Juvenile crime is a growing problem that endangers virtually every American. Juvenile delinquency is enormously damaging to the health and well-being of the nations families and communities. A juvenile crime can consist of DUI, robbery, rape, minor in possession, weapon in possession anything an adult can be charged with. Individuals under the age of eighteen who commit these crimes can be charged as a juvenile delinquent. Statistics show that most juveniles that commit crimes are in a gang; weather its street related or school related. The average cost of caring for an incarcerated juvenile is more than $40,000 a year. There is an abundance of evidence from studies of hidden misbehavior in which youths admit behavior ranging over the entire gamut of delinquent acts. Most of the juveniles who confess these actions indicate that they have had no dealings with the police or the courts. Even in areas with high rates of official delinquency, the true extent of juvenile misconduct is far greater than reflected in police or court records (3). Juvenile Crime is a major problem through out the world. If juveniles are to be prosecuted as adults, juvenile’s legal capacities should be comparable to adults, and weather individuals perceive juvenile who commit adult crimes with adult consequences to do better able to assist in their own defense or understand the charges against them in comparison to adolescents who do not commit these crimes is currently unknown. There is a great deal of controversy over the trying and sentencing of juvenile offenders today. Many will argue that because the severity of Juvenile crimes has risen, the severity of its consequences should rise; however, no matter how serious the crime is, juvenile offenders tried as adults receive far worse than they deserve. The majority of Juveniles tried as adults are hardly given any form of human rights. Adult jails are not the environment children should have to experience, especially those sentenced for misdemeanors and nonviolent crimes. There are other solutions to reducing juvenile crime. It does not take adult court to straighten out kids on the wrong path. Most children are not even able to recognize that what they had done is wrong. There may be no perfect solution to reducing juvenile crime, but there are ways far more effective than adult trying and sentencing.
Within the last five years, violent offenses by children have increased 68 percent, crimes such as: murder, rape, assault, and robbery. Honestly, with these figures, it is not surprising at all that the Juveniles Courts focus less on the children in danger, and focus more on dangerous children. This paper will analyze the different theoretical issues pertaining to the modern juvenile court, determine their origin, and suggest a course of action for resolving these issues to the best extent possible. It is important to note, however, that the juvenile justice system alone cannot ever prevent all juvenile crime, respond perfectly to every situation or treat every suspect fairly. Furthermore, an effective antidote to modern juvenile crime would necessitate far broader action, addressing underlying social structure inequalities that breed poverty and social disorganization.
The problem of dealing with juvenile justice has plagued are country for years, since the establishment of the first juvenile court in 1899. Prior to that development, delinquent juveniles had to be processed through the adult justic3e system which gave much harsher penalties. By 1945, separate juvenile courts existed in every single state. Similar to the adult system, all through most of the 20th century, the juvenile justice system was based upon a medical/rehabilitative representation. The new challenges of the juvenile court were to examine, analyze, and recommend treatment for offenders, not to deliver judgment fault or fix responsibility. The court ran under the policy of “parens patriae” that intended that the state would step in and act as a parent on behalf of a disobedient juvenile. Actions were informal and a juvenile court judge had a vast sum of discretion in the nature of juvenile cases, much like the discretion afforded judges in adult unlawful settings until the 1970s. In line with the early juvenile court’s attitude of shielding youth, juvenile offenders’ position was often in reformatories or instruction schools that were intended, in speculation, to keep them away from the terrible influences of society and to encourage self-control through accurate structure and very unsympathetic discipline. Opposing to the fundamental theory, all through the first part of the century, the places that housed juveniles were frequently unsafe and unhealthy places where the state warehoused delinquent, deserted, and deserted children for unclear periods. There is no doubt that youth justice practises have changed throughout the years, these changes have been made to adapt to the new challenges that present themselves today. Crime in general, but particularly youth crime is a consistent problem for society.
