Criminals that commit the level one felony, rape, should be punished harsher. Rapist, like Brock Turner, can commit such a crime and still not be punished the way one should. Brock received six months in jail after raping and penetrating an unconscious twenty two year old woman. On January eighteenth of 2015 he had five different charges against him. Two of the charges were for rape, two for felony sexual assault and the last was for attempting rape. February second he pled not guilty to any of the accounted charges. While the two rape charges were dropped by prosecutors, Turner was still charged for the other three charges. Those three charges had a potential of fourteen years of prison. Judge Persky sentenced Turner to six months of jail …show more content…

The average punishment for convicted rapist is around nine years and eight months, usually only about five years and four months are being served. This punishment is not harsh enough, however rapist do not deserve the death penalty. Many people believe that the death penalty would decrease the rate of the crime being committed by a significant amount. People who fear death wouldn’t commit the crime and risk their lives, however rapist do not deserve an easy way out of their

One opinion, who agrees with the death being a reliable outlate, states, “The justice system shows more sympathy for criminals than it does victims. It's time we put the emphasis of our criminal justice system back on protecting the victim rather than the accused. Remember, a person who's on death row has almost always committed crimes before this. A long line of victims have been waiting for justice. We need justice for current and past victims.” The opposite argument also stand out though, proving a valuable point in some cases. “While rape can be a very belittling and a traumatizing crime, believing the moral response to that is to end the life of the perpetrator does nothing to solve the problem, does nothing to help the victim, and does nothing for the health of society.
People are commonly emotionally invested in seeing criminals given just deserts, and their emotional high can lead them to demand and crave undue and brutal punishment when it's not warranted. A thief can potentially ruin a person's life far more, especially identity theft, but nobody is craving for the blood of thieves, they are only given
Many people are led to believe that the death penalty doesn’t occur very often and that very few people are actually killed, but in reality, it’s quite the opposite. According to the Bureau of Justice Statistics, 1,359 people have been executed as a result of being on death row since 1977 to 2013. Even though this form of punishment is extremely controversial, due to the fact that someone’s life is at stake, it somehow still stands to this very day as our ultimate form of punishment. Although capital punishment puts murderers to death, it should be abolished because killing someone who murdered another, does not and will not make the situation any better in addition to costing tax payers millions of dollars.
In order to mediate everyone’s views I believe the current situation should be slightly altered. The first thing that should change is the punishment facing murderers and rapists. Currently, 1st and second degree murder charges are have a minimum sentence for life in prison if charged. But for sexual assault, it ranges from 6 months to a max 25 years in imprisonment. Sexual assault, especially aggravated sexual assault deserves to be punished with harsher sentences. There should be fines as well as to compensate the victim and pay for reparation charges. Victims will usually face severe trauma and will need to have counseling done in order to once again feel comfortable and safe. As people believe that the death penalty is most needed for crimes such as murder and rape, there should be harsher environments in where they go to jail. Now, I not advocating abuse or cruel and unusual punishment but a system where these types of criminals will be further punished in order to appease the public, deter future criminals and help society improve could be used effectively. This system would be heavily focused towards paying back society in terms of jobs and labour that could be performed by inmates in exchange for improved
There are many problems rapes could cause besides the ones highlighted already. 35% of men report significant short-term or long-term impacts such as Post Traumatic Stress Disorder (PTSD). A few more would include anxiety, depression, fearfulness, or post-traumatic stress disorder. The thoughts of future occurrences would consume their thoughts as the use excessive precaution that could have a little effect would be taken. The Withdrawal from relationships or friendships and an increased sense of isolation as well as avoiding people or places that are related to the assault or abuse. Despite being the least disclosed crime, it cost the U.S annually more than any other crime.
Rape causes depression, loss of self-esteem, self-incrimination, and suicide. Therefore the consequences of rape should be life in prison or put in a mental institution. Rape should be banned nationally because you don’t know who could be raped next. Victims fear personal and family safety after a tragic incident like being raped.
