Income Disparities of women in the Workplace
The existence of male-female income and gender discrimination in the workplace has been noted in countless countries. Over the past few decades, laws barring discrimination in education and employment have helped give workingwomen many opportunities that our mothers never had. Because of these opportunities, women began working in many different fields, each requiring different skills and experience with different pay wages. Although these opportunities has opened many doors for working women all over the world, the doors for pay discrimination still remains tightly shut for women in the workplace. While significant progress has been attained in furthering gender discrimination between men and women in the workplace, countries such as the United Stated and Japan still seems to be reluctant, to grant true income equality in towards women compared to their male counterparts.
Thirty years ago women earned just over half the pay of their male counterparts. This was supposed to be resolved with the passage of the federal Equal Pay Act of 1963. Under this act, employers must pay women the same as men for work that is "substantially equal." Additionally, Title VII of the Civil Rights Act of 1964, which covers employers with 15 or more workers, prohibits pay differences based on gender and bars discrimination against women in hiring, promotion, training, discipline and other job aspects . Despite the existence of such laws, unfortunately workingwomen continue to earn less than men.
It's extremely obvious that women have come a long way in the labor force ever since the 19th century. At present time, women account for nearly half the nation's workforce, but due to pay discrimination there has been a wage gap that does not seem to close between men and women. For instance, the typical workingwomen in Japan earns 63 percent of the average man’s pay . While in the United States, the average American woman earns about 74 cents for every dollar the average man earns . In comparing these figures, Japanese women are at even more of a disadvantage in the workplace than their peers in the United States.
As stated above, laws have been in placed for years that strictly prohibit any type of discrimination in the workplace. So why does the wage disparity persist? In Japan, it is because of traditional expectations that women marry young and devote themselves to child rearing. This factor is always usually the case with Japanese women, however number of women who continue careers after marriage is growing, but companies have been slow to accommodate their needs for child care or maternity leave .
Throughout the world, discrimination in all forms has continued to be a constant struggle; whether it’s racial, gender based, religion, beliefs, appearance or anything that makes one person different from another, it’s an everyday occurrence. A major place that discrimination is occurring at is in the workplace. One of the largest problems discrimination issues is believed to be gender. Women, who have the same amount of experience as men are not getting paid at the same rate as men, these women also are equally trained and educated. According to the article Gender Pay, it was discovered in 2007 that a woman makes 81 cents for every dollar a man earns.(“Gender Pay”) . This shouldn’t be happening in today’s society for the fact the society lived in today is suppose to be more accepting. Men are viewed as being more popular, valuable and having higher powers than women. The Reason Discrimination is involved in the equal pay equal work is because of the significance it has to how some businesses pay their employees.
The main subject in the Kyllo case deals with the advance in modern technology and how it relates to constitutional law. The overall question in this case is whether or not the use of thermal imaging technology should be used as a tool for searching the home of a person. The argument by the appellant, Mr. Kyllo, uses the unreasonable search and seizure clause of the Fourth Amendment as a defense against the use of thermal imaging systems without a warrant to search for illegal drug production inside his home. Kyllo v. U.S. is currently pending before the United States Supreme Court so the objective of this essay is to explain the procedural history of this case and to predict a final result and the implications of that prediction.
The fourth amendment protects people against unreasonable searches and seizures. The police had evidence that DLK was growing marijuana in his house, so they used a thermal imager and found a significant amount of heat. The police took this evidence to a judge who gave them a warrant to search inside DLK’s house for the marijuana and when they did search his house the police found the plants and arrested DLK. The controversy surrounding this case is whether or not it was constitutional for the police to use the thermal imager of DLK’s house without a search warrant. The government did not need a warrant to use a thermal imager on the outside of DLK’s house because once the heat left DLK’s house it was out in public domain, the thermal imager could not see any details within DLK’s house, and the police already had evidence to expect DLK was growing the marijuana plants in his house.
