All through its 45 year history, the Equal Employment Opportunity Commission (EEOC) has distinguished and helped dissipate discrimination in the hiring process and is persistent on guaranteeing work candidates be dealt with reasonably (EEOC, 2011). According to Helen Norton, Associate Professor at the University of Colorado School of Law, Employers and staffing agencies have advertised job openings that span across different fields. Medical professionals, restaurant and grocery managers, as well as, investment bankers have all been restricted when looking for employment. Companies’ will state that applicants looking for work must be currently employed, disqualifying those who have been laid recently and people trying to get back into the labor force. Such a relationship is quite feeble. “A blanket reliance on current employment serves as a poor proxy for successful job performance” (Norton, 2011). The Civil Rights Act of 1964 was federal legislation that prohibited discrimination in voting, public accommodations, federally funded programs, education, and employment. Title VII of the Act prohibits discrimination by covered employers on the basis of race, color, religion, sex, or national origin. The Wall Street Journal article, Kim Keough, a resident of Bethel, Connecticut, and a human resource specialist who has been unemployed since July 2008, reports that the main reason she continues to be unemployed is due to the notion that people out of work suffer unfair bias. “Recruiters have told me not to bother sending in a resume if I’m not currently employed,” said the 46-year-old Ms. Keogh. “It’s damned if you do, damned if you don’t. This may reinforce the stigma that the laid-off worker is deficient in some manner. Since most organizations are interested in hiring individuals with a high level of ability and motivation an applicant who has been unemployed for any significant amount of time may be regarded as a risk. Therein lies the problem, but for the initial lay-off of a worker there is no reason to “reenter” something you already take place in. Companies can lay-off workers based on a multitude of factors that is unbeknown to the unsuspecting employee;
