The Americans after obtaining independence from England needed to establish a form of government. Before the war had ended, the Second Congress of the Confederation called for the drafting of a new government in order to govern this new country, which the Articles of Confederation established. The Articles of Confederation built a government solely based off republican ideals, such as civic virtue, the idea that the states and the people will make sacrifices to the common good in order to benefit everybody. Relying on civic virtue did not pull through as successful for the young country. The Articles of Confederation shone through as successful in organizing and establishing states in the Old Northwest, spreading republican ideals; however, the success of the Articles of Confederation was trumped by its failures. The Articles of Confederation failed to provide a new and young United States with an effective government in its inability to collect tax revenue to pay debts, controlling the mobocratic uprising of upset factions, and dealing with foreign policies; additionally, the failure of the Articles of Confederation revealed the inefficiency and failure of republicanism. The Articles of Confederation allowed congress to create successful land policies for the Old Northwest. Several states had large western land claims, such as Massachusetts and Virginia, made small landlocked states without western land claims feel inferior. These states ceded their land to the Congress of the Confederation. (Document E). Doing so, it showed that the states were capable of giving to the common good, following the republican idea of civic virtue that the Articles relied on. The reliance on civic virtue was successful in organized land policies that spread republicanism ideals; however, it failed to aid the Congress of the Confederation in tax revenue and controlling mobocracy. The Articles of Confederation was ineffective and faulty with is roots planted solely in republicanism.
The unpredictable failure of the Articles of Confederation to the continental congress was a huge problem. The Articles of Confederation was made so the states would have more power, And limit the powers of the national government. Main contributors for this action was the fear that the national government will gain too much power and overstep its authority.This would have a negative effect on the nation, because tensions will start to rise for the ineffectiveness of this new system of government. A Rebellion best known as Shays rebellion, took place shortly after The adoption of the Articles of Confederation. During the American Revolution the not yet established United States, held two Continental Congresses that eventually help defeat Britain. The First Continental Congress informed the local militias to prepare for war. The Second Continental Congress helped end the war and issue the Declaration of Independence. The Second Continental congress sought out to create a national government for our new country named the Articles of Confederation. However, The Articles of Confederation had many problems, for example, Congress and the states shared the right to regulate currency and issue money. This led to an excess of currency, which pushed down the value of currency and created inflationary pressure on the Continental dollar. In an effort to limit the power of the national government, Congress created one without enough power to govern effectively, which led to serious national and international problems. One of the main weaknesses under the Articles of Confederation was its incapability to regulate trade and levy taxes. The states controlled all of their “cash flows.” Sometimes, the states were in debt because of tariff wars that they would engage in with one another.
The year of 1776 was a time of revolution, independence, and patriotism. American colonists had severed their umbilical cord to the Mother Country and declared themselves “Free and Independent States”.1 The chains of monarchy had been thrown off and a new government was formed. Shying away from a totalitarian government, the Second Continental Congress drafted a document called the Articles of Confederation which established a loose union of the states. It was an attempt at self-government that ended in failure. The Articles of Confederation had many defects which included a weak central government that lacked the power to tax, regulate trade, required equal representation and a unanimous vote to amend the Articles, and had only a legislative branch. As a result the United States lacked respect from foreign countries. These flaws were so severe that a new government had to be drafted and as a result the Constitution was born. This document remedied the weak points of the federal government and created one that was strong and fair, yet still governed by the people.
The Northwest Ordinance was the main strength of the Articles of Confederation. Since the United States was a new nation, this was a big step in having control of the whole country and all the land it owned. Other small strengths included the ability to declare and end war, to start dealing with money that was exclusive to the country, and the ability to start dealing with foreign countries and not have to go through England first. Since the articles were a document for all of the states, it helped bring agreement and stopped arguments from happening because it was the general set of rules. For the most part, the articles did set up a government, but it’s power was inadequate. The articles also set up an ineffective economy, but it was a necessity for the new nation to have an economy. The articles were right to set up these things, but they did not do the job of carrying them out.
The Articles of Confederation were approved by Congress on November 15, 1777 and ratified by the states on March 1, 1781. It was a modest attempt by a new country to unite itself and form a national government. The Articles set up a Confederation that gave most of the power to the states. Many problems arose and so a new Constitution was written in 1787 in Independence Hall. The new Constitution called for a much more unified government with a lot more power. Let us now examine the changes that were undertaken.