In addition, women are paid less than men for the same type of work. According to Lean In, Sheryl Sandberg mentions that women were paid fifty-nine cents for every dollar men were paid in 1996, but women protested to raise the compensation to seventy-seven cents (6). This means that even though a woman and a man perform the same work such as an engineer does, both do the same assignments and have the same responsibilities in the technology place, men are paid twenty three cents more than women. Moreover, women suffer from “gender discount” which means women have to pay for being part of the workplace or society ...

Kennedy signed the Equal Pay Act of 1963 into law, he hoped that it would allow working women to finally earn the same amount of money as men; however, more than half a century later, men continue to out earn women in almost every field of work (Lipman para. 4). Male dominated fields tend to pay more than female dominated fields at similar skill levels. In 2012, women earned an average of $691 per week while men earned an average of $854 per week. Furthermore, the majority of women remain unaware that they are earning less than their male colleagues (Hegewisch para. 1).
Women are more than half the work force and are graduating at higher rates then men and continue to earn considerably less then men. There are several contributing factors to the gender wage gap. Women experience gender discrimination in the work force even though it’s been illegal since the Equal Pay Act in 1963. One of the challenges for women is uncovering discrimination. There is a lack of transparency in earnings because employees are either contractually prohibited or it’s strongly discouraged from being discussed. Discrimination also occurs in the restricting of women’s access to jobs with the highest commission payments, or access to lucrative clients.
In the case cited, police suspected Kyllo was growing marijuana in his home. They used a thermal imaging device from across the street to scan Kyllo's home to see if the level of heat escaping from it was consistent with high-intensity lights used to grow marijuana indoors. The result of the scan showed that portions of Kyllo's home were relatively hot compared to the rest of his home. Using the result of the scan, as well as other information, police obtained a warrant to search Kyllo's home, and found a marijuana-growing operation in their search.
Due to various countries initiatives to shrink the wage inequality between men and women wages in the work force, the gap has narrowed, respectively, which may have helped form such opinion. However, stating that the gender pay gap does not exist in today’s society, anywhere, is completely unlikely. Seeing that the gap has loosened its grasp in the working world, in other countries, the gap between pay has widened or remained stagnant. One cannot help but wonder why the gap remains consistent, even with such substantial progress made in countries where the gap has decreased. Reasons as to why gender wage gap exist so heavily, slightly differs from country to country, but the overall effect from the wage disparity is wholly evident.
From the beginning of history and to this day women still get paid less than the average man, but why? Whoever said that women are incapable of good work performance? Whoever said that women do not have the same responsibilities to maintain? What really makes a women’s work inferior to men? The answer is nothing. Today, women are depended on just as much as men, and are capable of performing at their level. However, a full-time working woman earns only seventy-seven cents for every dollar a man makes. These days women make up half the workplace in our society; they work just as hard and for the same reasons. Women deserve to be paid at an equal rate as men because they are relied on to uphold the same responsibilities and are just as qualified to perform at a man’s level.
It is very important to be concerned about the issue because it is constantly increasing throughout the United States. It upsets me that women are paid less than men because women have the same ability and work ethic as men do, but they are looked at differently. According to AAUW, women make 77 percent of what men make. This rate hasn’t changed since 2002 (Hill, 2013). Statistics show that women will never make as much as men due to the thought of never being comparable to men (Williams, 2013).

Despite government regulations to promote equality within the workplace, women’s salaries continue to lag behind males in similar career with similar experiences. According to research performed by Blau & Kahn (2007) “women salaries averaged about 60% of men’s until the 1970s and rose to nearly 80% by the 1990s” (as cited in Bendick, Jr. & Nunes, 2012, p.244). Today, women on average earn approximately $.81 for every dollar that men earn in the United States (Guy and Fenley P.41 2014).
Gender Inequality at a Workplace Historically, males and females normally assume different kinds of jobs with varying wages in the workplace. These apparent disparities are widely recognized and experienced across the globe, and the most general justification for these differences is that they are the direct outcomes of discrimination or traditional gender beliefs—that women are the caregivers and men are the earners. However, at the turn of the new century, women have revolutionized their roles in the labor market. Specifically in industrialized societies, the social and economic position of women has shifted. Despite the improving participation of women in the labor force and their ameliorating proficiency and qualifications, the labor force is still not so favorable to women.
