Summery and Conclusion The purpose of this essay was to clarify a holistic overview related to using seclusion among mentally ill in-patients, and discuss many opinions which focused on use or not use seclusion among mentally ill in-patients from legal and ethical dimensions. Despite of seclusion affect patient autonomy and penetrate human rights, on the other hand the main goal in the psychiatric setting as priority to enhance safety precaution and preventing harm of self and others and enhance the quality of life. As reviewed in literature, studies found that most of studies against using seclusion with reducing this practice and enhance using another proper way to reduce and avoid seclusion. The traditional approach to the care of the mentally ill during the last 200 years was custodial, rather than therapeutic. This approach to “Psychiatric Care Delivery System” was introduced in India from Britain . Mental hospitals were established in isolated areas, often on the outskirts with the object of segregating the patient as troublesome and dangerous to their neighbors. The overriding concern was to protect the citizens without regard for appropriate care and cure of the ailing patients. As a consequence of this objective of the mental hospitals, the quality of care in such hospitals had been very poor. The inmates were subjected to indignity and humiliation for an indefinite period, and once admitted never recovered, or rehabilitated back in their family, but doomed to the inevitable end. The stigma of mental illness thus prevailed.
Yet, solitary confinement is still considered necessary in order to maintain control within the prison and among inmates. Solitary confinement is seen as an effective method in protecting specific prisoners and altering violent/aggressive disobedient behaviors, (Maria A. Luise, Solitary Confinement: Legal and Psychological Considerations, 15 New Eng. J. on Crim. & Civ. Confinement 301, 324 (1989) p. 301). There is some discrepancy among researchers as to the varying effects on inmates who have undergone an extensive solitary confinement stay. Most researchers find that inmates who had no previous form of mental illness suffer far less than those who do, yet most if not all of these individuals still experience some difficulties with concentration and memory, agitation, irritability, and will have issues tolerating external stimuli, (Stuart Grassian, Psychiatric Effects of Solitary Confinement, 22 Wash. U. J. L. & Pol’y 325 (2006) p. 332). Although these detrimental psychiatric repercussions of solitary confinement currently appear, several researches have made suggestions as to how these may be avoided. These requirements being that
Every school, psychiatric unit should always make an effort to prevent the need for restraint and seclusion. Everyone has their own opinion on how they feel about these two issues and what the laws should be set on. School policies on seclusion and restraint will always differ from the psychiatric unit’s policy since they are two different environments and may deal with different clientele. There have been many laws that have been set and also changed throughout the years regarding how you should and shouldn’t restrain a patient or student because you could eventually seriously injure them. It can also be bad to seclude a student or patient because they could do multiple things to hurt themselves when they are being secluded.
If a person convicted of a crime shows no signs of being mentally ill when entering a prison which enforces the long-term use solitary confinement, by the time they completed their sentence and are released, their mental health will have been severely compromised. Studies have shown that the long-term use of segregation in prisons can cause a wide variety of phycological effects such as anxiety, psychosis, depression, perceptual distortions, and paranoia, often leading to a desire to self-harm or in more severe cases suicide. The study continues on to explain further ramifications, such as, physical effects. This shows some of the devastating effects the practice of administrative segregation has on inmates’ mental and physical well-being. Often, it is the mentally ill that are unfairly subject to this practice. “Mentally ill inmates may find themselves inappropriately placed in administrative segregation because of a lack of other suitable placements, protective custody reasons, or disruptive behavior related to their mental illness.” (O 'Keefe 125). Instead of providing safety to inmates and staff as the prison system claims administrative segregation is for, its main objective is social isolation. Which is one of the harmful elements of AS that makes it torture. Additionally, an annual report from the Canadian Government’s Office of the Correctional Investigator’s states, “close to one-third of reported self-injury incidents occurred in (federal prisons) segregation units”. Therefore, one can infer that the negative effects of AS are contradictory to providing safety to inmates. UN Special Rapporteur on Torture Juan Mendéz proposed administrative segregation should be banned as the “isolation of inmates amounted to cruel, inhuman or degrading treatment or punishment or – in more severe cases – to torture.” The ramifications of administrative segregation amount to what is defined as torture by lawyer and human rights Juan Mendéz. Administrative segregation is an unconstitutional treatment of inmates and does not constitute the values of our society, or the dignity and humanity of all people. The quality of confinement including structure design, quality of sound, color and objects within the room are important because they are the factors in what results in the inmates’ experience. In Garisson’s study, he believes that the inmate’s expectations and views on the purpose on solitary confinement was significant factor to the psychological outcome. Garisson believed that if solitary confinement was seen as a torturous punishment, it will increase the potential of psychological harm to inmates. Following Garissons study many other researchers have noted that the inmate’s views on the reasons of solitary confinement and how they are treated during confinement will determine if the will suffer any psychological effects all together. Thousands of people statewide are in prisons, all for different reasons. However, the amount of mental illness within prisons seems to go unaddressed and ignored throughout the country. This is a serious problem, and the therapy/rehabilitation that prison systems have do not always help those who are mentally ill. Prison involvement itself can contribute to increased suicide (Hills, Holly). One ‘therapy’ that has increased throughout the years has been the use of solitary confinement, which has many negative effects on the inmates. When an inmate has a current mental illness, prior to entering into the prison, and it goes undiagnosed and untreated, the illness can just be worsened and aggravated.

Inadequate mental health treatment available in many prisons and especially in solitary housing units compounds this psychiatric deterioration. If there is 40 students in class room at least two of them could be living with serious mental illness. Although mental illness is something that familiar to us, there is still misunderstood and stigma towards mental illness.
