After examining the websites for the New York State Department of Corrections (NYSDOC), the Texas Department of Criminal Justice (TDCJ), and Kriminalomsorgen (Norwegian Correctional Services), we are given a comprehensive overview of the many similarities that each organization shares. For instance, despite the “tough on crime” approach, rehabilitation remains an integral component for all three organizations. It is important to note that although Norway places a greater emphasis on rehabilitation, each department shares similar visions, goals, and values. However, each organization also possesses a variety of opposing punishment guidelines and security procedures. An example of one of these well-known differences in sentencing is the fact that Texas still imposes capital punishment. Of course, New York does not support the death penalty, and Norway’s maximum sentence is far more merciful than either Texas or New York. The Punishment Imperative, a book based on the transition from a time when punishment was thought to be necessarily harsh to a time where reform in the prion system is needed, explains the reasons why the grand social experiment of severe punishment did not work. The authors of the book, Todd R. Clear and Natasha A. Frost, strongly argue that the previous mindset of harsh punishment has been replaced due to political shifts, firsthand evidence, and spending issues within the government. Clear and Frost successfully assert their argument throughout the book using quantitative and qualitative information spanning from government policies to the reintegration of previous convicts into society.
Every civilization in history has had rules, and citizens who break them. To this day governments struggle to figure out the best way to deal with their criminals in ways that help both society and those that commit the crimes. Imprisonment has historically been the popular solution. However, there are many instances in which people are sent to prison that would be better served for community service, rehab, or some other form of punishment. Prison affects more than just the prisoner; the families, friends, employers, and communities of the incarcerated also pay a price. Prison as a punishment has its pros and cons; although it may be necessary for some, it can be harmful for those who would be better suited for alternative means of punishment.
Many changes are made inside the justice system, but very few have damaged the integrity of the system and the futures of citizens and prisoners. Although the story seems to focus more on lockdown, Hopkins clearly identifies the damaging change from rehabilitation in prisons to a strategy of locking up and containing the prisoners. To the writer, and furthermore the reader, the adjustment represented a failure to value lives. “More than 600,000- about 3 times what it was when I entered prison, sixteen years ago. In the resulting expansion of the nation’s prison systems, authorities have tended to dispense with much of the rehabilitative programming once prevalent in America’s penal institutions” (Hopkins 157). Throughout his novel, Texas Tough: The Rise of America’s Prison Empire, author and professor Robert Perkinson outlines the three current dominant purposes of prison. The first, punishment, is the act of disciplining offenders in an effort to prevent them from recommitting a particular crime. The past two decades have engendered a very serious and historic shift in the utilization of confinement within the United States. In 1980, there were less than five hundred thousand people confined in the nation’s prisons and jails. Today we have approximately two million and the numbers are still elevating. “The question of whether the death penalty is a more effective deterrent than long-term imprisonment has been debated for decades or longer by scholars, policy makers, and the general public” (Radelet & Lacock, 2009).
Enforcing death penalty in itself deters people from getting suitable opportunity to ensure that rehabilitation is enhanced. It is necessary to note that many individuals who have been charged with capital punishment have been emotionally and psychologically unstable. Enforcing the death penalty therefore denies them room for rehabilitation. There is a need to advance towards rehabilitation as opposed to advocating for execution. If individuals know that upon committing a capital offence they will be sentenced to death, they will hardly consider reform programs. It is also crucial to note that there is no concrete evidence on advantages derived from the death penalty. The truth is that it only aids in perpetuating death and chains of violence. Prisons should serve as centers to rehabilitate violent fellows, and then return them to the community as fully reformed and responsible individuals. It is therefore not justifiable that a death penalty should be enforced to them at all
For centuries, prisons have been attempting to reinforce good behavior through various methods of punishment, some more severe than others. There are several types of punishments which include “corporal punishment, public humiliation, penal bondage, and banishment for more severe offenses, as well as capital punishment”(Linklater, V). Punishments in which are more severe pose the question “Has it gone too far?” and is stripping away the rights and humanity of a criminal justified with the response it is for the protection of the people? Is justice really served? Although prison systems are intense and the experience is one of a kind for sure, it does little to help them as statistics show “two-in-five inmates nationwide return to jail within three years of release”(Ascharya, K).
