Facts: On December 4, 2012 the case involved Sandra Primrose as plaintiff versus Wal-Mart Stores, INC., as defendant presented in the hearing trial court. Ms. Primrose who was 73 years old at the time claimed that because of the Wal-Mart’s watermelon signs was display in the wrong area, where she was tripped and fell over the corner of the sign on September 09, 2009, and had caused her injuries while trying to transporting the watermelon to her shopping cart. She didn’t filled out the damage reported until September 09 of 2010. On October 15, 2012, Wal’Mart filed a motion for summary judgment request. Primrose claimed about the incident at Wal-Mart Stores, INC., that they were trying to cause any kind of harm to her. Based on the evidence that had been provided to the court have proved that the signs was clear enough to be seen by everyone around the area at that time. Moreover, Wal-Mart did not asking her to go around the display in order for her to transported the watermelon. The Judges thinks that the incident would not happened if Ms.Primrose can move her shopping cart closer so it would be easier for her to transferred the watermelon. Therefore, the Judges are agreed with the trial court’s decision to grant the defendant their motion for summary judgment, after it had been proven that the display was open and obvious to be seen by everyone and there’s no sign of any risk or mean to harm anyone. Also, Ms. Primrose was failed to prove her’s argues that she claimed above to support her liability to La. R.S. 9:2800.6, the Judges cannot impose any enforcement or duty upon the defendant. For this case, I believe that as the merchant stores like Wal-Mart or any kind of merchant, their vice is greed, and their virtue is temperance; letting people know about the deal they are having at that moment. For Ms. Primrose, her virtue is justice and well-being, and her vice is cowardice; because she wouldn’t agree with the judges final decision. Moreover, in utilitarians ethics; selling varies of items and help the community be able to get the supplies and food that they needs. In deontological ethics; even the judges make their final decision and I agree that the sign was obvious but as an owner of merchant, if one customer get hurt by the display once, then they should reconsider and be more caution with the display. In universal rules; the motive was to alert customers, and their reason is adversities but failed in a way of safety. They should have the viewing of old people vision when they place a
