If medication heals one's corporeity, then law is the medicine for society, maintaining the process of societal order. If religion rectifies one's soul, then law is the religion for society, shaping people's morality and leading to a harmonios society. Law is the "operating system" shaping the society! But is also influenced by people, politics, and social institutions, therefore reflecting the society as a whole! The diverse and multifaceted nature of law, but also it's inseparable relationship permeating almost all aspects of the society attracts and induces me to study law at degree level.
I’ve also thoroughly enjoyed eye-opening texts such as "What about Law?", and I've gained an insight of studying law as an academic subject with the use of legal reasonings to reach a conclusion. I've also gained a deeper understanding of the seven core areas in English law, and the field of Human Rights particularly drawn my attention for it's paradoxical relationship with the application of criminal law for having both a defensive and offensive role. This depicts the complex, yet fascinating nature of law. Moreover, the controversy of Human Rights for elderly also aroused my sympathy as a reflection of my observations on current affairs:
Behind the wealthy image of Hong Kong, the aging population and widening income gap also sheds light on the lack of care and protection mechanisms for elderlies. I've been the eyewitness of elderlies picking rubbishes and facing homelessness. Reading the "Protection and gaps under human rights law" has taught me that elderlies may also face multiple age-related discrimination which worsens the issue. This shouts a need for reform! Elderlies should also be included in the category for special care and atte...

...adminton competition, and also a 3rd place for table tennis. Both have improved my communication and team work skills, but also balanced between my academic and social life, and I would continue this balance whilst at university.
Throughout the course, I've endeavored to achieve high academic standards, and rewarded with a scholarship of 75% fee remission. I'm dedicated to continue to invest time in my studies, and studying in the UK provides the opportunity to acquire superior education and qualifications, while enjoying a full social life. Personally, this also provides an ideal career prospect in HK for their similar legal system based on the common law.
I would relish the opportunity of studying a law degree and believe that I possess the appropriate skill-set to cope with the challenge and workload involved, making a positive contribution to university life.
Legal consciousness refers to how people’s different conceptions of law determine whether they mobilize or resist the law (SOC216, Jan. 26). Susan S. Silbey and Patricia Ewick disclose three narratives of how people perceive the law: before the law, with the law and up against the law (2000). Individuals who are before the law fundamentally treat legality as an objective realm that is removed from their ordinary social lives (Silbey and Ewick 2000). They believe that the law is a hierarchical classification of rules that is both majestic and impartial (Silbey and Ewick 2000). In regards to ‘with the law’, legality is described and played as a game, in which existing rules can be arrayed accordingly and new rules can be invented in order to serve the individual’s interests (Silbey and Ewick 2000). Legality is described as a “terrain for tactical encounters” where
Legal Studies Essay Joey Agerholm Exclusion clauses determine the liability of something that might go wrong within a contract. They are used by sellers as an attempt to avoid or limit their liability. The seller has the advantage over the buyer who must agree to the clauses to purchase the product/service. Because of the buyers disadvantage the court takes such cases, involving exclusion clauses, very seriously, and the content of the clauses are carefully interpreted. With the current Trade Practises Act and the Fair Trading Act the standard form of business contract is adequate and effective in protecting the buyer. The Trade Practise Act is the most effective legislation for the protection of the consumer. It implies to the following situations:- - “A promise by the seller that the buyer will become the owner” If a car dealer breaks a promise or part of a contract, for example that he has the right to sell a car, and the car is stolen then although the buyer will have to give the car back he/she will get her money back. - “ A promise by the seller that goods will fit the description supplied by the seller” In this case the buyer is protected if the seller makes a promise, which is a condition of the contract, describing the product, and when the buyer receives the product, it does not match the description. - “ A promise where the seller is made aware of the purpose for which the goods are required, that the goods will be reasonably fit for that purpose” This condition is implied when the buyer makes the purpose of the goods needed known to the seller, and the buyer then relies on the seller’s judgement in providing the correct product. For example it would not be reasonable if you made the seller aware that you wished to purchase something suitable for mowing the average suburban backyard and you were sold a tractor. - “A Promise that goods are of merchantable quality” According to this act a good is considered to be merchantable if they are suitable for the prospect for which other similar goods are sold, involving the description applied to them, the price and any other relevant information. This act does however does not protect the consumer if he/she has examined the product and missed any defects that should have been seen or if the seller made him/her aware of the defect prior to the purchase of the product.
Civil law is interesting to me because it protects the private rights of all, and in this nation’s current state, I think that’s as important as ever. Compared to common laws, these laws are put in place based off rules and codes that are established. I’ve had experience in the civil law by owning and operating a business. Due to the laws and practices that are in place, it’s easy for me to run my operation. Another situation that I’ve found myself in dealing with civil law is when I was attempting to break a lease due to miswording in a signed contract. This was a long process, but in the end, I won the case due to them adjusting their contract without their customer’s knowledge.
The usual perception of law to most individuals is a world in which many factors and external beings control a fixed system and its failure to inhabit equality and justice. The understanding and meanings of law have different definitions on social relations which explains why the common thought in mind when asked about the law is in regards to a speeding ticket or encounters with the law enforcement. However, people perceive the law differently based on their everyday life and how it effects their life in the long-run. The way people understand and experience legal authority is shown by how they engage, avoid or resist the law and legal meanings. This is catorterized as the study of legal consciousness.
