The history of Canada’s Aboriginal people is a rich but tumultuous one, rife with conflict, but also full of valuable information we can emulate in our lives. Aboriginal people is the name for the original inhabitants of North America and their descendants. Though it’s unfortunate that Aboriginals, mostly those living on reservations, are seen as drunkards. Able to satisfy all of their material and spiritual needs through resources of the natural world around them. White privilege has negatively impacted Aboriginal peoples living on reservations through oppression, marginalization, and degradation.

Through legislature the people with the power, the British, would attempt to civilize First Nations. To assimilate the minority, because just by being so means your cultures and values are less than mine. In the 1820s the colonial administrations first attempt at assimilation took place at Lake Simcoe in Upper Canada. A group of Aboriginals were encouraged to colonial-style village where they’d be taught agriculture and advised to become Christians. Because of poor management, underfunding, a lack of understanding Aboriginals cultures and values, the experiment was a big failure. It most certainly did not stop there. In 1876 the Canadian government introduced the Indian Act. It is “…the principal statute through which the federal government administers Indian status, local First Nations governments and the management of reserve land and communal monies” (Parrot, 2006). The First Nations have to be given their Indian Status, a legal acknowledgment of a person’s First Nation heritage. That alone shows the difference between the government, and the Aboriginals living on reservations. The difference between First Nations and the Canadian government, in this case, quite aptly shows their relations of power. “Those in society with the most power – however defined- are in the strongest position to define the realities of difference and thereby create and recreate systems of dominance and power that determine where and how important resources like income, wealth, and access to education and health care are distributed” (Perry, 2011, p.24) Which means that the powerful Canadian government can oppress the minority Native Indians living on reserves through this very controlling legislature. The Indian Act no longer remains an undisputable aspect of the Aboriginal landscape in Canada. For years, this federal legislation (that was both controversial and invasive) governed practically all of the aspects of Aboriginal life, starting with the nature of band governance and land tenure. Most importantly, the Indian act defines qualifications of being a “status Indian,” and has been the source of Aboriginal hatred, due to the government attempting to control Aboriginals’ identities and status. This historical importance of this legislation is now being steadily forgotten. Politically speaking, Aboriginal and non-Aboriginal critics of the Indian act often have insufferable opinions of the limits of the Indian Act’s governance, and often argue to have this administrative device completely exterminated. Simultaneously, recent modern land claim settlements bypass the authority of the Indian Act over specific groups.
In this proposal our team seeks to explore the injustices within the Indian Act. To achieve this our proposed research will examine the target population being the aboriginal woman. The paper will further explore the oppressions faced by the aboriginal women within the Indian Act. In conclusion, this proposal will sum up the negative impact that the Indian Act had on aboriginal women and how it continues to oppress this population within the Canadian National discourse.
First I will define the definition of terms used in this paper. When I use the word Aboriginal, I understand this as a label given from the colonizers/ Europeans to identify Indigenous peoples. Canadian legislation defines Indigenous peoples as Aboriginal, I understand this as indifferent from the dominant ideology, therefore, the colonizers named Indigenous peoples as Aboriginal. According to teachings I have been exposed to it’s a legal term and it’s associated with discrimination and oppression. However, audiences I have written for prefer the use of Aboriginal. More premise to this reference is Aboriginal, Indigenous, First Nations, Indian and Native are used interchangeable, but it should be noted these names do represent distinct differences. Furthermore, I will use Indigenous to represent an empowering way to reference a unique general culture in Canada. Under the title of Indigenous peoples in Canada, for me represents: First Nations people, Metis people and Inuit peoples. These are the two titles I will use when I reference Indigenous people from an empowering perspective and Aboriginal from a colonizer perspective.

The Indian Act is a combination of multiple legislations regarding the Aboriginal people who reside across Canada, such as the Gradual Civilization Act of 1857 and the Gradual Enfranchisement Act of 1869 (Hanson, n.p.). The Gradual Civilization Act was the Canadian government's attempt to assimilate the aboriginals into the Canadian society in a passive manner, through a method they encouraged called Enfranchisement. Generations of native people in Canada have faced suffering and cultural loss as a result of European colonization of their land. Government legislation has impacted the lives of five generations of First Nations people and as a result the fifth generation (from 1980 to present) is working to recover from their crippled cultural identity (Deiter-McArthur 379-380). This current generation is living with the fallout of previous government policies and societal prejudices that linger from four generations previous. Unrepentant, Canada’s ‘Genocide’, and Saskatchewan’s Indian People – Five Generations highlight issues that negatively influence First Nations people. The fifth generation of native people struggle against tremendous adversity in regard to assimilation, integration, separation, and recovering their cultural identity with inadequate assistance from our great nation.
Living in Canada, there is a long past with the Indigenous people. The relationship between the white and First Nations community is one that is damaged because of our shameful actions in the 1800’s. Unnecessary measures were taken when the Canadian government planned to assimilate the Aboriginal people. Through the Indian Act and Residential schools the government attempted to take away their culture and “kill the Indian in the child.” The Indian Act allowed the government to take control over the people, the residential schools took away their culture and tore apart their families, and now we are left with not only a broken relationship between the First Nations people but they are trying to put back together their lives while still living with a harsh reality of their past.

As a result, the Aboriginal women of Canada lost their sense of purpose and responsibility, burdening them with less respect and power compared to the men.
