According to the Adoption and Foster Care Analysis and Reporting system, in 2011 there were 104, 236 children waiting to be adopted in the United States (p. 4). Adoption is the legal process an individual or family goes through to gain legal custody of a child in foster care. This child’s parents have lost custody of their child because they have been deemed unfit to raise the child, either because of neglect or abuse. After the child is removed from the horrible situation, he or she is taken by child services and placed in a foster home or with a family member. This system is in place to protect children from further abuse, neglect and trauma. Today, children in foster care are in the system for a very short period of time; there is a push to getting them out of a foster home and transition into a safe, loving and permanent environment. The foster care system is run the way it is because of the implementation of the Adoption and Safe Families Act of 1997.
The Adoption and Safe Families Act of 1997 changed the way we approach foster care and adoption. It was the first law that solely focused on children alone, not the entire family. The main objective of this law was to create timelines. These timelines determined the length of time a child could be in foster care before the parents’ loose custody of the child. After parental rights are terminated, the agency is to start searching for a family to adopt the child. In essence, this act took a process that could go on for years and condensed it. One of the biggest misconceptions that we have in our country is that foster care is a great thing; well, it’s not. There are so many flaws in our foster care system to even consider it a good idea. With constant reports of abuse, depression, lack of stability, to even the terrible after effects of the foster care system, like homelessness and incarceration; the foster care system hurts more than it helps. Our foster care system is bad for America, but most of all, our children.

There is nearly 400,000 children in out-of-home care in the United States right now (Children’s Right). Just about every day children are being shipped in and out of foster homes and group homes. Most people want the best for children in foster care and decide to take care of them until their parents can possibly recover. The foster care system can have both a negative or positive effect on children, foster parents, and biological parents because of the gaps in the system. Foster cannot not be avoided but the some aspects of the foster care system can be avoided if the missing gaps were filled.

Throughout history, the government has been in charge of creating and regulating different types of laws. Many of the laws have been created to protect those who reside in that country and therefore are expected to be followed. However, not everyone believes that they should follow the law and in return decide to either ignore them or rebel against them. When members of society violate the simple law that has been set in place to protect those who do not possess the capability to protect themselves, it becomes a dangerous and horrendous tragedy. One of the most horrific laws that people violate is that of child abuse and neglect.
This essay will first address the statute used and interpretation of the threshold test by the courts, and then focus on cases involving vulnerable children to assess whether the statute in The Children Act 1989 is sufficient in protecting these children from harm. I will look at the argument in favour of the current approach taken by the courts, and the counter-argument in favour of changing the current approach. The arguments are delicately balanced and the law is always developing, so it will be interesting to see how the Supreme Court resolves this issue in future.
Foster care needs to be reformed, especially when it comes to private agencies. Many people seem to overlook the issues embedded within the foster care system; all it does is take care of children, right? Wrong. Private agencies pervert the system with the nightmares they create. In 1887 the federal government launched boarding schools designed to remove young Indians from their homes and families in reservations and Richard Pratt –the leader of Carlisle Indian School –declared, “citizenize” them. Richard Pratt’s “Kill the Indian… and save the man” was a speech to a group of reformers in 1892 describing the vices of reservations and the virtues of schooling that would bring young Native Americans into the mainstream of American society.

According to the International Foster Care Organization “Foster care is a way of providing a family life for children who cannot live with their own parents.”(2004) Foster care is supposed to provide temporary care while parents get help dealing with problems, or to help children or young people through a difficult period in their lives. Children will return home once their parents are able to provide a safe enviorment for them. However if parent are unable to resolve the issues that cause their child in foster care their children may stay in long-term foster care, some may be adopted, and others will move on to live independently.