In comparing the Articles of Confederation with the U.S constitution that was produced by the federal convention in 1787, it is important to note that the U.S operated under both documents. During March 1, 1781, the Articles of Confederation went into effect when it was ratified by Maryland. However, the U.S constitution replaced the Articles of Confederation as soon as it was ratified on June 21, 1788 by New Hampshire. The main difference between the Articles of Confederations and the U.S Constitution is that the constitution didn’t force the laws, but established the why of the constitution. The Articles of Confederation were incapable of providing the United States with an effective form of government. The Articles of Confederation presided weakly over the government as it allowed little or no power to tax, control trade, and branches of government were missing. In addition to this, the thirteen states acted as separate nations and the national government had little control over them.
To say that the Articles of Confederation provided the United States of America with an effective government would be quite an over exaggeration. For most people in modern day, an effective government would be one that can govern mass numbers of people and still be politically correct in overruling decisions on matters while keeping the law in mind, yet keeping the benefit of common good front and center. But, the Articles of Confederation were not written in the present day, so these ideals of a competent government were not quite applicable. For most people, an effective government was one that could govern mass numbers of people, still giving the states and the people many rights, while still being able to keep all under control. This would have eliminated any possibility that a federal government could become too strong or resemble a monarchy. However, the Articles of Confederation did few of these things. The Articles of Confederation were ineffective because they provided a weak central government, did not give the authority to settle boundary disputes, and eventually led to civil unrest which included incidences such as Shays’ Rebellion.
Soon after the Revolutionary War in America, a new government was started when the Articles of Confederation were adopted by the Continental Congress. The Articles set up a democratic government that gave the States the power to make their own laws and to enforce them. The American Revolution stirred political unity and motivated the need for change in the nation. Because many Americans fought for a more balanced government in the Revolutionary War, they initially created a weak national government that hampered the country's growth and expansion. In the Letter from Abigail Adams to Thomas Jefferson, Mrs. Adams complained about the inadequacy of power that the American government had to regulate domestic affairs. The Articles of Confederation was created to be weak because many had feared a similar governing experience that they had just eliminated with Britain. The alliance of states united the 13 local governments but lacked power to deal with important issues or to regulate diplomatic affairs. Congress did not have the power to tax, regulate trade, or draft people for war. This put the American citizens at stake because States had the power to refuse requests for taxes and troops (Document G). The weakened national government could not do anything about uprisings or small-scale protests because it did not have the power to put together an army. The deficiencies of the confederation government inspired the drafting of the American Constitution. The document itself embodied the principle of a national government prepared to deal with the nation's problems. In James Madison's Federalist Paper, he persuades the American public to adopt the Constitution so that the government can protect humans from their nature and keep them out of conflicts.
Although it was quite necessary to establish a strong central government in the 18th century, this also created discourse with the American people and threatened the idea of American Exceptionalism. The Articles of Confederation was a plan of government that was based on the principles that were fought for in the American Revolutionary War. Even though The Articles of Confederation were based upon principles we fought for, it contained major flaws. The government had no power of national taxation and had no power to control trade. The biggest weakness of The Articles of Confederation was that it had no direct origin in the people, the states were in control. Each and every state had the power to collect its own taxes, issue currency, and provide for its own military. The Articles of Confederation was a transition between the Revolutionary War and the Constitution. Without The Articles of Confederation it would have been impossible to create the United States Constitution, mistakes were made with the first, and fixed later with the Constitution.
It was not very easy for the United States to expand like they had in mind. The division of land had been a rising problem since the Revolutionary war. Two of the main issues during the time of the Articles of Confederation were the pricing and land measurement (Potter and Schamel 1). Throughout the course of over fifty years, the government had tried many different attempts to get people to want to expand to the west. They just didn’t really know the right way of how to go about it. Trying to sell the acres did not go over well, considering the price seemed outrageous for what they were getting. Untouched soil was very hard to start on and be successful from the beginning, which caused some problems with people not wanting to buy the land (Weiser 1). So again, a different political group tried a different approach.
The Articles of Confederation was the first government of the United States. The Articles had created a very weak national government. At the time the Articles were approved, they had served the will of the people. Americans had just fought a war to get freedom from a great national authority--King George III (Patterson 34). But after this government was put to use, it was evident that it was not going to keep peace between the states. The conflicts got so frequent and malicious that George Washington wondered if the “United” States should be called a Union (Patterson 35). Shays’ Rebellion finally made it evident to the public that the government needed a change.