According to the authors of “Enhancing Care and Advocacy for Sexual Assault Survivors on Canadian Campuses”, “Sexual assault has immediate and long-term health consequences for victims including suicide, HIV infection, depression, and social isolation,” (Quinlan, Clarke, and Miller). Another common side effect these victims face is post-traumatic stress disorder. Someone experiencing PTSD may have random outburst of anger, have trouble concentrating on day to day tasks, or may even have flashbacks of their attack. These consequences make it hard for victims to get back into the normal routine of everyday life (“Effects of Sexual Assault”). In a case at Amherst College a young women named Angie Epifano faced many of these consequences after she was raped by an acquaintance in one of the college’s dormitories. While immediately choosing to ignore what had happened to her Epifano soon became an emotional wreck. Before the attack Epifano had believed herself to be an extremely strong and independent individual. In an article done on Epifano’s story she stated “Everything I had believed myself to be was gone in 30 minutes,” (Epifano). Sexual assault takes away a piece of someone. With their hopes and dreams clouded by the tragedy they have endured, victims face a lifetime of
I will use this article to bring attention to the fact that the death penalty should be abolished because a lot of the time, people being prosecuted cannot afford a competent defense team. I will also use this article to accentuate my belief that jail time, life without parole, is a much better punishment than the death
The death penalty continues to be an issue of controversy and is an issue that will be debated in the United States for many years to come. According to Hugo A. Bedau, the writer of “The Death Penalty in America”, capital punishment is the lawful infliction of the death penalty. The death penalty has been used since ancient times for a variety of offenses. The Bible says that death should be done to anyone who commits murder, larceny, rapes, and burglary. It appears that public debate on the death penalty has changed over the years and is still changing, but there are still some out there who are for the death penalty and will continue to believe that it’s a good punishment. I always hear a lot of people say “an eye for an eye.” Most people feel strongly that if a criminal took the life of another, their’s should be taken away as well, and I don’t see how the death penalty could deter anyone from committing crimes if your going to do the crime then at that moment your not thinking about being on death role. I don’t think they should be put to death they should just sit in a cell for the rest of their life and think about how they destroy other families. A change in views and attitudes about the death penalty are likely attributed to results from social science research. The changes suggest a gradual movement toward the eventual abolition of capital punishment in America (Radelet and Borg, 2000).
Which is why I take rape, and sexual assault very seriously. This is something that leaves its mark on your being forever. It has a profound effect of your quality of life, your career and
One of the most repetitive and controversial topics discussed in the criminal justice system, is the death penalty. Capital punishment has been a part of our nation’s history since the creation of our constitution. In fact, as of January 1st, 2016, 2,943 inmates were awaiting their fate on death row (Death Penalty Information Center). Throughout my life, I have always been a strong advocate for the death penalty. During the majority of my undergraduate degree, I was a fierce supporter of capital punishment when discussing the topic in classes. However, throughout many criminal justice courses, I found myself in the minority, regarding the abolishment of the death penalty. While debating this topic, I would always find myself sympathetic to the victims and their families, as one should be, wanting those who were responsible for heinous crimes to
Rape is not just an action against an individual, but a violent crime that can scar a life
Have you ever thought about if the person next to you is a killer or a rapist? If he is, what would you want from the government if he had killed someone you know? He should receive the death penalty! Murderers and rapists should be punished for the crimes they have committed and should pay the price for their wrongdoing. Having the death penalty in our society is humane; it helps the overcrowding problem and gives relief to the families of the victims, who had to go through an event such as murder.
Did you know that ninety-seven percent of rapists will never spend a day in jail? (RAINN) This fact is depressing considering the large percentage of rape victims. Things like rape and violence have a severe impact on the mentality level of people. Their lives will change forever after going through an intense situation such as being molested, beaten, or anything along those lines. It has caused people to commit the same crime, become severely depressed and suicidal, as well as many other unfortunate events. People look down on those who have gone through such events, some may say things such as, "you probably deserved it”, “you were dressed provocatively" or "how did you not enjoy that?” As such, rape is an underexplored
According to rain.org 44 percent of rape victims are under the age of 18 and 80 percent are under the age of 30 years old. Every 2 minutes an American is a victim of rape and about 240,000 of them are reported each year. Only 60 percent of assaults are not reported to the police renders that 97 percent of the perpetrators never spend a day in jail. The less the people report the crime the less they are likely to catch the perpetrator. Sadly 23 of the victims know the person whole is assaulting them. Almost 40 percent of the rapist know their victim. This is a very uns...
some of the rape victims have been killed by the rapists having been assaulted. Some victims have also killed themselves much later due to the pain and stigma associated with the
The death penalty should fit the crime and in extreme cases, extreme measures should determine the course of justice. Some murders, like the intentional murder of a rape victim, are so depraved that capital punishment is the only proportional sentence available. The constitution itself recognizes that punishment must be proportional to the offense. The Supreme Court also recognizes that in order for the public to have confidence in the criminal justice system. There must be a belief that the punishment must fit the crime. With the person who committed the rape to get the death penalty allows for punishment to fit the crime. Committing a rape is a very serious and offensive crime. Those people who commit this crime should be punished harshly.
