anti slavery activist, wrote his short story “From Resistance to Civil Disobedience”. In this story he’s arrested for not paying his state taxes. At the time the state was engaged in the Mexican-American War that was not only fought over boundaries expanding slavery but was also enacted by President Polk under his own decision. Thoreau thought the war was too aggressive and without just reason.

The use of nonviolence runs throughout history however the fusion of organized mass struggle and nonviolence is relatively new.
Despite the belief that fighting with violence is effective, civil disobedience has been tried throughout history and been successful. Fighting violence with violence leaves no oppertunity for peace to work. By refusing to fight back violently, Martin Luther King Jr. took a race of people, taught them the value of their voice, and they earned the right to vote. Henry David Thoreau presented his doctrine that no man should cooperate with laws that are unjust, but, he must be willing to accept the punishment society sets for breaking those laws, and hundreds of years later, people are still inspired by his words. Mohandas K. Gandhi lead an entire country to its freedom, using only his morals and faith to guide him, as well as those who followed him, proving that one man can make a difference. Civil disobedience is the single tool that any person can use to fight for what they want, and they will be heard. After centuries of questioning it, it appears that the pen truly is mightier than the sword.
Civil disobedience has been around for a long time. In Bible times Christians would disobey laws that would go against their beliefs, such as the law that they couldn’t preach. (Acts 4) Christians still disobey laws in many countries that do not let them practice their faith, some end up in jail or killed.
By definition, civil disobedience means to actively refuse to obey certain laws, demands, and commands of a government or of an occupying power without resorting to physical violence (Wikipedia 2007). Many of the influential people in history have felt passionately about what they believe. These passions caused them to rebel against a government or authority. Many times they felt so strongly about what they believed and how they were being treated was wrong they became disobedient. They would take physical and verbal abuse for being disobedient but would never retaliate. They believed in what they thought was wrong and tried to change the way they were governed. Albert Einstein once said 'never do anything against conscience even if the state demands it.' Albert Einstein's views seem to be reasonable. The claim by Albert Einstein is accurate because people should stand up for what they believe, they should know when they are right and their government is wrong, and they should trust in themselves and their own beliefs.
Thoreau’s Civil Disobedience is a piece that denounces the role of government and promotes the individuality of man. He argues that government rarely proves itself to be useful, and that anything achieved under the influence of that government could have been even greater had the system not been involved, evident in paragraph 2, “Yet this government never of itself furthered any enterprise, but by the alacrity with which it got out of its way. It does not keep the country free. It does not settle the West. It does not educate. The character inherent in the American people has done all that has been accomplished; and it would have done somewhat more, if the government had not sometimes got in its way.” (Thoreau, lines 12-16) He states that the American government derives its power from the majority, not the strongest group, and not necessarily the most moral. Thoreau wants us to believe that we the people should follow what we think to be ethically just, not what the government and the majority force upon us. In my opinion, I agree with Thoreau in the aspect that we need a more improved form of government, however I disagree with the type of government that Thoreau wishes for. He believes we work better without restraint and that we must command our individual respect, but I heartily argue the opposite; a society must have order and an infrastructure, we need a system to oversee the problems that we cannot solve as humans with individual mindsets. I do not believe that the government should have the right to pry into our lives without solid evidence, but I do believe that we need a fair and balanced administration that is required to look after its’ peoples’ well being.