Though crime, in general, is on the decline there are specific crimes and group offenders that are actually increasing. Specific crimes such as hate crimes, those crimes motivated by hostility to the victim as a member of a group, based on color, creed, gender, or sexual orientation, and juvenile crimes have become escalating debates. Lionel Tate, a 12-year-old boy at the time of his actions, is a suitable case to investigate. Using his case, I will address the increase in juvenile delinquency, the contributions to the malice acts, the severity of the crimes being committed by youth, and possible, yet reasonable repercussions.
Vandergoot determines that the reasoning capacity of an adolescent, the ability to make legal decisions, and filter unnecessary information is unclear to a juvenile in the justice system; the vagueness of youth stepping into the courts prevents them from fully participating in the justice system. ( Vandergoot, 2006). As a result of this impreciseness youth encounter Vandergoot concludes a separate justice system allocated for youth to adhere to adolescent needs. In today's society juveniles are being tried in adult courts, given the death penalty, and sent to prison. Should fourteen-year olds accused of murder or rape automatically be tried as adults? Should six-teen year olds and seven-teen year olds tried in adult courts be forced to serve time in adult prisons, where they are more likely to be sexually assaulted and to become repeat offenders. How much discretion should a judge have in deciding the fate of a juvenile accused of a crime - serious, violent, or otherwise? The juvenile crime rate that was so alarming a few years ago has begun to fall - juvenile felony arrest rates in California have declined by more than forty percent in the last twenty years. While California's juvenile population rose by a half a million since the middle and late 1970's, juveniles made up less than fifth-teen percent of California's felony arrests in 1998, compared to thirty percent in 1978; according to the Justice Policy Institute. The juvenile arrests have dropped back, even as the population of kids between ages of ten and eight-teen has continued to grow, and the number of kids confined in the California Youth Authority (CYA) has fallen. With all the progress our society has made in cutting back in juvenile crimes there is still a very serious problem. But if locking kids up is the best way to address it, how do we explain a drop in crime when there are more teens in California and fewer in custody? First we must look at the economy around us. With so many job opportunities available more and more teenagers find honest ways to keep busy and make money. Our generation has a brighter future than the generation a decade ago. Next we look at successful crime prevention efforts: after-school programs, mentoring, teen outreach programs, truancy abatement, anti-gang programs, family resource centers. There is evidence that these programs are beginning to pay off. Sending more, and younger teens through the adult court system has been a trend across the country in reaction to crimes, such as school shootings and violent rapes. Yet evidence shows that treating youth as adults does not reduce crime. Federal standards define any young offender under the age of eighteen who commits a crime is define as a juvenile delinquent. And the important differences between adults and young people, that a one-size fits all method is not desirable and will not make the situation better. Our justice system also accomplishes an important symbolic function by establishing principles of behavior. It formally defines the right and wrong for citizens and frees them from the responsibility of taking vengeance, thus avoiding the escalation of feuds within communities. The system protects the rights of free citizens by honoring the belief that individual freedom should not be denied without good cause.
As minors commit violent crimes without being held accountable, they can grow up to be real criminals and they can be very dangerous. Without a solid foundation of what is right and wrong, these minors will grow up believing that their actions are the norm. For this reason, minors need to be held accountable. Traditionally, there has been little research on or interest in the impact of female crime in modern society. In addition, juvenile crime rates are on the rise, which combine for a void of research or information on female juvenile offenders. In general, crime rates for women offenders have risen since the 1990's. Increasing numbers of young women are also offending at higher rates. In a 1996 U.S. Department of Justice Report, the number of arrests of young women had doubled between 1989 and 1993. Twenty percent of all juvenile arrests were committed by girls, an increase of 87 percent. However, according to The National Study of Delinquency Prevention in Schools, males are far more likely to admit to criminal involvement than are females. For example, 12 percent of males and 4 percent of females reported carrying a hidden weapon other than a pocketknife in the past year (Wilson, p.150). There are several theories for this rise in crime proposed by modern feminists, including that the introduction of women into traditional male roles prompted women to commit increasingly dangerous and violent crimes.
