Your honour, this matter is an application for a conditional release of bail. My client, Mr Angus Ansti has been charged under s35 (1) of the Crimes Act 1900 (NSW) for causing reckless grievous bodily harm. Has your honour been made aware of the facts? My client has been charged with an offence is in accordance to section 16 B sub-sections C regarding offences involving grievous bodily harm and personal violence. Therefore under the previously mentioned section, the offence is a shown clause requirement. (1) Firstly, I would like to address section 18 (a) regarding the accused person’s background, including criminal history, circumstances and community ties. My client is a young dedicated martial arts student who trains tirelessly six days a week. Furthermore, my clients hope to become a master and teacher of his martial discipline. (2) Secondly, I would like to address subsections (b) and (C) regarding the seriousness of the offence and my client’s history of violence. Though my client’s actions have resulted in the victim obtaining grievous bodily harm I must contend that he had acted to defend his friend. Furthermore, my client by his nature is not a violent individual in that with the physical confrontations that he has been involved in has always been in the defence of another. Thus demonstrate he is an individual who arbitrarily enacts violence upon another (3) Thirdly, 18(F) the accused has complied with all conditions, apart from reporting to the police station on two occasions when he was interstate participating in martial arts
