Assault in the first degree Assault is a physical attack on someone without the person’s consent. In most cases, assault is a result of a fight or other dispute that rise to some level of violence. In a mutual fight, the first person to report to the police is usually not charged, and in most cases, the person who did not start the fight is usually charged in Maryland. Assault is a serious case in Maryland and it has a serious penalties, with that, one needs a experienced lawyer who can challenge the evidence and argue that the case does not warrant the penalties so that the charge amount can be reduce or the case might be dismissed. A person is guilty of assault if he or she causes a serious physical damage on the victim. Serious physical injury means physical injury that causes serious or permanent disfigurement, serious impairment of health or loss or protracted impairment of the function of any bodily organ or lime and that creates a reasonable risk of death. In Maryland Assault is defined as “an attempt to touch someone else without their consent” (Maryland Assault Defenses). In order words, touching in the sense that they threaten, punch, or hit someone with a weapon. Legally, one might wonder how sexual assault is defined. According to Massachusetts State law, there are two major categories of sexual assault against adults. One of these is rape, and the other is indecent assault and battery. When describing a physical altercation between two adults, the term is assault and battery. Assault on an individual has more than immediate effects; the effects can last a lifetime in severe cases. In all fifty states, it is a crime to hit, strike or use corporal punishment in any deliberate manner towards any person over the age of eighteen. However, this law does not apply to physical force being used on minors. Spanking, whipping, and paddling are among a few common references to this form of punishment. Physically disciplining children has had many names over the years. No matter which term is used, corporal punishment has a negative impact on every party involved. It is a widely used, socially accepted method of discipline. “Approximately 94% of three and four-year old children have been spanked in the past year (Slade & Winssow 1321). Although spanking is a widespread practice, it is becoming more controversial. The negative effects of spanking greatly outweigh the benefits. Spanking is a socially tolerated view promoting abusive patterns, and has a negative psychological impact in teaching children that pain, fear, and confusion promote conformability.
