The criminal justice system is about how a society deals with people who violate criminal law. The criminal justice system has a lot to do with politics. Politics expresses what is and is not criminal, and what the consequences are. The community plays two important roles in criminal justice system. The community is responsible for reporting crimes they witness happening. Police depend on the community for this information as they can't always be there to witness a crime. Lastly, the community makes up the members of the jury who convict or acquit criminals.

The criminal justice system has been evolving since the first colonists came to America. At first, the colonists used a criminal justice system that mirrored those in England, France, and Holland. Slowly the French and Dutch influences faded away leaving what was considered the English common law system. The common law system was nothing more than a set of rules used to solve problems within the communities. This system was not based on laws or codes, but simply that of previous decisions handed down by judges. Although rudimentary, this common law system did make the distinction between misdemeanors and the more serious crimes known as felonies.

We as Americans live in a country where the Justice Department has failed to collect on $7 billion in fines and restitutions from thirty-seven thousand corporations and individuals convicted of white collar crime. That same Justice Department while instead spending more than 350% since 1980 on total incarceration expenditures totaling $80 billion dollars. America has become a place where a 71-year-old man will get 150 years in prison for stealing $68 billion dollars from nearly everyone in the country and a five-time petty offender in Dallas was sentenced to one thousand years in prison for stealing $73.

Statistics show that African American men are arrested more often than females and people of other races. There are some measures that can and need to be taken to reduce the racial disparity in the justice system. Racial disparity in the criminal justice system exists when the proportion of a racial or ethnic group within the control system is higher than the proportion of the group in the general population. The cause of this disparity varies and can include differences in the levels of criminal activity, law enforcements emphasis on particular communities, legislative policies, and/or decision making by one or more persons at some level in the criminal justice system.

Among drug related convictions, African Americans make up half of the cases whereas only 26% of the white population is convicted. As Bobo and Thompson stated, “Illegal drug consumption seems to know no race. Incarceration for drug-related charges, however, is something visited in a heavily biased manner on African Americans.”

Their job is to insure that everyone receives a fair trial, determine guilt or innocence, and apply sentences on guilty parties. The court system will contain one judge, and a jury of twelve citizens. The jury of the court will determine the guilt or innocence of the individual. The jury will also recommend a sentence for the crime the individual committed. Even though the jury makes the recommendation for the sentencing of the crime, the judge will follow pre-determined sentencing guidelines to make a final decision.
