Aboriginal and Torres Strait Islander Aboriginal and Torres Strait Islander people were social beings who were linked to other people (including ancestors), through a number of totemic relationships. These relationships were very complex and test the intellectual agility of those who try to understand them. Most commentators speak and write about Aboriginal social relationships using the word tribe. The over-representation of Aboriginal children in the Canadian Child Welfare system is a growing and multifaceted issue rooted in a pervasive history of racism and colonization in Canada. Residential schools were established with the intent to force assimilation of Aboriginal people in Canada into European-Canadian society (Reimer, 2010, p. 22). Many Aboriginal children’s lives have been changed adversely by the development of residential schools, even for those who did not attend them. It is estimated that Aboriginal children “are 6-8 times more likely to be placed in foster care than non-Aboriginal children (Saskatchewan Child Welfare Review Panel, 2010, p. 2).” Reports have also indicated that First Nations registered Indian children make up the largest proportion of Aboriginal children entering child welfare care across Canada (Saskatchewan Child Welfare Review Panel, p. 2). Consequently, this has negatively impacted Aboriginal communities experience of and relationship with child welfare services across the country. It is visible that the over-representation of Aboriginal children in the child welfare system in Canada lies in the impact of the Canadian policy for Indian residential schools, which will be described throughout this paper.
First I will define the definition of terms used in this paper. When I use the word Aboriginal, I understand this as a label given from the colonizers/ Europeans to identify Indigenous peoples. Canadian legislation defines Indigenous peoples as Aboriginal, I understand this as indifferent from the dominant ideology, therefore, the colonizers named Indigenous peoples as Aboriginal. According to teachings I have been exposed to it’s a legal term and it’s associated with discrimination and oppression. However, audiences I have written for prefer the use of Aboriginal. More premise to this reference is Aboriginal, Indigenous, First Nations, Indian and Native are used interchangeable, but it should be noted these names do represent distinct differences. Furthermore, I will use Indigenous to represent an empowering way to reference a unique general culture in Canada. Under the title of Indigenous peoples in Canada, for me represents: First Nations people, Metis people and Inuit peoples. These are the two titles I will use when I reference Indigenous people from an empowering perspective and Aboriginal from a colonizer perspective.

Aboriginal spirituality originally derives from the stories of the dreaming. The dreaming is the knowledge and a sense of belonging that the Aboriginals had of the beginning of life and the relationship to the land and sea (Australian Museum, 2011). The dreaming stories are passed on from one generation to the next orally. These stories teach the following generations how to behave towards the land and other people. The dreaming stories give them a sense of duty to protect the land and appreciate it because the dreamtime stories indicate that the spirits have not died but are still alive in different forms as animals or humans, therefore the ancestor’s power is still felt through the landforms (Clark, 1963), (Australian Governement, 2008)

(Faiman-Silva, 1997, p.8) The Cheyenne tirbe also traced their ancestry through the woman's lineage. Moore (1996, p. 154) shows this when he says "Such marriages, where the groomcomes to live in the bride's band, are called 'matrilocal'." Leacock (1971, p. 21) reveals that "...prevailing opinion is that hunting societies would be patrilocal.... Matrilineality, it is assumed, followed the emergence of agriculture...." Leacock (p. 21) then stated that she had found the Montagnais-Naskapi, a hunting society, had been matrilocal until Europeans stepped in. "The Tanoan Pueblos kinship system is bilateral. The household either is of the nuclear type or is extended to include relatives of one or both parents...." (Dozier, 1971, p. 237)
When Africans were brought to America during slavery they were forced to give up most of their heritage and were usually separated from their families. This common occurrence usually brought about tremendous pain and grief to the slaves. “West Africa family systems were severely repressed throughout the New World (Guttmann, 1976)”. Some slaves tried to continue practices, such as polygamy, that were a part of traditional African cultures but were unsuccessful. However, they were successful in continuing the traditional African emphasis on the extended family. In the extended family, aunts, uncles, cousins, and grandparents played important roles. Slaves weren’t allowed to marry, but they didn’t let that stop them, they created their own marriages. And through all the hardships they had placed on them, they developed strong emotional bonds and family ties. The slaves discouraged casual sexual relationships and placed a lot emphasis on marriage and stability. To maintain some family identity, parents named their children after themselves or other relatives or sometimes gave them African names.
In conclusion the colonisation of Australia and the adoption of discriminatory policies eroded Aboriginal culture and tradition affecting their sense of well-being and thus deteriorated their health. Today these policies are reflected in the social determinants of health as socio-economic disadvantages. They continue to impact contemporary Aboriginal people. In order to improve Aboriginal health outcomes; the impacts of these policies need to be overturned. This can be done by assisting them with improving their socio-economic status in the light of their needs and traditions.
Australia’s Indigenous people are thought to have reached the continent between 60 000 and 80 000 years ago. Over the thousands of years since then, a complex customary legal system have developed, strongly linked to the notion of kinship and based on oral tradition. The indigenous people were not seen as have a political culture or system for law. They were denied the access to basic human right e.g., the right to land ownership. Their cultural values of indigenous people became lost. They lost their traditional lifestyle and became disconnected socially. This means that they were unable to pass down their heritage and also were disconnected from the new occupants of the land.
