We Need an Amendment Outlawing Flag Desecration
In an attempt to make outrageous political statements, people often go to extremes: monks burn themselves to express freedom from religious intolerance, civilians stand in front of military tanks to stop them from destroying their city, and others burn or tear up flags to demonstrate their beliefs on issues from racism to war. Although flag desecration is the least violent of these three examples, it should be banned with an amendment because the flag is a symbol of freedom.
Flag defilement is seen in many forms, such as- spitting on, tearing apart, or burning. During the 1960’s, a time of despair and revolution, flag vandalism proliferated. In effort to alter their lifestyle, Americans stampeded the streets ruining the symbol of freedom in the name of politics and racism. The violent array of insubordination created an immediate reaction. Each protest became more violent and ill mannered. Each time someone demolishes a flag, the act is not freedom of speech- it is an expression of an anti-American lifestyle.
During the Vietnam War, activists ironically demolished the flag to bring back the men fighting overseas. The same men who were fighting for the freedoms of Americans and the symbol of America. These soldiers believed in America as a country and the flag as a badge of democracy and freedom so much, they risked their lives and almost 60,000 American soldiers died to preserve America’s freedoms.
Those who have lost family members in a vicious battle will understand that it is not a sign of admiration to disgrace the icon for which these young men died to defend-- many between the ages of 17 to 24. In honor of those who may die for our country in the future, the Senate should pass an amendment outlawing flag desecration.

Free speech and the First Amendment rights do not give people lisence to desecrate a symbol of pride and freedom. It is not all right to protect those who let it burn, lighting up the sky with their hatred. It definitely is not acceptable to insult the men and women who fight every day to protect this nation by burning the symbol of their labors. Therefore, it is crucial that the Supreme Court pass the amendment to the Constitution to protect the flag of the US.
Much history came within the Texas v. Johnson case. It all started during the 1984 Republican National Convention, this is where Johnson participated in a political demonstration to protest what policies Regan was administrating (Brennan 1). A march was occurring throughout the city streets, which Johnson did take part in. Johnson burned an American flag while protesters chanted him on (Brennan 1). No person was specifically injured during this protest; although, many witnesses were severely offended (Brennan 1). Johnson was convicted of Desecration of a venerated object, which violated the Texas Statue. The state court of appeals affirmed Texas Court of Criminal Appeals and reversed the case stating it was a form of expressive conduct, so it was alright (Brennan 1). In a 5 to 4 decision the Supreme Court came to the conclusion that Johnson’s burning of the flag was protected under his First Amendment rights (Brennan 1). Some have seen friends and family get tortured and murdered by their own government for daring to do things we take for granted every day. For those who risked everything simply for the chance to become an American....what kind of feelings do they have for the flag when they Pledge Allegiance the first time? Go to a naturalization ceremony and see for yourself, the tears of pride, the thanks, the love and respect of this nation, as they finally embrace the American flag as their own. Ask one of them if it would be OK to tear up the flag.
The 1830s was a time of serious religious conflict. Many people, especially authors, had different opinions on how to find true spirituality. In the end, authors in America created Transcendentalism. Transcendentalism is a philosophical and literary movement that searches for individual truth through spiritual reflection, complete solitude, and a deep connection with nature. Because this was established by authors, many of them wrote different pieces reflecting and using the beliefs of Transcendentalism. Ralph Waldo Emerson was considered to be the father of Transcendentalism. He wrote many influential pieces that follow and emphasize major Transcendental beliefs. The major beliefs include the over-soul, nature, and senses. In addition to those, there are minor beliefs and overall ways of living. These beliefs were included in Transcendental pieces as a general way to share the belief and to create a movement. Due to the use of nature, senses, and the over-soul as its three core Transcendental beliefs, Ralph Waldo Emerson’s “Nature” successfully explain the fundamentals of Transcendentalism.
