Case Study Analysis – Ban on Tobacco Advertising by the Government of India The connections held amongst the Government, the Tobacco Industry and the health of citizens has been a controversial and complicated topic for decades. This case analysis will focus on the ban on tobacco advertising in India. First, the ideas and arguments will be discussed for both the supporters and those who opposed the ban. The next topics will include the conflict of interest in regards to the government of India and my opinion on what governments should be doing in regards to tobacco advertising. If the product is so terrible the government must intervene and protect the citizens, why wouldn’t they completely protect them. In my mind the entire industry needs to be reevaluated. I look at tobacco no different than I see other drugs such as marijuana and heroin. This is not to say I don’t believe in the right for citizens to choose, this would bring us to a completely different topic, but if one is banned all should be banned and on the contrary if one is legalized then all should in turn be legalized. In my opinion governments should take a look at current policies and see how they treat other substances and retain the equivalent throughout or make changes throughout. Even though I know and understand firsthand the effects smoking has on an individual’s health, I have to stand by and conclude if the product is legal than advertising should be as well. Rather than banning advertisements for tobacco products pushing knowledge and advertising the motives not to smoke are more powerful and will reap greater rewards. Tobacco companies should be prevented from using advertising tactics that target teenagers. There has always been controversy as to how tobacco companies should prevent using advertising tactics to target teenagers. As controversial as this is tobacco companies shouldn’t advertise teen smoking. Many teens may be lured to believe cigarette advertising because it has been part of the American Culture for years, magazine ads and the media target young people, and these companies receive a drastic increase financially; however, the advertising by these cigarette companies has disadvantages such as having to campaign against their own company, limiting their cigarette advertising and becoming a controversial dilemma as to encouraging teenagers to smoke. From billboards to newspaper advertisements, cigarette promotions started becoming part of the American Culture.
The tobacco industry seems like a beneficial addition to our economy. It has basically been a socially acceptable business in the past because it brings jobs to our people and tax money to the government to redistribute; but consider the cost of tobacco related treatment, mortality and disability- it exceeds the benefit to the producer by two hundred billion dollars US. (4) Tobacco is a very profitable industry determined to grow despite government loss or public health. Its history has demonstrated how money can blind morals like an addiction that is never satisfied. Past lawsuits were mostly unsuccessful because the juries blamed the smoker even though the definition of criminal negligence fits the industry’s acts perfectly. Some may argue for the industry in the name of free enterprise but since they have had such a clear understanding of the dangers of their product it changes the understanding of their business tactics and motives. The success of the industry has merely been a reflection of its immoral practices. These practices have been observed through its use of the media in regards to children, the tests that used underage smokers, the use of revenue to avoid the law, the use of nicotine manipulation and the suppression of research.
Cigarette advertisements reflect society’s love-hate relationship with tobacco products through the ages. During its heyday of popularity, cigarette advertisements were not governed in any way, allowing tobacco companies to use any means necessary to sell their products including advertising during popular children’s television shows. This practice came under scrutiny around 1964 when the Surgeon General released its first report on “smoking and health.” This report stated that smoking may be hazardous to your health. Soon to follow the release of this report was a ban on all cigarette advertisements on television and radio.

Tobacco use is a debate worldwide and everyone has their own opinions about the issue. This is such a controversial issue because of the many different health risks, weather it is beneficial or not, the harmful aspect, and its importance of an individual’s freedom. Tobacco has no general advantages towards someone’s health, as it destroys the lungs and can cause cancer anywhere in the body from all the carcinogens. In my opinion the production and sale of tobacco should be banned in the United States.

Cigarette companies are doing all they possibly can to make money, just like every other company. These tobacco companies do not care about the consumers and the risks that come along with consuming tobacco products. Yes, I am aware that these multimillion dollar operations need to make money, but however on the other hand the way that cigarettes get advertised should not end up with that country getting in trouble from those companies.
