The statue also defines publication as communication to a third person and includes publication that occurs as a result of gross negligence as intentional publication. The mere fact that Tom leaves the defaming letter with Allen’s friend is gross negligence. Add to Tom’s gross negligence is the fact that the letter was folded and seal with a piece of tape. Tom did not instructed the friend on the importance of not opening the letter. Tom’s letter was is personal believes.