The dissenting opinion to the previous idea is that the government's legitimate interest in preserving the symbolic value of the flag is, however, essentially the same that may have motivated a particular act of flag burning. The flag uniquely symbolizes the ideas of liberty, equality, and tolerance -- ideas that Americans have passionately defended and debated throughout our history. Bulimia Nervous, as defined by the National Eating Disorders Association, is a serious, potentially life-threatening eating disorder characterized by a cycle of bingeing and compensatory behaviors such as self-induced vomiting. "Protecting Freedom of Expression on the Campus” by Derek Bok, published in Boston Globe in 1991, is an essay about what we should do when we are faced with expressions that are offensive to some people. The author discusses that although the First Amendment may protect our speech, but that does not mean it protects our speech if we use it immorally and inappropriately. The author claims that when people do things such as hanging the Confederate flag, “they would upset many fellow students and ignore the decent regard for the feelings of others” (70). Some people see the American flag as patriotism. These people are the ones who have their flags out all year around. The ones who always have them flying high. Some of these people even have American flags hanging off their cars. To some people the American flag is their son or daughter who they have lost either in the line of duty in the military, on the police force, or even the fire department. Although its sad but true some Americans have no patriotism and could care less what happens around them. These people will only care if it affects them in a harmful way.
In the United States today, approximately 4500 children are born deaf each year, and numerous other individuals suffer injuries or illnesses that can cause partial or total loss of hearing, making them the largest “disability” segment in the country. Although, those in the medical field focus solely on the medical aspects of hearing loss and deafness, members of the deaf community find this unwarranted focus limiting and restrictive; because of its failure to adequately delineate the sociological aspects and implications of the deaf and their culture. Present day members of deaf culture reject classifications such as “deaf mute” or “deaf and dumb”, as marginalizing them because of their allusions to a presumed disability. (Edwards, 2012, p. 26-30)
The disparity between the Deaf and hearing is based around ableism, or a newer notion, Audism. Audism is the notion that those that can hear are superior. (Oberholtzer, 2009) Like most that are viewed as inferior, the Deaf are often looked at as lesser compared to those of the hearing community and labeled as disabled, even if they themselves do not view their deafness as a disability. Many of Deaf community members are able to hear and speak well enough to communicate with hearing people but still chose to identify with the Deaf community rather than in the hearing world. He was interested in nature’s relation to humans. Henry David Thoreau is best known for following in the footsteps of Emerson’s idea of transcendentalism. To get a better understanding of Thoreau’s ideas of transcendentalism, I will briefly talk about Ralph Waldo Emerson’s essay entitled “Nature.” It is written to show importance to nature. In the introduction of Nature, Emerson reveals the purpose of his essay, which is that man takes nature for granted. Emerson says that humans do not experience nature and God directly. Emerson makes the point that the goal of science is to come up for a theory about nature. However, man will never understand the true form and spectacles of nature. Emerson makes another point saying nature and spirit are the only true mechanisms of the Earth. Emerson continues in his introduction to explain that nature is everything other than the human spirit. He speaks of nature and the spirit as if they were a form of “Yin and Yang.” In order for the spirit to exist, nature must exist. In the next eight chapters Emerson gives mediated high praise to nature. In the beginning of the first chapter Emerson expresses his belief that most adults lost the ability to approach nature as an awareness to separate us from our material world. Among the followers of Christianity, questions arise in order to find the righteous path to Heaven’s gate. On the contrary, there are those who seek answers for what is forsaken. Dante Alighieri fully expresses himself on this dilemma in his written work, The Divine Comedy. The first part of the epic poem is Inferno; Dante defines and constructs Hell, based on the morals and judgments set by common beliefs during his time. Dante also uses Aristotle’s philosophical work to shape the structure of Hell. Undergoing a journey through Hell as himself, Dante places famous literary icons to assist in questioning the acts of justice. Dante builds and contrast between the sinners who are innocent, and those who deliberately perform evil deeds. Virgil, a fellow poet and pagan, exemplifies wisdom and clarity that which Dante must learn through his endeavor. Virgil’s guidance will provide contrast and the necessary guidance to reach Paradise. The change of character Dante experience, is dreadful; pity and remorse must be exempted to honor retribution for the sinners’ defiance against God. All the answers regarding Hell, lies upon meeting the primal sinner, Lucifer, the Fallen Angel. Dante’s journey unfolds a critical analysis in which portrays the human struggle in every individual. There are several implications of the four functions of myth that can be derived from Dante’s Inferno. Dante divides Hell into three dispositions: incontinence, malice and brutality. Henry David Thoreau was a renowned American essayist, poet, and philosopher. He was a simple man who built his life around basic truths (Manzari 1). Ralph Waldo Emerson deeply impacted Thoreau’s viewpoints and philosophies, specifically by introducing him to the Transcendentalists movement.