In Western cultures imprisonment is the universal method of punishing criminals (Chapman 571). According to criminologists locking up criminals may not even be an effective form of punishment. First, the prison sentences do not serve as an example to deter future criminals, which is indicated, in the increased rates of criminal behavior over the years. Secondly, prisons may protect the average citizen from crimes but the violence is then diverted to prison workers and other inmates. Finally, inmates are locked together which impedes their rehabilitation and exposes them too more criminal
Society has long since operated on a system of reward and punishment. That is, when good deeds are done or a person behaves in a desired way they SP are rewarded, or conversely punished when behaviour does not meet the societal norms. Those who defy these norms and commit crime are often punished by organized governmental justice systems through the use of penitentiaries, where prisoners carry out their sentences. The main goals of sentencing include deterrence, safety of the public, retribution, rehabilitation, punishment and respect for the law (Government of Canada, 2013). However, the type of justice system in place within a state or country greatly influences the aims and mandates of prisons and in turn targets different aspects of sentencing goals. Justice systems commonly focus on either rehabilitative or retributive measures.
This form of justice emphasizes the philosophy that everyone deserves a second chance. The largely successful Norwegian prison system emphasizes the need to not treat criminals cruelly. Oftentimes, those who commit crimes have been bred in environments that have led them to where they are; sometimes they’ve been subject to childhood abuse. In cases like the Jassi Sidhu case, it would seem rehabilitation is a far off concept. The individuals that conspired to murder Jassi Sidhu have been bred to think a certain way their entire lives and changing that would not be an easy task. However if we punish individuals without attempting to help them better themselves, we as a society have reached a dead end, as Judge John Reilly said,” If we only punish wrongdoing with no attempt to fix the underlying causes, we only damage the web of our society.”
“The history of correctional thought and practice has been marked by enthusiasm for new approaches, disillusionment with these approaches, and then substitution of yet other tactics”(Clear 59). During the mid 1900s, many changes came about for the system of corrections in America. Once a new idea goes sour, a new one replaces it. Prisons shifted their focus from the punishment of offenders to the rehabilitation of offenders, then to the reentry into society, and back to incarceration. As times and the needs of the criminal justice system changed, new prison models were organized in hopes of lowering the crime rates in America. The three major models of prisons that were developed were the medical, model, the community model, and the crime control model.
All over America, crime is on the rise. Every day, every minute, and even every second someone will commit a crime. Now, I invite you to consider that a crime is taking place as you read this paper. "The fraction of the population in the State and Federal prison has increased in every single year for the last 34 years and the rate for imprisonment today is now five times higher than in 1972"(Russell, 2009). Considering that rate along crime is a serious act. These crimes range from robbery, rape, kidnapping, identity theft, abuse, trafficking, assault, and murder. Crime is a major social problem in the United States. While the correctional system was designed to protect society from offenders it also serves two specific functions. First it can serve as a tool for punishing the offender. This involves making the offender pay for his/her crime while serving time in a correctional facility. On the other hand it can serve as a place to rehabilitate the offender as preparation to be successful as they renter society. The U.S correctional system is a quite controversial subject that leads to questions such as how does our correctional system punish offenders? How does our correctional system rehabilitate offenders? Which method is more effective in reducing crime punishment or rehabilitation? Our correctional system has several ways to punish and rehabilitate offenders.
Many people idealized the relevancy of living in a civilized world, where those who break the law are reprimanded in a less traditional sense of punishment in today’s standard. Instead of just doing hard time, programs and services could and should be provided to reform and rehabilitate prisoner. Despite the very strict methods needed in order to accomplish prisoner reformation, this type of punishment was still a far cry from the public executions that were popular in earlier history. Policy makers, the public and a new generation of thinkers are now focused on stabilizing American society and improving the conditions of mankind (Rotham), particularly when it comes to the criminal justice system rather than simply demonstrating power and control to try and maintain deterrence.
