According to Quinney (1970), criminal laws fit into a capitalist society. The lawful order gives the United States the reality to the crime problem. Everything that makes up crime’s social reality, including the presentation of illegal law, the conduct of those who are labeled as criminal, and the building of a philosophy of crime, is related to the conventional legal order. The social reality of delinquency is created on conflict in our society. According to Quinney (1973), the legal system in the United States does not serve everyone in society as a whole, but aids the interest of the ruling class in a capitalist society. The presiding class used the legal system to preserve law and order that allows for the dominant economic interest to be promoted and maintained.

I would eradicate prison system because prisons are not built to rehabilitate criminals. It is a business and studies have shown criminal preferring going to prison instead of being on the streets. According to Crank & Brezina (2013), prison sentences are often seen as one of the worst punishment states provide to criminal. However, research shows that offenders actually do not share the same view that a prison sentence is worst. Some offenders adjust to prison life with ease and do not see prison as a harsh punishment; some actually prefer prison over alternative sanctions such as boot camp or probation. Although incarceration is viewable by offenders as punitive, some experienced life in prison to easier compared to life on the street. Punishment does not serve as deterrence because if this was the case, homicide rates will not be high and it is a form of capitalism to serve the interest of
