In this essay I will propose that colonialism and the ‘Immigration Restriction Act aka White Australia policy’, are not dead, not just yet anyway. I will briefly outline some of the tensions in the community which led to the implementation of this policy in 1901. I will also investigate how the media of the day helped this policy along. I will then go on to explain how this policy, which was enacted to stop non Europeans entering Australia, effected the Indigenous population throughout the life of said policy. I will then go on to see if some points from this policy are being revived in today’s political environment, or is it just coincidence that these new legislations seem to align themselves with the 'White Australia' policy of yesteryear. Also I will briefly examine if these new policies breach the ‘Human Rights Act’. One in particular, Operation Sovereign Borders, designed to stop refugees entering the country illegally. By the end if this essay I should be able to answer the question posed above.
The Immigration Restriction Act was the main component of a package of legislation acknowledged by the new Federal Parliament in 1901. It was premeditated to exclude all non-European migrants and also the Indigenous population who were deemed as not being Australian. This package also incorporated the ‘Pacific Islander Labourers Act and Section 15 of the 1901 Post and Telegraph Act’, which provided that ships hauling Australian mail, and therefore funded by the Commonwealth, should provide work for white labour only. The attitudes were in line with Australian nationalism of the late 1800s. And was a move to control non-European immigration to most of the Australian colonies dating back to the 1850s.

Maestro by Peter Goldsworthy provides an insight into 1960s/70s Australia and helps reinforce common conceptions about Australian culture. One common conception Goldsworthy reinforces in this text is Australia’s increasing acceptance of multiculturalism. Maestro, set in the 1960s to 1970s, shows Australians growing more accepting and tolerant of other cultures. This shift in perspective was occurring near the end of the White Australia/Assimilation Policy, which was phased out in the late 1970s/early 1980s. An example of this shifted perspective in Maestro is Paul’s father’s opinion about living in Darwin:
A Constitution is a set of rules put in place to govern a country, by which the parliament, executive and judiciary must abide by in law making and administering justice. In many countries, these laws are easily changed, while in Australia, a referendum process must take place to alter the wording of the Constitution (Commonwealth of Australia, date unknown, South Australian Schools Constitutional Convention Committee 2001). Since the introduction of the Australian Constitution in January 1901, there have been sufficient proposals to alter and insert sections within the body to reflect the societal values of the day, ensuring the Constitution remains relevant to the Australian people. Although Constitutional reform can be made on a arrangement of matters, the latest protests on Indigenous recognition and racial references within the body of the Constitution has called into question the validity of racial inclusion, and whether amendments should be made to allow for recognition. This essay will focus on the necessity of these amendments and evaluate the likelihood of change through the process of referenda.

Key events in Aboriginal Australian history stem from the time Australia was first discovered in 1788. For instance, when Federation came into existence in 1901, there was a prevailing belief held by non Aboriginal Australians that the Aborigines were a dying race (Nichol, 2005:259) which resulted in the Indigenous people being excluded from the constitution except for two mentions – Section 127 excluded Aborigines from the census and Section 51, part 26, which gave power over Aborigines to the States rather than to the Federal Government. Aboriginal people were officially excluded from the vote, public service, the Armed Forces and pensions. In the nineteenth century, the “History wars” became the fight between the most prominent historians revolving around the deception of frontier conflict between the labor and coalition. The debate aroused from the different interpretations of the violence that took place during the European colonization and to what degree. It became a crisis in history, emerging from the dispossession of the Aboriginal and Torres Strait Islanders (ATSI) that resulted in exclusion of their traditions and culture. The ATSI were the first people of Australia that brought along a different culture, language, kinship structures and a different way of life (Face the Facts, 2012). Post European colonization was a time where the ATSI people experienced disadvantage in the land they called home. With the paramount role as future educators, it demands proficient knowledge on the Australian history and one of the most influential moments in our history started from the first European settlers.

Throughout the world, in history and in present day, injustice has affected all of us. Whether it is racial, sexist, discriminatory, being left disadvantaged or worse, injustice surrounds us. Australia is a country that has been plagued by injustice since the day our British ancestors first set foot on Australian soil and claimed the land as theirs. We’ve killed off many of the Indigenous Aboriginal people, and also took Aboriginal children away from their families; this is known as the stolen generation. On the day Australia became a federation in 1901, the first Prime Minister of Australia, Edmund Barton, created the White Australia Policy. This only let people of white skin colour migrate to the country. Even though Australia was the first country to let women vote, women didn’t stand in Parliament until 1943 as many of us didn’t support female candidates, this was 40 years after they passed the law in Australian Parliament for women to stand in elections. After the events of World War Two, we have made an effort to make a stop to these issues here in Australia.

The assimilation policy was a policy that existed between the 1940’s and the 1970’s, and replaced that of protectionism. Its purpose was to have all persons of aboriginal blood and mixed blood living like ‘white’ Australians, this established practice of removing Aboriginal children (generally half-bloods) from their homes was to bring them up without their culture, and they were encouraged to forget their aboriginal heritage. Children were placed in institutions where they could be 'trained' to take their place in white society.
