The Federalist paper # 68 was written with the intent of explaining the process by which we elect the President of the United States, also the views of the people in regards to the election of the President, as well as the House of Representative’s responsibility in electing the President.
During 1788, Alexander Hamilton was one of the three authors of the Federalist Papers in addition to being a Lawyer in the state of New York. The Federalist Papers are known for being an imperative source of understanding in regards to the original Constitution.
It is clear that Hamilton felt it was necessary for the intellect of the people would become of great significance in choosing a person to whom much trust is being invested as the President of the United States. Furthermore, the writer also wanted to make sure the person chosen as the President of the United States would be well protected during his time in office. Originating in 1787, the Electoral College was created as the official body within American politics that elects the president and vice president. The decision of who will win is based off the vote totals in each state, and “the founding fathers established it in the constitution as a compromise between election of the president by a vote in Congress and election of the President by a popular vote of qualified citizens.” (U.S. National Archives and Records Administration, “What is the Electoral College?”). During this time, the job of the Electoral College was to make peace between differing states and federal interest groups, provide popular participation in elections, give a vote to less populated states, and keep the president’s powers separate from Congress.
In order to understand and analyze the forces that shaped politics during this time period, political changes must first be examined. One of the biggest changes during this time period was the change in the number of voters. Between 1812 and 1840, the percentage of eligible voters in the United States presidential elections almost tripled, increasing from 26.9 to 80.2 percent while the percentage of states allowing voters to choose presidential electors more than doubled, rising from 44.4 to 95.8 percent, shown in Document A. By 1840, Rhode Island was the only state that didn’t allow all free men to vote.

In Federalist 78, Alexander Hamilton argued that the Judicial Branch is the “least dangerous to the political rights of the Constitution" and that it is “beyond comparison the weakest of the three departments of power” since it has “neither force nor will, but merely judgment.” [*] While it is true that Hamilton wrote the Federalist Papers as propaganda to garner support for the Constitution by convincing New Yorkers that it would not take away their rights and liberties, it is also true that Article III of the Constitution was deliberately vague about the powers of the Judicial Branch to allow future generations to decide what exactly those powers should be. In the 1803 case of Marbury v. Madison, the Supreme Court, led by Chief Justice John Marshall, established the Court’s power of judicial review. However, as Jill Lepore, Harvard professor of American History, argued, “This was such an astonishing thing to do that the Court didn’t declare another federal law unconstitutional for fifty-four years” after declaring the Judicial Act of 1789 unconstitutional in Marbury v. Madison. [*Jill Lepore] Alexander Hamilton was incorrect in his assertion that the Judicial Branch is the least dangerous to political rights and the weakest of the three government branches because judicial review has made the Supreme Court more powerful than he had anticipated. From 1803 to today, the controversial practice of judicial activism in the Supreme Court has grown—as exemplified by the differing decisions in Minor v. Happersett and United States v. Virginia—which, in effect, has increased the power of the Supreme Court to boundaries beyond those that Alexander Hamilton stated in Federalist 78.
In Federalist no. 78 Hamilton explains the powers and duties of the judiciary department as developed in Article III of the Constitution. Article III of the Constitution is very vague on the structure of the federal courts. Hamilton had to convince Americans that the federal courts would not run amok. He presented that the federal courts would not have unlimited power but that they would play a vital role in the constitutional government. Everyone has heard the name Alexander Hamilton, but few are familiar with his views and actions regarding the survival of the young American republic. He could be recognized for anything from serving our fledgling country by fighting in the New York militia; to serving his community as a lawyer and as a national tax agent; to beginning his political career as a representative for New York at the National Congress. Though most would agree his most important contribution to our struggling republic was to spearhead the project which formed the doctrine helping to establish the foundation in which modern democracy is based, the Articles of Confederation.

Since then, the U.S. has grown from a mere 4 million to a looming number of around 300 million people. It is because of this population increase that the Electoral College has become obsolete and is beginning to fail at its duties.
