Personal Justice and Homicide in Scott’s Ivanhoe
Abstract: Scott’s Ivanhoe reveals a conflict between our innate concept of justice as personal justice and the impersonal justice which is imposed on us by the modern nation-state. This conflict causes the split between the proper hero, who affirms the order of impersonal justice, and the dark hero, who acts according to personal justice, in Scott’s work.
In Evolution and Literary Theory, Joseph Carroll provides a paradigm for the integration of literary criticism with evolutionary psychology. First, he argues that literary critics should learn to understand and respect the evidence for the basic contention of evolutionary psychology, namely, that the human mind is not a blank slate which receives all of its content from an external culture, but that human cognition and the culture that is based on it are highly constrained by innate psychological mechanisms, which evolved in the environment in which humans spent most of their evolutionary history, the hunting-gathering bands of Pleistocene Africa. Humans evolved a rich array of specialized mental mechanisms for dealing with this environment, including mechanisms for determining mate value (see Buss), for protecting kin (see Daly and Wilson, 17-121), for social exchange (see Cosmides and Tooby 1992) and many others. These psychological mechanisms collectively form the human nature which underlies the production and consumption of literary texts. However, the scope of an evolutionarily informed literary analysis is not limited to simply finding these human universals in literary texts. Rather, many of these psychological mechanisms are “open programs” which permit of a wide range of cultural and individual variation (Carroll 152). Carroll identifies the three levels at which a literary criticism informed by evolutionary psychology should work: human nature, cultural order, and individual identity (150). While human nature constrains all cultural productions, “cultural forms are themselves the product of a complex interaction among various innate dispositions and between innate dispositions and variable environmental conditions” (152). Evolutionary psychology enables us to understand not only literary universals, but also the complex and often conflicting relationship between human nature, culture, and the individual.
In their book Homicide, evolutionary psychologists Margo Wilson and Martin Daly identify one such conflict between human nature and the contemporary cultural order. They argue that humans have an innate concept of justice which is based on the idea of personal revenge. According to this concept of justice, it is legitimate and even praise-worthy for people to whom a wrong has been done to avenge the wrong-doing themselves.
As I was completing this assignment, I was watching the infamous Netflix documentary entitled Making a Murderer. The documentary follows the story of Steven Avery, who is currently in prison for the death of a woman, Teresa Halbach, in 2005. Steven Avery has been denying any involvement in the murder of Teresa Halbach for the past eleven years. In the middle of the reading, the documentary was exploring and analyzing Steven Avery’s deviant behavior as a young man (Making). As I observed what was being discussed about Steven Avery, I was able to build the connection between how society, and the community from which he came from, perceived Steven Avery and what Kai Erikson discussed in the first couple pages of the book with regards to deviance and its relation with regards to society.
Many businesses and factories hired children because they were easier to exploit; they could be paid less for more work in dangerous conditions. Plus, their small size made many children idea for working with small parts or fitting into small spaces. Children as young as four could be found working in factories, though most were between eight and twelve. Despite the economic gains made by the business that employed them, many children suffered in the workplace. The industrial setting caused many health problems for the children that, if they lived long enough, they would carry with them for the rest of their lives. Children were also more likely to face accidents in the workplace, often caused by fatigue, and many were seriously injured or killed. The kids under the age of fourteen were sent to go assist with the textile workers. They then would beat and verbally abuse the child. And if children would show up late, they would be weighted. Weighted means to put a very heavy weight on the child's back and have them walk up and down the factory aisles for hours, so other children can learn from it. This then resulted in back and neck injuries. (“Child Labor in Factories”) While this all seems really cruel, there were many positives that came out of child labor. Children were still able to contribute to their families. Money was a big struggle, and it had a major impact for poor families. Children were also getting a wide range of opportunities and work experiences for the future ahead. Although it might not be the best way to get experience, they were still helping out there families and showing respect towards them. In 1801, agriculture provided employment for 36% of the British population. By 1851, only 10% of the British population was employed in agriculture, while over 40% was employed in industry (Hopkins, 36). Due to the new mechanics and cheap labor, factory owners could now produce their goods at a cheaper rate.
