Alimony is essential in most circumstances when a marriage is over between two individuals. The perseverance of alimony is to avoid confrontation between an ex-married couples when the marriage is over. Generally, when alimony is filed one of the separated spouses is seeking for help because he or she is not receiving finical help from their ex-spouse during and after the divorce. Usually, when an ex-spouse chooses not to take on their responsibilities, he or she once shared, either of the separated spouse has the right to file for alimony and any other additionally help if needed. When alimony is presented in court, there’s a set of rules, law and guidelines that each individual has to go by. If they decided to take the matter into their own hands, they will have to settle all arguments and assets slipping on their own without any assistance. In many divorce cases, spouses are rarely fair with one another. So an alternate route would be to file for alimony so that he or she can maintain his or her lifestyle that they were custom to while married. Alimony is not a permitted condition; it’s a set payment that a judge can levy to an individual for a certain period of time. Alimony is based on several factors such as length of marriage, age, current income, and fault in marital divorce. Meaning, a man or woman could pay alimony for a certain amount of time. It all depends on the state law, who’s at fault, and the situation. Having an alimony agreement in place and on file can save time, headaches, and more money. Certain situation and circumstance could determine how long, and how much and what kind of settlement he or she will be rewarded with. Before awarding a spouse with alimony, the courts have to determine the reason, of the divorce because it can be one of the factors of awarding a spouse with alimony. A spouse cannot simply say they won’t this or they won’t that; they have to meet the requirements. The requirements are based off income, fault, length of marriage, age and more. If they meet the requirements for alimony, he or she will have set the payment order by the judge. For instance, if a spouse wants a divorce because infidelity was involved in their marriage and they won’t out, the person that committed adultery will be found at fault and they have to pay alimony to the other spouse. Would divorce struggle without alimony? Divorce would struggle tremendously because there would be fighting, greed, and unsolved problems.
