On March 31, a $1 billion trial between Apple and Samsung began in California court. Apple was accusing Samsung of infringing on software patents related to its iPhone.
These two companies used to get along great. Their legal battle started long after Samsung started selling Android devices. Apple founder Steve Jobs hated Android and once called it a “stolen” product — a ripoff of the iPhone. Apple’s first major clashes in the smartphone wars started with Nokia and HTC in 2009 and 2010. Apple spends billions on Samsung flash memory, screens, processors, and other components. Souring that relationship with lawsuits was risky, but eventually Apple felt it had no choice.

The retrial on damages invalidated by Judge Koh gets underway. Apple seeks $379.8 million; Samsung argues the amount should be $52 million. A Samsung representative concedes in court some of its devices “contain some elements of Apple’s property.” Judge Koh awards Apple $290 million in damages, bringing the Samsung’s total penalty in the first U.S. case down from $1.05 billion to $929 million.

Apps are the most important thing about a phone, a phone can be powerful and fast but without good apps the phone is pointless. Apple dominates in apps as they make money on each app sold. Apple is very strict when it comes to applications as the developers of the apps must not violated user privacy and must stay within the many rules that Apple has given them. Overall apple has a gigantic app store. So many apps that this used to be Apple’s slogan, “there’s an app for everything”. Without the App store the IPhone is nothing. Google is working very hard to increase the number of Android based mobile apps; they are less strict about their apps which can be an issue because you can obtain a virus from downloading a certain app from the Google play store. However this can be a good thing because Android app developers do not have to worry about following certain app development rules which means they can post more apps on the store in a shorter period of time versus someone who is constantly getting their apps rejected by Apple. Both Apple and Google have been successful with mobile computing because of their apps. Microsoft has not been successful as their app store has very little apps that people are interested in, the main reason why barley anyone has a windows phone. To conclude, Apple Inc. and Samsung Electronics went to U.S. District Court due to Apple Inc.’s claim that Samsung Electronics had infringed on some of their technology patents used in the iPhone and iPad. Everyone knows Android and Apple have been rivals for years now. Each company has been developing new software and technology each year to prove who’s worthy of the #1 title. They have been competing with each other messenger, price difference, app store, product line, restrictions, and even marketing strategies. In 2012, Samsung, an Android represent, was forced to pay Apple $548.2 million for copyright infringement. This gives society a general idea of the rivalry between the two companies. In 2011, after five-years of litigation, Judge Kimba M. Wood of the United States District Court ruled in favor of Recording Industry Association of America (RIAA) and ordered a settlement of $105 million from LimeWire. The lawsuit was initiated by RIAA in 2006, for copyright infringement violations, against LimeWire for the illegal file sharing of music by its consumers. More than 9,000 recordings were identified by music labels that LimeWire users unlawfully distributed. RIAA sought the maximum penalty of $150,000 for each song totaling $1.4 billion in damages. Although RIAA was not awarded the full amount, they hoped it served as a deterrent for music piracy by other companies in the future.

They fell short in the nineties though, companies began to catch up and now there was more competition than before. Apple released their ipod in 2001, putting them back in the leadof the technology industry (The History of Apple). Presently, Apple is still exceeding other companies in the technology industry, such as Microsoft, Blackberry, Google and Hewlett Packard. Microsoft is Apple’s largest competitor, which is revealed through the Dupont analysis and other activity ratios, these particular ratios also make known that Apple’s numbers are not all accurate.
When it comes to smart phone market share in the United States, Apple still trails Android by almost 10%. But if you are to break out the market share figures then you will notice that IPhone reigns supreme by a very wide margin. According to a lot of recent data compiled by ComScore, Phone’s share of the United States smartphone market now is about 43.6%, followed by Samsung which is at 27.6%. Apples market has increased by 4% almost every year, while Samsung has been dropping by 4% almost every year. Although Apple is doing a bit better than Samsung overall, Samsung is still topping Apple with their Android. The rivalry is more than just two companies trying to out do the other. It was a war of technology between two men. Bill Gates and Steve Jobs, names most people are familiar with, and these two men could easily be given the credit of giving us a modern world. Gates started working on computers at a very young age, wanting to create computer software. He eventually made his way to Harvard, this is when it all changes. He develops a modern day organizer, but at this time it is uncharted territory and everyone wanted to get there hands on it. Jobs path to success was a little more bumpy than that of Gates. Comparing the design between Apple and Samsung, they have some differences and similarities. Apple more focuses on simplicity than Samsung.
