Tobacco, once recreationally customary and signified one as being “cool” has done a substantial 180 degree turn. With the knowledge that came along with the 20th century also came the harsh truth that tobacco causes illness and disease. Recently the use of tobacco has been brought into our governments legislations and state laws prohibiting tobacco use in varies of ways. With designated smoking areas outside and in parks. No smoking in bars and restaurants many smokers are being victimized by a bad habit. With the FDA's new fickle regulations on all tobacco companies products, would it be adequate for the average consumer to walk into a store and see across the counter a picture of a dead fetus on a cigarette package? Is it in the government's power to determine and force billion dollar companies to advertise against their own products? And is the propaganda on the issue of smoking gone to far? Tobacco as an industry has evolved greatly over time worldwide as well as the science's giving us the truths in all it's negativity, but the main concern the consumer should be worried about is ones nations rights and freedoms; laws and science aside.
As of June 22, 2010 a huge law drafted by the FDA came into effect for all tobacco companies to require more visual health warnings on advertisements on smokeless tobacco products and as well as taking effect for cigarette ad's within a year from date. With the new advertisements in mind many do not find the obstacle in over looking a bolded malevolent text. However, the most alarming of all advertisements are the ones that have yet to come.

...es are still at the tops of the list. It's not the government's right to regulate and force a company to advertise against itself and draw un-wanted attention to their product. Opinion should never be incorporated into a legislation without the people's vote, and with government regulations not doing so where is our rights to say enough is enough?

The tobacco industry seems like a beneficial addition to our economy. It has basically been a socially acceptable business in the past because it brings jobs to our people and tax money to the government to redistribute; but consider the cost of tobacco related treatment, mortality and disability- it exceeds the benefit to the producer by two hundred billion dollars US. (4) Tobacco is a very profitable industry determined to grow despite government loss or public health. Its history has demonstrated how money can blind morals like an addiction that is never satisfied. Past lawsuits were mostly unsuccessful because the juries blamed the smoker even though the definition of criminal negligence fits the industry’s acts perfectly. Some may argue for the industry in the name of free enterprise but since they have had such a clear understanding of the dangers of their product it changes the understanding of their business tactics and motives. The success of the industry has merely been a reflection of its immoral practices. These practices have been observed through its use of the media in regards to children, the tests that used underage smokers, the use of revenue to avoid the law, the use of nicotine manipulation and the suppression of research.
The rhetorical appeal, ethos, also has an effect on the images’ message. Your advertisement is endorsed by an activist website called thetruth.com. It is a well-known website dedicated to exposing the truth of big tobacco companies and “inspiring action in the fight to end smoking.” This support validates your advertisement and assures your audience you are a credible source worth listening

Over the last 50 years, smoking and the public image of smoking has changed dramatically. Americans have learned the harmful effects of smoking and have put a heavy disdain on the use of it. The number of new smokers has drastically dropped over the years and many that had previously smoked have stopped. Some have turned to electronic cigarettes as a safer way to intake nicotine. Over the years, smoking advertisements have changed drastically. Nowadays, tobacco advertisements are virtually non-existent in our society, but when they were abundant they depicted smoking as a cool and sophisticated activity. Today, smoking advertisements are shown by electronic cigarette companies. These companies emphasize the healthier lifestyle these products
Recently the FDA “The Real Cost” campaign ad shows a young girl asking for menthol cigarettes and shows her peeling off the skin off her face because the money isn’t enough. This commercial is geared toward people who are uninformed and think Menthols are safer than cigarettes such as young teens. The ad is seen as a reflection of the audience of young teens and a danger and caution to parents who have young teens. This ad focuses on the damage menthol cigarettes and regular cigarettes affect skin. FDA “The Real Cost” campaign advertisement is targeted to inform young teens that menthol and cigarettes don’t just cost money but also skin by using mostly pathos, a bit of logos, and it adds to the cultural struggle of preventing teens from smoking.
... With more ads showing teens the harms of tobacco usage and through education, this use of “counter-adding” could go a long way in terms of preventing more youth from picking up such a bad habit. In addition, I think far more legislation should be aimed towards restricting what is actually being put into cigarettes rather than advertisements, as these toxins and poisons are responsible for the 430,000+ average deaths each year from smoking. Yet, today is today, and as long as companies like Altria and Reynolds American have the money to play Washington, they’ll get what they want. Now it’s just up to everyone else, for the sake of the health of our future, to help push legislation that will help deter the aims of companies that basically distribute cancer to hundreds of thousands each year.
Now, cigarette ads include labels with warning signs, disturbing pictures of deceased unborn children, children with smoke formed into bags over their heads, people with amputated limbs, or pictures of gum and tooth decay. “Even if, as some enthusiasts claim, e-cigarettes can help a smoker quit, could it also entice young people to start?” (Are e-Cigarettes Safe?). Figure 3 contains an ad of a man smoking on a blu e-cig with the phrase ,“Why Quit? Switch To Blu”. This one ad out of many, surprisingly, contains a now required warning label at the bottom, warning pregnant or potentially pregnant consumers of the chance that their baby or reproductive system may be harmed. What some consumers don 't know, is that the e-cigarette owners are also the owners of the big tobacco cigarette companies. These companies clearly don 't want the smokers to quit smoking, but continue with what is argued as a “healthier”
In Lee Ann Fisher Baron’s “Junk Science,” she claims that the “food industry with the help of federal regulators” sometimes use “[a science that] bypasses [the] system of peer review. Presented directly to the public by…‘experts’ or ‘activists,’ often with little or no supporting evidence, this ‘junk science’ undermines the ability…[for] everyday consumers to make rational decisions” (921). Yet Americans still have a lot of faith in the U.S. Food and Drug Administration (FDA). According to a 2013 Pew Research study, 65% of Americans are “very favorable” or “mostly favorable” of the FDA. When it comes to what people put in their bodies, the FDA has a moral obligation to be truthful and transparent. The bottom line of the FDA’s myriad of responsibilities is to help protect the health of Americans. Deciding what to eat is a critical part of living healthily, and consumers must be able to trust that this massive government agency is informing them properly of the contents of food. While the FDA does an excellent job in many areas, it has flaws in other areas. One of its flaws is allowing the food industry to print food labels that are deceptive, unclear, or simply not true (known as misbranding). This is quite the hot topic because a Google search for “Should I trust food labels” returns well over 20 million results, many of which are blog posts from online writers begging their readers not to trust food labels. One way that the tobacco industry can be more ethical is changing their advertising strategy. I believe that today’s advertising strategy is very misleading about cigarettes. Examples of this unethical advertising is in Argentina, here 20 percent of television advertising is spent on smoking commercials, as well as in countries in and around Africa there are billboards that depict a man in a business suit stepping out of a black Mercedes as a chauffeur holds the door. This displays that cigarettes make people classy and sophisticated, making cigarettes look not only harmless but stylish. Another good example of unethical depiction on cigarettes is in Nigeria; here they promote a cigarette for graduates, with a picture of a university and a student in a cap and gown. Should tobacco and alcohol advertising be allowed on television? The ban on advertising tobacco is already in affect, however, alcohol is another harmful substance. Should liquor be allowed to be advertised, if tobacco can not advertise their product? The ban on advertising tobacco products on television and radio, was passed through legislation in 1970 by Richard Nixon. This argument like others out there has two sides, one side in favor these advertisements and the other against these advertisements. Since both of these substances are highly addictive and costly. Would we like to see these advertisements continued? Are these advertisements the hazard they are communicated to be? Through the research of these two important sides, this essay will explore which side has a stronger stance on the topic.
