The development of the world has lots of good advantages for men; but besides all these it has also bad effects, too; as the illnesses and most importantly the mental illnesses. As the centuries go on our responsibilities get much harder and this causes stress and some other mental diseases, too, to some people and this makes a danger; but I'm not talking about the ones who are consciously in mental hospitals. The main idea is that, we call the people who are in these hospitals insane; but maybe they are saner than the ones who are out in the society because the ones who are consciously in these hospitals are the ones who are aware of them and willing to be healed. However, the ones who are out in the society, who are among us and we don't notice, are not aware of their true reality. The ones who are aware of it are not the ones who are real insane and the society's duty is not to avoid insanity but to help the ones who are in that kind of situation and to help them. Most of the people are scared from them; but actually they should be scared of the ones who are among us. They can be dangerous to us more than others; because the ones who are not outside can't touch you, can't talk with you and also even if they do those you would be aware of that person's true identity, so you would not care much or act thinking of it and also they would be aware of themselves so they would act likewise, too. In 1941, two brothers sat in court smashing their heads on the desks until they bled, barking like dogs, and crying sporadically. They weren’t insane, but that was exactly what the men wanted the jury to think. Anthony and William Esposito were being charged for robbing a payroll truck and shooting someone in the process. The jury was still skeptical until, ten months before the sentence, the Esposito brothers began to refuse any and all food they were offered. Almost a year later, the men were taken, in their almost dead state, to the electric chair and were executed. This is only one of the many examples of the insanity defense being abused. In this case, the criminals did not succeed in getting out of punishment, but there have been many successful cases that are being questioned too late. Although the insanity plea is important to those who have medical record of a psychological disorder, our “perfect” law needs to fine-tune the defense to prevent people from using it to escape going to jail or being executed.

Albert Einstein describes insanity as “doing the same thing over and over again and expecting a different result.” Albert Einstein may have been a genius, but in this case he is wrong. There are people in this world who are mentally insane and they can’t help themselves. On rare occasions people like this become killers. In the legal system we have a defense an accused murderer can use to show they were not in their right mind when the act occurred. This is the insanity defense. This happens in 1% of criminal trials in the United States (US). A perfect example of a case that used the insanity defense was Andrea Yates v The State of Texas.
Former U.S president Ronald Reagan was shot by a man named John Hinckley in the year 1981. The president along with many of his entourage survived the shooting despite the heavy infliction of internal and external injuries. The Hinckley case is a classic example of the 'not guilty by reason of insanity' case (NGRI). The criminal justice system under which all men and women are tried holds a concept called mens rea, a Latin phrase that means "state of mind". According to this concept, Hinckley committed his crime oblivious of the wrongfulness of his action. A mentally challenged person, including one with mental retardation, who cannot distinguish between right and wrong is protected and exempted by the court of law from being unfairly punished for his/her crime. Insanity seems to be the question in the courtroom today. What defines if a person is mentally stable or if he is sick? The government and court system has been trying to find the definite line, but there are still varying beliefs for and against whether people should be allowed to plead insanity. The definition of insanity is, “the state of being mentally ill; madness” (Oxford Dictionary). The definition of mentally ill is “psychiatric disorder that results in a disruption in a person’s thinking, feeling, moods, and ability to relate to others” (worldiQ.com). When someone commits a crime, he or she may use mental illness as a defense. This is called an insanity plea or insanity defense. What the insanity defense does is try to give the alleged perpetrator a fair trial. At least in extreme cases, society agrees with this principle. The problem is where do we draw the line. Under what circumstances is a person considered insane, and when are they not? The trouble with the insanity defense in recent years is the assumption that virtually all criminals have some sort of mental problem. One important point is that the crime itself, no matter how appalling, does not demonstrate insanity. Today, the insanity defense has become a major issue within the legal system. If the defendant is clearly out of touch with reality, the police and district attorney ordinarily agree to bypass the trial and let the defendant enter a mental hospital.
The insanity defense pertains that the issue of the concept of insanity which defines the extent to which a person accused of crimes may be alleviated of criminal responsibility by reason of mental disease. “The term insanity routinely attracts widespread public attention that is far out of proportion to the defense’s impact on criminal justice” (Butler,133). The decision of this defense is solely determined by the trial judge and the jury. They determine if a criminal suffers from a mental illness. The final determination of a mental disease is solely on the jury who uses evidence and information drawn from an expert witness. The result of such a determination places the individual accused, either in a mental facility, incarcerated or released from all charges. Due to the aforementioned factors, there are many problems raised by the insanity defense. Some problems would be the actual possibility of determining mental illness, justify the placement of the judged “mentally ill” offenders and the total usefulness of such a defense. In all it is believed that the insanity defense should be an invalid defense and that it is useless and should potentially be completely abolished.
Continuing budget cuts on mental health care create negative and detrimental impacts on society due to increased improper care for mentally ill, public violence, and overcrowding in jails and emergency rooms. Origins, of mental health as people know it today, began in 1908. The movement initiated was known as “mental hygiene”, which was defined as referring to all things preserving mental health, including maintaining harmonious relation with others, and to participate in constructive changes in one’s social and physical environment (Bertolote 1). Why is there a cloud of judgment and misunderstanding still surrounding the subject? People with a mental disorder or with a history of mental health issues are continually ostracized by society. This results in it being more difficult than it already is for the mentally ill to admit their symptoms to others and to seek treatment. To towards understanding mental illness is to finally lift the stigma, and to finally let sufferers feel safe and accepted within today’s society. People with a mental illness are often feared and rejected by society. This occurs because of the stigma of mental illness. The stigma of mental illness causes the perception of individuals with mental illnesses to be viewed as being dangerous and insane. They are viewed and treated in a negative way. They are almost seen as being less of a human. The stigma affects the individual with a mental illness in such a cruel way. The individual cannot even seek help without the fear of being stigmatized by their loved ones or the general public. The stigma even leads to some individuals developing self-stigma. The basis of insanity is upon M’Nagten Rules (1843) which set forward the principles of a defence when the “defendant had a defect of reason” or a “disease of the mind” and was not able to understand the nature of the act they did or did not know what they were doing was wrong. These three conditions must be proved for the defence of insanity to become available. Insanity is available for the all cases that require mens rea except for strict liability cases.

Throughout history people with mental illness have been perceived as lesser than those without mental illness, and thus these people have an innumerable amount of difficulties and challenges to overcome compared to their counterparts with the benefits of pristine mental health. In The Mad Among Us by Gerald N. Grob, he describes the change of the ways of caring for the mentally ill starting from the beginning of institutionalization in the early eighteenth century (Grob 17) to the idea that serious disorders cannot be cured, but alleviating the symptoms "should be able to remove the obstacles that stand in the way of natural self-healing processes." (Grob 311). The lies of people with mental illness are as diverse as the disorders they live with. Unimaginable obstacles are waiting around every corner for people with mental illness.
