Pregnancy is a life changing event for women. In fact, it is a selfless act. Almost all women change their lifestyle while being pregnant. For example, they change or control their diet and restrict certain activities. However, some women who are pregnant may still drink alcohol and smoke cigarettes. The risk that an expecting mother takes while drinking or smoking is a higher probability that this behavior may cause harm to the unborn baby inside her womb. Doctors recommend that all pregnant women should refrain from cigarettes or alcohol when they are pregnant. Women should not drink because it is medically proven that the outcome will be a baby born prematurely, or with a low birth weight. There may also be respiratory problems and the baby may have fetal alcohol spectrum disorders (FASD). The mother may even have a miscarriage. It is because of this plethora of problems associated with smoking cigarettes or drinking alcohol while a woman is pregnant that doctors recommend against it. So, if a woman drinks alcohol or smokes while knowing she is pregnant, should she be charged with the crime of harming or assaulting the helpless human inside her? I believe she should be charged since the helpless unborn child existing within her is defenseless.
There is a case where the unborn child is counted as a living human being and another proving that the fetus in the womb is purely nonexistent human. A 38 year-old man from El Paso, Texas was charged with two counts of murder after killing a pregnant woman and her unborn child (Evia). But in the state of Texas, abortion is legal, so how can this case be a double homicide whereas entering an abortion clinic to eliminate the life of an unborn is legal? In both of these examples you equa...

The Centers for Disease Control and Prevention suggestion that a pregnant woman should not drink alcohol during pregnancy (Advisory on alcohol use in pregnancy 2005) has been widely criticized as being unnecessarily paternalistic, but the CDC goes further into explaining that, “Alcohol consumed during pregnancy increases the risk of alcohol related birth defects, including growth deficiencies, facial abnormalities, central nervous system impairment, behavioral disorders, and impaired intellectual development” (Advisory on alcohol use in pregnancy
One of the biggest issue of abortion goes back to the controversial question of when human life actually begins. Many people will often argue that a fetus is a living being from the moment of conception and feel that it deserves the same legal protections as an adult, therefore making it immoral to kill it. Just like in our court system, we would not put an innocent person on death penalty. The fetus has done nothing wrong and has the right to live. As the editor of Christianity Today wrote, "abortion is one of those monumental issues of justice that comes along once in a lifetime. It is violence against children, a hideous act of poisoning or dismembering tiny bodies, then dumping them in a landfill or garbage disposal." On the other hand, those who are for abortion say that a fetus is only a "potential human being." The advocates for legal abortions want the mother to choose whether she keeps the baby or kills it, and the rights of a mother supersede the rights of a baby. John M. Sw...
When it comes to pregnancy, expectant mothers usually have a lot of questions and concerns. One such concern is alcohol consumption. Some people feel that it is okay while others are against the consumption. However those who drink take a huge risk that can result in what is referred to as Fetal Alcohol Spectrum Disorders (FASD). This umbrella term is used to describe the range of damage from alcohol exposure to a fetus. The characteristics, diagnosis, and the mother are all important factors to look at when trying to understand these birth defects.
Pregnant and Imprisoned in the United States. (2000). Birth: Issues in Perinatal Care, 27(4), 266-
... excluded potential risk factors for preterm birth including previous pregnancies and multiple births. Thus, these results should only be applied to the risk of alcohol consumption for primiparous mothers with singleton pregnancies. However, despite the lack of risks identified in this study, alcohol use during pregnancy has been linked to disabilities. According to the American Academy of Child and Adolescent Psychiatry (AACAP, 2011), its adverse effects include fetal alcohol syndrome, learning disabilities, social ineptness, depression, and anxiety. The AACAP strongly recommends against pregnant women consuming any form of alcohol at any level. Despite the data presented by Dale et al. (2016), the question of the other risks of alcohol consumption on the fetus was not explored and thus alcohol use during pregnancy should not be condoned solely based on this study.
“Whoever engages in conduct that violates any of the provisions of law listed in subsection (b) and thereby causes the death of, or bodily injury (as defined in section 1365) to, a child, who is in utero at the time the conduct takes place, is guilty of a separate offense under this section.” (Cornell University Law School , n.d.)
A baby, from conception is a human being. So it is only logical to think that when you decide to take the life of a baby, even if it’s barely visible to the human eye, you are deciding to murder a person. Life begins at the moment of conception, so the argument that a newly conceived human life doesn’t have the ability to feel doesn’t hold a lot of weight. Rather, a person should think of it as the baby doesn’t have a choice and by most standards in society when a person doesn’t have a choice, the act is usually considered wrong, especially if the action results in death.
These factors may include what a woman ingests and exposes her embryo or fetus to. Sadly, alcohol use during pregnancy is an ongoing problem that can have detrimental effects on the fetus, including Fetal Alcohol Syndrome (FAS). Choosing to drink alcoholic beverages during pregnancy is a choice, a risky choice. Unfortunately, some women don’t even know they are making a risky choice by consuming alcohol because they are in the early stages of pregnancy. It is common for a female to not find out they are pregnant until at least the fifth or sixth week after fertilization.

People always think that nothing bad would ever happen to them, or that they would never make the same mistakes as other mothers. The fact of the matter is it can happen to anyone and it will happen if people are not careful. 21 % of women use illegal drugs and alcohol during the nine months of pregnancy. Whether it is just one drink or one hit or this is an everyday occurrence; it can affect the baby mentally and physically for the rest of its life.
...just being around a person that does can cause harm to a mother’s fetus. Women need to know that smoking can cause miscarriages, premature birth, and other damage to a baby. Before women that smoke decide to make the decision of getting pregnant, they should research all the harmful effects that smoking has on a fetus. If pregnant smokers were to halt tobacco use a total of 986 infant deaths would be averted annually. This validates the need for infusion of more resources into existing smoking cessation campaigns in order to achieve higher quit rates, and substantially diminish current levels of smoking-associated infant deaths (Salihu, Aliyu, Pierre-Louis, & Alexander, 2003). The only way a woman can avoid pregnancy complications associated with smoking is to quit and she should also avoid others who smoke in order to avoid the dangers of second hand smoke.
Yet, I have clearly shown that the fetus is a separate person with its own heart, lungs, brain, and all different body organs. The oppositions would say that it is the woman’s right to terminate her own pregnancies. Yet, in the eyes of the law two charges are filed when someone kills a woman and her fetus, so how is it her right to kill another human being? A woman doesn’t have four arms, four legs, two heads, four kidneys, two hearts, and two brains… so how is it only her body?
