When the United States declared itself a sovereign nation, the Articles of Confederation were drafted to serve as the nations first Constitution.Under these Articles, the states held most of the power; but due to an almost absent centralized government, colonists were ill-equipped to deal with such practices as regulating trade both between states and internationally, levying taxes, solving inter-state disputes, negotiating with foreign nations, and most importantly enforcing laws under the current notion of "Congress". Realizing that there were several deficiencies in the current system of self-government, the states appointed delegates to ratify the situation and come up with a way to attain the aforementioned practices they needed to be a functional independent nation. From 1787-1790 the development of the American Constitution was a battle between two opposing political philosophies. America’s best political minds gathered in Philadelphia and other cities in the Northeast in order to find common ground in a governmental structure. The Federalists and the Anti-Federalists had both some political thoughts that agreed as well as some political thoughts that disagreed. However, both parties would compromise and ultimately come together.
On September 28, 1787 Confederation Congress sent out the draft of the Constitution. This was the first time in history for the people to debate, discuss, and decide with a vote for how they wanted to be governed. There were two groups that debated the thought of the Constitution. They were called Federalists and anti-Federalists.
The Federalists and Anti-federalists shared the common beliefs of John Locke’s Enlightenment ideals such as all men were born equal (even though most of these men owned slaves), but their opinions about the role of government were different. Both parties had their own visions of how a new government would function and how the Constitution would support the government being proposed. Many argued that the Articles of Confederation had created a very weak government with very limited power. Specifically, the amount of power or the absence of power of a central government was the main disagreement between the Federalists and Anti-federalists. As a result, the Federalists and Anti-federalists argued about the ratification of a new constitution, which would give the central government more power.
The thirteen states formed a Confederation referred to as the “league of friendship” in order to find a solution for common problems such as foreign affairs.The Articles of Confederation was the nation’s first Constitution. The articles created a loose Confederation of independent states that gave limited powers to the central government. Each state would have one vote in the house of Congress, no matter the size of the population. Members of the one-house Congress, such as Pennsylvania, agreed that the new government should be a unicameral legislature, without an executive branch or a separate judiciary. Under the articles, there wasn’t a strong independent executive. There wasn’t any judicial branch but Congress had the authority to arbitrate disputes between states. Congress was responsible for conducting foreign affairs, declaring war or peace, maintaining an army and navy and a variety of other lesser functions. But the articles denied Congress the power to collect taxes, regulate interstate commerce and enforce laws. Because of this, the central government had to request donations from the states to finance its operations and raise armed forces.
The year of 1776 was a time of revolution, independence, and patriotism. American colonists had severed their umbilical cord to the Mother Country and declared themselves “Free and Independent States”.1 The chains of monarchy had been thrown off and a new government was formed. Shying away from a totalitarian government, the Second Continental Congress drafted a document called the Articles of Confederation which established a loose union of the states. It was an attempt at self-government that ended in failure. The Articles of Confederation had many defects which included a weak central government that lacked the power to tax, regulate trade, required equal representation and a unanimous vote to amend the Articles, and had only a legislative branch. As a result the United States lacked respect from foreign countries. These flaws were so severe that a new government had to be drafted and as a result the Constitution was born. This document remedied the weak points of the federal government and created one that was strong and fair, yet still governed by the people.
The Articles of Confederation was America’s first constitution. The Articles of Confederation failed to create a strong central government, however. With the demise of the states in sight, the need for a stronger and more structured central government became apparent. An invitation was sent to all thirteen states in February 1787 by the Confederation Congress to resolve the matter. The events that took place over the next several months would create the United States Constitution. Going down in history as a revolutionary form of government, the U.S. Constitution would give life to a country that is still running strong over 200 years later.

