Recent data provided by the Federal Bureau of Investigations indicates that there were an estimated, 1,165,383 violent crimes committed nationwide in 2014 (FBI, 2015). According to the average statistics presented early on in this research, 25-45 percent of those offenders are likely to have claimed amnesia for their crime. Based on those percentages, between 290,000 and 524,000 violent offenders attempted to exploit the inexplicit protocols, and classifications forensic psychologists’ have left undetermined for genuine versus simulated amnesia. Current research on crime related amnesia has been primarily focused on the victim’s memory recall and the validity of eyewitness testimony, leaving the offender’s memories untouched. Victim memory information is readily available and presented due to its inconsequential nature, unlike offender memories. Typically containing a negative connotation, violent offenders are disinterested in supplying legal or psychological evaluators with information relating to any memories of their crime. Offender memories are thus required to be obtained through the recollections of simulated offenders, in mock crime clinical evaluations.
An investigation into the variations of amnesia as well as their possible causes has concluded that amnesia assumes either dissociative or organic forms. In conjunction with this information, both forms can be observed in violent malingerers attempting to escape from criminal responsibility. Findings related to dissociative amnesia indicate that it is preferred for simulation, due to its unreliability of tangible evidence. ...s in current studies resulted in higher accuracy when determining simulators from genuine amnesia. The pitfall of these studies was the inability to accurately determine genuine amnesic individuals from those perceived to be malingers; altering the participants in future studies to include incarcerated criminals is likely to increase the accuracy of the determination. Offering similar incentives to incarcerated criminals could potentially increase the accuracy of the present analysis. In addition, forensic psychologists will need to collaboratively establish a singular set of evaluative techniques that can be reliably expressed in multiple case scenarios; excluding the present complication of personal variances within each test. Without improvement to the present evaluations, criminal malingering will persist and increasingly evade forensic psychologist’s attention.
