There is a Centuries long debate as to why our Nation’s Founding Fathers chose for us to be ruled under rule of law instead of rule of man. Our Founding Fathers founded this nation on a promotion “We the People”. They ruled that we should be led under the rule of law rather than the rule of man for multiple reasons. Our government now though is stipulating whether or not the old American government made the right choice, when compared to other foreign countries. In a rule of law system the government keeps guidelines, our constitution, setting our way of governing. In the other Countries they don’t always agree with the way we rule and vice versa. In Canada they are rules under rule of law and very loosely run their government the way we do, they just have a Prime Minister. One main reason is the way that other countries now rule their government. The factors in the Rule of Law that are numerous and vast. They include limited government powers, order and security, and an open government. Another main reason that we are now thinking that our Founding Fathers chose Rule of Law rather than Rule of Man is the way our government officials, old and new, act as the way of our government. The last reason why people now think that the reason they chose Rule of law is because if we were ruled under Rule of Man following the constitution would be harder because of the way the way our government was going to be projected they thought that Rule of Law would be the best fit. Now that we look back on the reasons the Founding Fathers chose Rule of Law rather than Rule of Men and should be thankful we did because if they had gone any other way with our government who knows where we could be now. This great country known as Canada, is governed smoothly because of the agreements and rules that have been in place since the beginning of confederation. The Canadian Constitution is one example of these rules. The Canadian Constitution is not just one single documentation, it is a collaboration of documents that make up one enormous document (Dyck 261). The six basic principles of the constitution are: responsible government, federalism, judicial review, the rule of law, constitutional monarchy and democracy; which all helped to shape the Constitution and therefore Canada (Dyck 266).
Through the years many changes have taken place, and technologies have been discovered, yet our Constitution remains. Some say that the Constitution was written for people hundreds of years ago, and in turn is out of step with the times. Yet its principals and guidelines have held thus far. The framers would be pleases that their great planning and thought have been implemented up until this point. However this does not compensate for the fact, that the we the people have empowered the government more so than our fore fathers had intended. Citizens were entrusted with the duty to oversee the government, yet so many times they are disinterested and only seem to have an opinion when the government’s implications affect them. As time has changed so has the American people, we often interpret our freedoms in a self serving manner, disregarding the good of the whole and also the good for the future. Thus there are no true flaws in the Constitution, it appears that the conflict emerges in the individual and their self, and poses question when we must decide when to compromise the morals that our Constitution was founded on, or when to stick to what we know is right and honest.
Thomas Paine wrote, “the more simple anything is, the less liable it is to be disordered.” He also goes on to argue that if something is simple and disorder was to occur, it would be easier to repair since issues wouldn’t be as complex (in comparison to a mixed government). Later on, Paine continues and makes a connection between law and a king. He argues that in America, law is king. He says, “…let the crown, at the conclusion of the ceremony, be demolished, and scattered among the people whose right it is.” Paine claims that just like a king, laws should not behold the virtue and power that rests among the people. The Role of Courts in American Politics The third branch of the federal government is the judicial branch. Before the existence of the Constitution, a system of state courts was in place. Through much controversy and compromise a decision was accomplished, which put in place the Supreme Court. In Article III, Section 1, "The judicial power of the United Statesshall be vested in one Supreme Court and such inferior courts as the Congress may from time to time ordain and establish." The Supreme Court was initially set up as a part of the separation of powers in the American political system.
The criminal justice system has been evolving since the first colonists came to America. At first, the colonists used a criminal justice system that mirrored those in England, France, and Holland. Slowly the French and Dutch influences faded away leaving what was considered the English common law system. The common law system was nothing more than a set of rules used to solve problems within the communities. This system was not based on laws or codes, but simply that of previous decisions handed down by judges. Although rudimentary, this common law system did make the distinction between misdemeanors and the more serious crimes known as felonies.
George Mason explains that when a man has power, he does not use that power with discernment. Once that power is in his hands, he will only crave for more. The nature of power to man is to utilize that power and gain more and more. Mankind are selfish and will only focus on their interests first and forget about the interests of people. A man will do whatever it takes to gain that power. Power is like an addiction, once you acquire a little bit of it, you will only want more. In summarization, man is currently power-hungry and has been power hungry from the beginning of time and will continue to be power-hungry till the end of ages. For this a government is needed and a constitution that all people will be able to comply with and this is the biggest safeguard. Everyone, regardless of their position will have to follow the constitution. “The Constitution leaves in its wake a long legacy, forever shaping the fate of many other countries. Whether those countries are currently in a state favorable to liberty or not, it is undeniable that the U.S. Constitution’s principles have caused people to rethink how to organize their political systems” (Hang). Time has only added value to the Constitution, for every time we reference it in our lives it is a testament of our trust and loyalty in what it states about our rights as individuals and the role the government plays in our lives. When it was written, the Constitution was the law of the land that gave people rights they had previously lived without. Similarly, we live lives of choice and independence because of the same document while other countries limit all the rights we are guaranteed in the Constitution. Yet people have to betray what they believe in sometimes because they are forced to follow the laws. Why does the government not think about what people think about laws? We do deserve to have a say in what goes in this country. Maybe we should even have more say than the government, since the people are the ones who give the money to use for what the government wants. The government can be making a decision that will lead the country to a bad place, yet the people can’t really do anything about it. It is all unjust. Like Thoreau stated, “But a government in which the majority rule in all cases cannot be based on justice, even as far as men understand it.”
The American government prides itself on the foundational principle of democracy which allows individual voices to be heard. Afterall, the roots of power in our nation stem from the people. The Constitution was established to ensure the balance of powers among the federal government, state legislature, and the common people. Time, however, has worked against the American people in the battle towards democracy. The idea of a governing body drawing its power directly from its constituents has been undermined by the corrupt nature of modern politics where politicians act out of self-interest. While the Constitution and later amendments had every intention of securing basic liberties, certain limitations later undermined the original intentions of the founding fathers to give power back to the people by placing the larger majority of power in the hands of the state.
The rule of law, simply put, is a principle that no one is above the law. This means that there should be no leniency for a person because of peerage, sex, religion or financial standing. England and Wales do not have a written constitution therefore the Rule of Law, which along with the parliamentary Sovereignty was regarded by legal analyst A.C Dicey, as the pillars of the UK Constitution. The Rule of Law was said to be adopted as the “unwritten constitution of Great Britain”.
I can imagine a perfect world. A world where morality is of upmost importance in our dealings with each other, where morals are critically examined, and debated with reason as well as passion. This world would be a pinnacle of human achievement. A pinnacle that we are nowhere near. Why is this? Well, in today's society, morals are often associated with obeying the law, and since laws are legislated by politicians, they are subject to politics. Laws are not right in and of themselves, and morals are not a matter of a majority's opinion. Some matters that are in the domain of charity are done through politics, often citing morality as a reason. Where exactly does charity fit in with morals? With politics? In this paper I will explore the meaning of morality, its justification, and its scope as it pertains to our lives. I will also spend some time explaining how politics, laws, and charity relate to morality, and how politics often assume charitable roles.

The key to a successful nation is a firm, strong, and fair code of high laws that provides equal and just freedom to all citizens of the country. A strong government is as important as a firm code of law as a government is a backbone of a country and of the laws. A government is a system that executes and determines its laws. As much as fair laws are important, a capable government that will not go corrupt and provide fair services holds a vital role in building and maintaining a strong country.