The Constitution, when first introduced, set the stage for much controversy in the United States. The two major parties in this battle were the Federalists and the Anti-Federalists. The Federalists, such as James Madison, were in favor of ratifying the Constitution. On the other hand, the Anti-Federalists, such as Patrick Henry and Richard Henry Lee, were against ratification. Each party has their own beliefs on why or why not this document should or should not be passed. These beliefs are displayed in the following articles: Patrick Henry's "Virginia Should Reject the Constitution," Richard Henry Lee's "The Constitution Will Encourage Aristocracy," James Madison's "Federalist Paper No. 10," and "The Letters to Brutus." In these documents, many aspects of the Constitution, good and bad, are discussed. Although the Federalists and Anti-Federalists had very conflicting views, many common principals are discussed throughout their essays. The preservation of liberty and the effects of human nature are two aspects of these similarities. Although the similarities exist, they represent and support either the views of the Federalists or the Anti-Federalists.
By the late eighteenth century, America found itself independent from England; which was a welcomed change, but also brought with it, its own set of challenges. The newly formed National Government was acting under the Articles of Confederation, which established a “firm league of friendship” between the states, but did not give adequate power to run the country. To ensure the young nation could continue independently, Congress called for a Federal Convention to convene in Philadelphia to address the deficiencies in the Articles of Confederation. While the Congress only authorized the convention to revise and amend the Articles the delegates quickly set out to develop a whole new Constitution for the country. Unlike the Articles of Confederation, the new Constitution called for a national Executive, which was strongly debated by the delegates. There were forces on both sides of the issue trying to shape the office to meet their ideology. The Federalists, who sought a strong central government, favored a strong National Executive which they believed would ensure the country’s safety from both internal and external threats. The Anti Federalists preferred to have more power in the hands of the states, and therefore tried to weaken the national Executive. Throughout the convention and even after, during the ratification debates, there was a fear, by some, that the newly created office of the president would be too powerful and lean too much toward monarchy.
The first form of government that the states had was the Articles of Confederation, which was a more accurate representation of the government that the colonies wanted after the revolution. The only way any decision was made under the articles was if the votes were unanimous so nothing ever got done. The Constitution turned the states into a Democratic Republic, meaning that congress would get together and vote on and if 50.1% could agree on what was being voted on, that law could be passed without needing a unanimous vote. The powers given to congress in the constitution were(and are not limited to) “regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes, to make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, the Congress shall have Power To lay and collect Taxes”(Maddison). It’s interesting that when you think about it all those rights congress has are the rights that the colonists complained about in the Declaration. The colonists were quick to judge the king on his actions as a supreme leader, but when they gained their freedom they had to get used to the same laws that the British imposed on them, the same laws that they claimed were injustices and worked so hard to abolish with the Declaration ended up meaning nothing when the Constitution was
The first written constitution of the United States was the Articles of Confederation in November 15, 1777. Congress was also given the right to make treaties and alliances to maintain the armed forces and the money. Also, the central government was lacking the ability to tax and regulate commerce which led to the Constitutional Convention in 1787 and the creation of the federal law. Since the American Revolution, the U.S. congress felt that they needed a stronger union and a government powerful enough to defeat Great Britain. The central authority inhibited the creation of such a strong government that shared political theory held that a republic could not serve a large nation such as the United States .To many of the americans and their union seemed to be simply a league of confederated and also their congress representing thirteen independent polities.
There will always be two sides with opposing views to any decision that can be made. Government and politics are no different. People are always able to find something to be dissatisfied about. This can be seen from the two parties, the Federalists and the Anti-Federalists, that emerged during the creation and ratification of the Constitution. The Federalist group was the one who wished to ratify the newly made constitution. The Anti-Federalist group was the one who attacked every point of the newly made documents for being too restrictive and lacking. Both sides had argued back and forth, believing that their ideas would benefit the people more. There were of course major figures that were part of the revolution who disagreed with each other on what should be included in the Constitution.
Following the Declaration of Independence, the Continental Congress realized it was necessary to set up a government. The Articles of Confederation in 1781 served as the document that established the fundamentals of the national government in the United States after it declared independence from Great Britain. Although, this document said nothing about slavery. It left the most powers including slavery, to the individual states. After their experience with the British, the colonists distrusted a strong central government. The new government consisted of a Congress in which each state had one vote. With little to no power to execute its laws or collect taxes, the new government proved ineffective.
