POLICE AND ABUSE
When discussing police efforts and juvenile delinquency one can only imagine the difficulty officers encounter while performing their primary duty which is to protect the public. But how can or does one (officer) efficiently protect the community while preserving the rights of the juvenile criminals as well. We as a public have become more and more aware everyday of how hard it is for the police to work effectively, but now we are faced with a larger dilemma. The juvenile justice system was enacted to help juveniles who commit crimes learn from their mistakes or actions and to make them better citizens for our communities. The dilemma we face is having a criminal justice system that wants criminals to pay for their actions and a juvenile justice system that wants to help those who commit crimes. And who do we have in the middle of these two remarkable systems………the police.
The concept of proper policing has changed over the years and has incorporated the assistance of concerned citizens. We are leaving the crime fighting to the communities for policing. No we’re not deputizing communities, but we are involving those concerned citizens who see the downfall of not being involved anymore. We are no longer crime fighters, but we maintain order and discipline. We are not necessarily here just to stop an armed bank robbery in progress, but we are more visible in the community whereas this acts as a deterrent to commit most crimes in communities. And we let the members of the community know we are accessible at all times to be the deterrent or visible whenever they should need us.
POLICE AND ABUSE
Since officers cannot treat juveniles in the same manner as adults the idea of community policing is the greatest tool conceived. Imagine a community who is involved in every child’s life that when this particular child misbehaves in any way members of the community are the first responders and handle this situation without police involvement. Dream on I know, but when we are discussing juveniles and police officers I often believe we are too late in rehabilitating a child. Let’s look at a simple statistic of juvenile arrests in our nation:
1. 500 juveniles are arrested.
2. Of them 320 are referred to juvenile court.
3. 140 are informally handled and released.
4. 25 referred to criminal court.
5. 10 are referred to welfare.
6. 5 are referred to other police department agencies.
Studies and anecdotes have shown that our modern approach, however, is ill-equipped to reduce crime or deal with chronic delinquents while at the same time protecting their due liberties. We now stand on the precipice of decision: How can we strike an appropriate balance in the juvenile justice system? Should we even retain a separate system for children at all? The answers are usually difficult, sometimes subtle, but always possible to attain.
The objective of this essay is to examine one of the six pillars of the President’s Task Force on 21st century policing. Of the six pillars, pillar four’s target is the importance of community policing and crime reduction. The definition of community policing is the use of partnership and problem-solving methods to address public safety issues, such as crime, fear of crime and social disorders. The highlight of community policing is that it partners with residents in the community to implement public safety. Some background into how community policing came to be was in the 1960s and 70s, civil rights protest were in effect. When our thoughts turn to the criminal justice system it is only a natural instinct to assume everyone associated with policing, courts, and corrections will have to deal with juveniles sometime in their career. Young people in today’s society can be so easily influenced by social situations, peer pressure, and family members. The courts in the United States are faced with difficult decisions on a daily basis. In today's society juveniles are being tried in adult courts, given the death penalty, and sent to prison. Should fourteen-year olds accused of murder or rape automatically be tried as adults? Should six-teen year olds and seven-teen year olds tried in adult courts be forced to serve time in adult prisons, where they are more likely to be sexually assaulted and to become repeat offenders. How much discretion should a judge have in deciding the fate of a juvenile accused of a crime - serious, violent, or otherwise? The juvenile crime rate that was so alarming a few years ago has begun to fall - juvenile felony arrest rates in California have declined by more than forty percent in the last twenty years. While California's juvenile population rose by a half a million since the middle and late 1970's, juveniles made up less than fifth-teen percent of California's felony arrests in 1998, compared to thirty percent in 1978; according to the Justice Policy Institute. The juvenile arrests have dropped back, even as the population of kids between ages of ten and eight-teen has continued to grow, and the number of kids confined in the California Youth Authority (CYA) has fallen. With all the progress our society has made in cutting back in juvenile crimes there is still a very serious problem. But if locking kids up is the best way to address it, how do we explain a drop in crime when there are more teens in California and fewer in custody? First we must look at the economy around us. With so many job opportunities available more and more teenagers find honest ways to keep busy and make money. Our generation has a brighter future than the generation a decade ago. Next we look at successful crime prevention efforts: after-school programs, mentoring, teen outreach programs, truancy abatement, anti-gang programs, family resource centers. There is evidence that these programs are beginning to pay off. Sending more, and younger teens through the adult court system has been a trend across the country in reaction to crimes, such as school shootings and violent rapes. Yet evidence shows that treating youth as adults does not reduce crime. There are many issues with crime and violence in the United States, but very few are more controversial than the issue of juveniles in crime. How are juveniles getting involved in crime? What is causing America’s youth to do things that their parents should’ve instilled as morally wrong? What are ways to control and possibly eliminate these issues that affect the way we live? For the past century, criminologists have been studying juvenile related crime and a few theories have come up. These theories have, in the mid to late 20th century, been shaped into models. There are three main models dealing with juvenile crime and violence that will be gone over in pages to follow of this paper: Noninterventionist Model, Rehabilitation Model, and Crime Control Model. In this paper, the reader will see what each model discusses, and how they apply to today’s youth. At the end each model’s description, the reader will learn what I personally think about how the specific model would work. Being a recently turned 20 year-old, I feel I can give an accurate view of how, or if, the crime model would work. Living in both extremely rural(Mokane Missouri), and very urban(St Louis) has taught me a great deal about what really goes on in a juvenile’s head, and what sorts of actions would truly help to decrease crime rates among juveniles. I will give examples from the readings of chapter 13 of Making Sense of Criminal Justice: Policies and Practices, and I’ll conclude with my opinion of which model I believe works best to cope with juvenile crime.
