At the beginning of this assignment we were given a situation involving a child where most people’s first instinct would be to protect the child, but as the assignment went on I believe we all realized that our first instinct may not always be the correct one. When we think about things from an outsider point of view, it seems easy to make what we call the right decision, but when in the moment, making the decision takes quick thinking and reasoning to decide how best to handle the situation. Even though this seems like an unimportant fact, I believe it is important. It shows that if Jimmy had more time to make the decision and think about it longer he still would have chosen the exact same scenario. Although my immediate reaction was that the little boy needed to be the priority this ethical dilemma allowed me to look closer into what is truly right or wrong.
I believe that Jimmy acted unethically according to the theory of ethical fundamentalism. Jimmy was presented with the facts of the case and had knowledge of the code he agreed to when becoming a lawyer. The argument that Jimmy acted ethically using ethical relativism is a valid argument, but in the end, this argument does not prove that someone acted ethically or unethically. The entire argument is relative and allows any choice a person makes to be either ethical or unethical regardless of what cultural standards or laws dictate. Even under ethical fundamentalism one can say that Jimmy acted ethically because of his faith and relying on that central authority. This argument is weak in my opinion because we have no idea why Jimmy chose to act the way he did. We have no knowledge of his religious beliefs or view of the world so we cannot assume that this is why he saved the little boy. The Rules of Professional Conduct are the only undisputable information we have which provides the strongest case that Jimmy acted unethically. If Jimmy was choosing to follow a central authority in his life, it should have been the ethical standards he agreed to when becoming a lawyer. He was aware of the laws and still chose to be a lawyer regardless of whether these ethical standards violated his values. Just Ray and Jimmy started out as friends, but Ray “ratted” Jimmy out (Lehane 360). While in jail, Jimmy missed the last months of his wife’s life. After leaving jail, Jimmy swore to take his revenge on Just Ray. Jimmy liked Ray and before taking his life he said: “I was crying too hard. That’s how pathetic it was. [Ray] was blubbering, I was blubbering” (361). We can clearly see that Jimmy didn’t want to kill Ray. Jimmy knew what he was doing was wrong, but he justified his action by saying that he had to kill him on “Principle” (Lehane 361). Lehane is trying to show that revenge is often hidden under the guise of justice. Lehane is saying that in reality, there is no justice in revenge. The murder of Just Ray also led to a cycle of violence. Ray’s kids grow up with lots of resentment and they develop behavioural problems. In turn, one of Ray’s kids murdered Katie (375).