Law is a very important aspect of our lives which lays down the principles of our day to day activities. There is not a right or wrong definition of law, however it can be defined in various ways such as a set of rules and regulations created by the Parliament enforced through institutions that plays an important role in the creation and maintenance of social order and which regulates every aspect of our lives, another definition is provided by Sir John Salmond who defines law “as being the body of principles recognised and applied by the state in the administration of justice”.
Today schools are changing to integrate the 21st century. Therefore, it is imperative that educational administrators are aware of the legal framework facing the issues in schools. There are many issues the administrators will face and they must know the constitutional rights of individuals and the school. The Constitution contains the laws of the United States.
In every society around the world, the law is affecting everyone since it shapes the behavior and sense of right and wrong for every citizen in society. Laws are meant to control a society’s behavior by outlining the accepted forms of conduct. The law is designed as a neutral aspect existent to solve society’s problems, a system specially designed to provide people with peace and order. The legal system runs more efficiently when people understand the laws they are intended to follow along with their legal rights and responsibilities.
Population ageing is currently one of the most significant demographic trends and becoming a worldwide problem(cite) specially among the elderly who are often the most recognized and forgotten group in this analysis. They are recognized as the ’elder’ the wisest, and perhaps the most knowledgeable about life and its experiences. This population however, is forgotten in terms of the respect and value it once contributed to society. And in today’s world this group is often marginalized because of age. The older they get, the more useless they become in the eyes of society and thus this attitude viewed towards the elderly leads to neglect and abuse. They are therefore excluded from the active participation, and decision making in society. This isolated group is thus discriminated against on the basis of age and gender which can be referred to factors such as ageism and sexism. Nevertheless, these factors not only attribute to elder abuse but are viewed differently within subcultures. Therefore, it is important to examine why elder abuse occurs and what are its consequences in the context of human rights agenda.
My personal and educational growth in college and subsequent professional experience provided an avenue for a career choice, working in law. I have learned that the law protects on all levels from the multi-million dollar client to the single mom who can barely feed her children. It is through this that I can continue to make a difference in my and others’ lives. Emory Law offers me the opportunity to further my goals through its International Humanitarian Law Clinic, Volunteer Clinic for Veterans, and the multiple of chances to help others through my blossoming legal knowledge while in school. All of these would add pieces of my puzzle and help bring into focus the bigger picture of my puzzle. Through attending Emory Law I will continue to create change through helping and ultimately find where I fit in this greater human puzzle.
Shouldn’t we be helping and taking care of the obliterated elderlies? Poverty in Hong Kong is due to the lack of resource the poor have, not being able to live a good life in this cosmopolitan city. Nowadays, there are a lot of poor families or elderlies living in an extremely poor conditioned areas. Due to their lack of resource, they are forced without any solutions to live in places like cage homes, squatter settlements, and roof -top houses. Another reason why poverty is caused in Hong Kong is because the government doesn’t give attention to the poor. For example, families living in subdivided flats registered for public housing have waited for a very long time but still doesn’t get an official reply. One of the problems caused by poverty is 1 in 3 seniors struggle to meet their nutritional needs. The population of Hong Kong is approximately 7.155 million and 1 in 6 people is living in poverty which means around 1191666 people are living in poverty. Senior Citizen Home Safety Association helps the elderlies to live a quality life of their own choice in the community.
Law is the foundation of central structures of social life on which society’s integrity depends, which is why Petrazycki, Ehrlich and Habermas perceive it to be a key steering mechanism in society,
Law is the framework which applies to members of the community and sets the binding values and standards recognized by its subjects. It regulates their behaviour and it reflects the principles ...
Both law and morality serve to regulate behaviour in society. Morality is defined as a set of key values, attitudes and beliefs giving a standard in which we ‘should’ behave. Law, however, is defined as regulating behaviour which is enforced among society for everyone to abide by. It is said that both, however, are normative which means they both indicate how we should behave and therefore can both be classed as a guideline in which society acts, meaning neither is more effective or important than the other. Law and morals have clear differences in how and why they are made. Law, for example, comes from Parliament and Judges and will be made in a formal, legal institution which result in formal consequences when broken. Whereas morals are formed under the influence of family, friends, media or religion and they become personal matters of individual consciences. They result in no formal consequence but may result in a social disapproval which is shown also to occur when breaking the law.
Law is one of the most important elements that transform humans from mere beasts into intelligent and special beings. Law tells us what is right and wrong and how we, humans, should act to achieve a peaceful society while enjoying individual freedoms. The key to a successful nation is a firm, strong, and fair code of high laws that provides equal and just freedom to all citizens of the country. A strong government is as important as a firm code of law as a government is a backbone of a country and of the laws. A government is a system that executes and determines its laws. As much as fair laws are important, a capable government that will not go corrupt and provide fair services holds a vital role in building and maintaining a strong country.
At this stage of my life, I have many ambitions, the first step of which is to carry out my Masters studies in Automotive Engineering. Attending U.K. universities is surely a dream for distinguished students all over the world, especially the ones who are passionate about education. Secondly and a more subtle reason being acquiring a degree that has global recognition has become a necessity if one desires to carve out a niche for oneself in this increasingly global economy. Given a chance I shall prove my worthiness.