Crime rates across the U.S. for juveniles is at all time high. Juveniles across all demographic have been punished more severely than those of the past. Contributing factors including lower socioeconomic areas such as the Detroit Metropolitan Areas & Chicago. Another positive thing about trying juveniles as adults is that those juveniles are taken from their neighborhood, and by doing this it opens the eyes of other teens who are around watching everything that happens. “We once arrested a teen right in the middle of his block. The adult system’s shifts leaked into the juvenile system, causing an increase in incarcerations even when delinquency rates were declining at the time. Juvenile reform legislations prompted more compulsory sentencing and more determinate sentences for juveniles, lowering of the upper age of juvenile jurisdiction, considerable ease in obtaining waivers to adult court for juvenile prosecution, and made it easier to gain access to juvenile records as well. Furthermore, it led to greater preoccupation with chronic, violent offenders, which in turn led to a redirection of resources for their confinement. Thereby, the absence of reliable criteria for identifying such offenders tends to stereotype all delinquents and is more likely to raise the level of precautionary confinements. These three major shifts in juvenile justice policy demonstrate the power and depth of traditional beliefs about the causes and cures of crimes in U.S. society. It also shows how the system can bend for a time in the direction of new approaches to prevention and control. The majority of the juvenile research concludes that serious harm can be done to juveniles simply being referred into the formal juvenile justice process. Police officers should really take into consideration that who they send for the formal process (Kaufman, I. 1979).At times these juveniles are just playing around and doing things that they are not supposed too and when processed they are being mixed with real delinquents and are being influenced by the wrong people which may cause them to tern deviant and later delinquents. Rehabilitative treatment has not always been seen as a right for juveniles. It hasn’t even been regarded as the best possible course of action for dealing with juveniles. This paper will explore the history of the juvenile system, define what rehabilitation is, and explore the balance between the benefits of rehabilitation and the interest of public safety.
Community oriented policing has been around for over 30 years, and promotes and supports organizational strategies to address the causes, and reduce the fear of crime and social disorder through problem solving tactics. The way community policing works is it requires the police and citizens to work together to increase safety for the public. Each community policing program is different depending on the needs of the community. There have been five consistent key elements of an effective community oriented policing program: Adopting community service as the overarching philosophy of the organization, making an institutional commitment to community policing that is internalized throughout the command structure, emphasizing geographically decentralized models of policing that stress services tailored to the needs of individual communities rather than a one-size-fits-all approach for the entire jurisdiction, empowering citizens to act in partnership with the police on issues of crime and more broadly defined social problems, for example, quality-of-life issues, and using problem-oriented or problem-solving approaches involving police personnel working with community members. The dilemma of juvenile incarceration is a problem that thankfully has been declining, but still continues to be an ethical issue. The de-incarceration trend has coincided with a decrease in crime. It is hopeful that our nation is changing the approach to the treatment of juveniles in the criminal justice system. It means we know what to do and what is working, now just to follow through and continue the change to creating a juvenile justice system that is truly rehabilitative and gives youth tools to be able to be positive members of
Juvenile delinquency is a serious problem and leads to negative outcomes for youth, families, and society as a whole. Adolescents under the age of 18 who are arrested for committing a criminal act are processed through a juvenile justice system. The juvenile justice system is grounded on the principle that the youth have different needs than adults. During adolescence, youth are forming their identities and still developing mentally, physically, socially, and emotionally. Due to their early stages of development, juveniles who violate the law should be treated differently than adults.
Conversely, police officers may suggest that there are citizens that don’t do their part to make their neighborhoods safe, which takes us back to Sir Robert Peel. Unfortunately, when the police try to empower people to be accountable, and to do their part, the interpretation is that the police are avoiding their responsibility. In any case, understanding there is work to be done by both, the police and citizens is the first step. Now, implementing the processes to make the corrections needed is merely a start.
