Analysis of the Canadian Human Rights Act
The Canadian Human Rights Act prohibits discrimination on the basis of disability and perceived disability. Disability includes those with a previous or existing dependence on alcohol or a drug. Perceived disability may include an employer’s perception that a person’s use of alcohol or drugs makes him or her unfit to work.
Because they cannot be established as bona fide occupational requirements, the following types of testing are not acceptable:
• Pre-employment drug testing
• Pre-employment alcohol testing
• Random drug testing
• Random alcohol testing of employees in non-safety-sensitive positions.
The following types of testing may be included in a workplace drug- and alcohol-testing program, but only if an employer can demonstrate that they are BONA FIDE OCCUPATIONAL REQUIREMENTS:
• RANDOM ALCOHOL TESTING OF EMPLOYEES IN SAFETY SENSITIVE POSITIONS:
Alcohol testing has been found to be a reasonable requirement because alcohol testing can indicate actual impairment of ability to perform or fulfill the essential duties or requirements of the job. Random drug testing is prohibited because, given its technical limitations, drug testing can only detect the presence of drugs and not if or when an employee may have been impaired by drug use.
• DRUG OR ALCOHOL TESTINIG FOR REASONABLE CAUSE OR POST-ACCIDENT:
where there are reasonable grounds to believe there is an underlying problem of substance abuse or where an accident has occurred due to impairment from drugs or alcohol, provided that testing is a part of a broader program of medical assessment, monitoring and support.
• PERIODIC OR RANDOM TESTING FOLLOWING DISCLOSURE OF A CURRENT DRUG OR ALCOHOL DEPENDENC /ABUSE PROBLEM
may be acceptable if tailored to individual circumstances and as part of a broader program of monitoring and support. Usually, a designated rehabilitation provider will determine whether follow-up testing is necessary for a particular individual.
• MANDATORY DISCLOSURE OF PRESENT OR PAST ALCOHOL DEPENDENCY/ABUSE:
may be permissible for employees holding safety-sensitive positions, within certain limits, and in concert with accommodation measures. Generally, employees not in safety-sensitive positions should not be required to disclose past alcohol or drug problems.
Under these limited circumstances where testing is justified, employees who test positive must be accommodated to the point of undue hardship. The Canadian

Each year, DUI drivers kill thousands, injure more and cause vast amounts of property damage. Determining the alcohol content in a drunk driver's blood has great evidentiary value in DUI prosecutions. Each state has a per se law, designating a blood alcohol content (BAC) of .08 percent as legally intoxicated. However, studies indicate BAC dissipates from the body between .01 to .02 percent/hour. Gathering evidence of chemical impairment in a DUI investigation is not only critical towards a successful prosecution but time sensitive. The nursing profession is guided by the principal of nonmaleficence, or “Do no harm”. Nurses are responsible for maintaining and optimizing a patient’s quality of life. When nurses fail to care for themselves, they also put their patients at risk. The patient has a reasonable expectation to receive safe and competent care. The influence of drugs and alcohol greatly deteriorate the judgment and skills of any good nurse. Increased patient workload, long hours, personal stress, and sleep deprivation put many nurses in a position to self-medicate. It is my position that high-risk specialty employees undergo drug testing in order to be held accountable and help keep their patients and themselves safe from harm.
