Diallo is approached by the police at midnight; Diallo is sitting on a porch, looking up a down the street. The police found this subspecies and one police officer think Diallo looks like a push in burglar that has been around. The police approach Diallo and this scares Diallo, he is an immigrant with not very good English; Diallo runs from the police to his home as he tries to enter the building, he reaches in his pocket and an officer yells “gun” and they unload their guns on Diallo. Kenna was a singer from 2008, Music industry didn’t know how to generals his music. Kenna was told by big time musicians and their managers that his music is amazing. Kenna didn’t make it far in the music industry because he wasn’t playing for the public on the radio, even though everyone said he was good, but they didn’t believe their feelings due to his songs being not popular. Kenna’s music was never recognized by the general public and lost the lust for trying to get his music out there.

This paper will consider eye witness testimony and its place in convicting accused criminals. Psychology online (2013) defines “eye witness testimony” as a statement from a person who has witnessed a crime, and is capable of communicating what they have seen, to a court of law under oath. Eye witness testimonies are used to convict accused criminals due to the first hand nature of the eye witnesses’ observations. There are however many faults within this system of identification. Characteristics of the crime is the first issue that will be discussed in this paper, and the flaws that have been identified. The second issue to be discussed will be the stress impact and the inability to correctly identify the accused in a violent or weapon focused crime. The third issue to be discussed is inter racial identification and the problems faced when this becomes a prominent issue. The fourth issue will be time lapse, meaning, the time between the crime and the eye witness making a statement and how the memory can be misconstrued in this time frame. To follow this will be the issue of how much trust jurors-who have no legal training-put on to the eye witness testimony, which may be faltered. The argument of this article states that society will judge you in anyway possible because of the privileges you have, but remembering what Tal included in her article saying “My appearance certainly doesn’t tell the whole story, and to assume that it does and that I should apologize for it is insulting. ”(Fortgang 2014:16). As stated in this quote, a person’s appearance will never tell you their story, you will judge them for how they look, but that way is not the correct way to judge anyone, the only way to judge a person is to not judge them at all, because every person has challenges they have to face to become who they are today.

In a perfect world, everyone WOULD be judged based on the content of their character. But we do not live in a perfect world and humans have always pre-judged others based on physical and cultural differences. Racism and prejudice have caused us to make dire mistakes in the past, but we have learned from these mistakes and have bettered our society. However, society today is filled with stereotypes and prejudices about people of certain races. It is evident in all aspects of our lives, including media, culture, and even the legal system.
When an individual unintentionally enters a room full of an unfamiliar crowd, he or she is bound to be embarrassed, but also have an apprehensive sensation of how others in that room will distinguish them. A situation like that establishes a moment in which that person realizes that all eyes are gaping at that individual. By averaging out distractions, it makes it easier to focus on the defining characteristics of a profile. Not only does this prove useful for identification, but it may also make it easier for one to detect changes they may not have noticed before. Typically, 2 people will form an opinion of others within the first 3 seconds of meeting one another.
