Should handguns be legalized?
As we all know, guns as a whole have been a controversial issue for people from all walks of life. One side feels that guns should be legalized and the other side that feels guns should be completely illegal. When someone is in a dangerous situation, he or she should have the right to defend his or herself. However, if one is against guns, how is that person going to be able to defend him or herself? Because of this, I am a huge proponent of guns when it comes down to being in a dangerous situation. What some people fail to realize are the reasons why people need a gun in the first place. Some argue that guns kill people and the misuse of guns is growing at an alarming rate. The way I see it, people kill people and guns are not the only weapon of choice. I feel that guns should be legalized because it’s our country’s second amendment, individuals who live in bad neighborhoods need them, people who are put in dangerous situations also need them, guns also provide a sense of security and more guns decreases the crime rate.
It is clear that our Second Amendment guarantees our right to bear arms. The author of “Guns as Smut Darrell Miller” states that the U.S. Supreme Court held that our Second Amendment guarantees an personal individual the right to keep and bear arms (1278). Miller also reports that our Second Amendment guarantees an individual the right to keep and bear arms for personal protection (1280). Author Edwin Vieira Jr. states that it is undoubtedly true that all citizens are capable of bearing arms (23). With our country’s second Amendment, living in urban areas with high crime rate, people being put in bad situations, guns providing a sense of security, and guns decreasing crime rates, it is evident that I have legitimate reasons why handguns should be legalized. Although Americans have the right to defend themselves but furthermore, the use of guns should come with responsibility.
In America guns have been a part of the country’s society since it’s birth. Throughout history the citizens of the US have used firearms to protect the nation, protect their families, hunt for food and engage in sporting activities. The issue of Guns and gun control is complex. Weighing the rights and liberties of the individual against the welfare and safety of the public has always been a precarious balancing act. In the United States, gun control is one of these tumultuous issues that has both sides firmly entrenched in their positions. Those parties in favor of gun ownership and the freedom to use and keep arms, rely on the fact that the provision for such rights is enshrined in their constitution. In this climate of growing violence, rife with turmoil and crime, gun advocates feel more than ever that their position is justified. As citizens of the “Land of the Free” possessing a gun is a fundamental right, and may even be a necessity... Anti- gun lobbyists point to the same growing violence and gun related crimes in an effort to call on the government to take action. By enacting more laws and stricter control, these people not in favor of guns feel society would be better safer.
For hundreds of years Americans have been growing up with the notion that it is a right to own a gun. Since the creation of the second amendment, people all over the United States have been able to guns for private use. Guns operated by the public are said to have a variety of uses such as, being able to protect oneself if conflict arises, grants the ability to put food on the table, and are used in competitions shooting targets against other people. But for many people guns have been seen as the root of all evil. Anti-gun users think that guns cause a variety of unexpected and innocent deaths. They also think that there are not enough laws in place that allow just about anyone to purchase a gun. The question of should guns be legal to all citizens has plagued our society. Do you think it is morally right for anyone to arm themselves and use it when they deem it to be necessary? Or do you think that the 2rd amendment seem unnecessary and outdated law that needs to be rewritten? These questions are just two of many that have thrown back and forth between pro-gun and anti-gun users.
Some people will argue that the US Constitution allows citizens to bear arms only for a well regulated militia, A militia being an army composed of ordinary citizens. This is true that militia is necessary to the security of a free state. They also proclaim that the provision “The constitutional right of the people to keep and bear arms shall not be infringed” the Second Amendment does not mention handguns by explaining that carrying a concealed handgun increases the chances of a confrontation escalating and turning lethal. Gun control supporters maintain the thought and believe that the use of handguns is not stated in the constitution and is considered dangerous. Many also believe that it is too easy to get a gun. Many believe this. but they are sadly mistaken.
The second amendment grants all Americans the right to bear arms. The ability to hold a firearm at any time as long as the firearm is registered. In the United states, all it takes to hold a firearm is a background check and a safety class. In a short reading from the “American Now” book a short article By Christina Tenuta called Responsible gun ownership saves lives she asks “do Americans really need guns?”, but are the guns really the problem? Although the second amendment requires some decent documents , the qualifications to obtain a firearm needs to be revised to a mental check, a family history check , and also to make it a priority for reinforcement to check on the registered firearm every six to twelve months.
One of the biggest reasons that handguns should not be banned is because of the Second Amendment. The Second Amendment states, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” People who argue that guns should be banned state the Second Amendment was not intended for the regular civilian, but rather the militia. This is where they are wrong. The Supreme court has taken a case like this in Heller vs District of Columbia. Heller had been caught using a handgun and sued the U.S. on the right for civilians to bear arms. The Court decided and interpreted the Second Amendment as the right for all the civilians to bear arms and not just the militia. There were and are good reasons for this, luckily they are still practiced today. Back in the day guns used to be for hunting and, on the occasion self defense. But when the colonists of this country had enough of British rule, they picked up there own personal guns and went to war and the British saw first hand how powerful the rough band of average American gun owners were. Today in the United States many people argue over the fact of guns being legal or illegal. There are people using guns for personal safety and there are others who use them for crimes, as well as for other situations. Firearm deaths in the United States have slowly been decreasing from year to year with all these bills getting passed to promote a safer country than ever before. Guns are the main weapon for youth suicide, school shootings, and for committing murder. In 2010 there were 2,711 infants, child, and teenage firearm deaths. As in school shootings and in committing murder, studies show shooters often had multiple, non-automatic guns, shootings were planned, most youth tell before shooting, shooters have a history of being bullied or threatened, shooters have mental issues, and shooters have done suicidal gestures before (Gun Control with School Shootings). In 1968 Congress passed the Gun Control Act. This act regulates interstate commerce in firearms, making it so that you must be a licensed manufacturer, dealer, or importer. The Gun Control Act was the first attempt at restricting easy access to a firearm. In 1976 the District of Columbia City Council prohibited it’s residents from owning a handgun. Dick Anthony Heller sued the district in 2007 for denying him the right to keep his handgun in his home on Capitol Hill. In June 2008, the Supreme Court ruled the District of Columbia’s handgun ban was unconstitutional. The people of this country believe in their reserved rights, Mr. Heller’s fought for his second amendment right and won, showing the spirit of democracy. Since the Columbine High School shootings in 1999, 27 separate mass shootings have left five or more people dead each time. These randoms acts of violence have taken place in schools (Sandy Hook, Virginia Tech), the workplace (Fort Hood), movie theaters(Aurora, CO) , and even in the church (Charleston, S.C.). Everyday seems to bring new tragedy involving guns, but is it the gun that is killing people or the operator? As with anything, there are pro and cons to the right of own a firearm. With a firearm in your possession, you can protect yourself and your family from just about any threat. Having a gun gives you power over your own life, but this power also extends over someone else life
Nevertheless, guns are very dangerous and they are used in all sorts of criminal activities already. Therefore, the benefits of having a gun outweigh the drawbacks of not having a gun.