Being in this class has benefited me towards my priorities. I was always one to procrastinate and I still am, but now I know how to do it in a smarter, more effective way. During this class, I found out how to plan my priorities. I had to think about my life priorities, semester priorities, and also my week’s priorities. All of these take time and dedication to achieve and procrastinating in the wrong way is not going to help. My life priorities were to graduate early, and receive my degree. The semester priorities were to pass all my classes, and also to take knowledge from the courses. My week’s priorities were a little more realistic, and they were to take time on my activities and to not be stressed about a small situation. These priorities are very important to me because I feel like these will lead me into the right direction for my career. This section of this course has had value toward my college career success. Women are numerically underrepresented in United States politics. Though people may see famous faces of women in politics around them, a mere 17 percent of leaders of the Federal government in the United States are women. Not only, at the Federal level are women underrepresented, but also at the state and local levels. Only in six states are there female governors, and members of city hall are predominately male in 92 out of the 100 largest cities in the continental U.S. Since the 1970’s the percentage of women in high political offices had been increasing, but in the last several election cycles there has been no net increase. The United States House of Representatives has plateaued in its percentage of female representatives and Senate suffered the first net decrease in the percentage of women serving since 1979. In terms of progress of women’s representation in politics, the United States is falling behind many nations. As of 2011, 90 nations have a higher percentage of women in office. (Lawless and Fox) Women in the United States have not achieved political parity, and are falling behind many nations in the election of women to office.
In the American society, we constantly hear people make sure they say that a chief executive officer, a racecar driver, or an astronaut is female when they are so because that is not deemed as stereotypically standard. Sheryl Sandberg is the, dare I say it, female chief operating officer of Facebook while Mark Zuckerberg is the chief executive officer. Notice that the word “female” sounds much more natural in front of an executive position, but you would typically not add male in front of an executive position because it is just implied. The fact that most of America and the world makes this distinction shows that there are too few women leaders. In Sheryl Sandberg’s book “Lean In,” she explains why that is and what can be done to change that by discussing women, work, and the will to lead.
Is it appropriate for employers to test staff for drugs or alcohol? How reliable are these results? Why should some one invade your privacy? Do drug testing determine your skills level for a job? What do drug testing in the work force prove? The arguments against drug testing are it is excessively invasive, may damage relations between employers and employees, and could hamper the recruitment and retention of good staff. In 1986 the Regan administration recommended a drug-testing program for employers. In 1991 The Omnibus Transportation Employee testing act of 1991 were passed. It required mandatory drug testing in trucking and other industries. Over the past 25 years drug testing in the military has increase. Today, approximately 62% of all employers in the US have mandatory drug testing program. Drug testing in the work force have been a very controversial topic ever since. Drug testing should not be in the workplace since it does not measure on the job impairment, do not prevent accidents and is an invasion of privacy.
As a soon to be graduating high schooler, I can say this class definitely gave me a dose of (that grown up word) independence. By focusing on the learning goals, I was able to see what changes I can make to create polished work. When I signed-up for this class, I assumed it would be easy and I was only taking it because I needed it to graduate; however, I can say that this class will help me in the future. There was no set requirement throughout the class, it was based on self-improvement. By making my own standards and being forced to make decisions, I definitely matured as a student. With this in mind, thank you for this valuable quarter and I can’t wait to advance in the future thanks to the learning goals and this overall
The composition concentrates mainly on the foreground .It has three main points of interest, the small rowing boats, the artificial island and the floating barge .It also has a stretch of trees and foliage in the background painted in a much lighter fashion. Monet?s painting has a very different composition from Renoir?s painting of Grenouillere, which was done at the same time; Renoir?s painting is focussed much more on the artificial island and the people on it. Monet uses a combination of thick bold brushstrokes and small short soft brushstrokes; this creates a nice varied look and helps give a good impression of perspective. The tone is also very varied as it is Very light in some areas, but it is also quite dark in others, such as the shades on the barge. Impressionism grew out of and followed immediately after the Barbizon school. A distinctive feature of the work of the Impressionists was the application of paint in touches of mostly pure colour rather than blended; their pictures appeared more luminous and colourful even than the work of Delacroix, from whom they had learned the technique. The characteristics of impressionism include the use of short brush strokes (Perry, 1995) and the lack of effort to veil or hide or keep these brushstrokes from being noticeable as the audience looks at the painting. Mandatory drug tests have proven to help teenagers reduce the use of drugs and alcohol in their daily lives. If young people get used to it when they are young, it’s proven that they would have a difficult time trying to loss their addiction to the substance. Helps the person without any criminal chargers but with all the help needed. They even have different types of drug tests to show the time period of when the person might have taken a drug recently.
