During my time at the nursing home, I was surprised to see how some of the patients were cared for. One of the patients I had was a very sweet woman, with a huge heart. She loved to visit with anyone who came by to see her and was always so excited to see us come in on Wednesdays. Sadly, however, When I cared for her I came to realize that she was not receiving proper ethical care. When I went to change her sheets, I had removed layers and layers of sheets and blankets that had just been stacked on top of each other instead of new sheets each day. Along with that, I had found used tissues within each layer of sheets. On the top sheet, there was also a used brief that was laying on the bed where her pillow is. As I continued to make her bed, I had a hard time locating her call light, come to find out her call light had been underneath her bed where she was unable to reach it. I was very surprised to see all of this and it bothered me knowing that these people rely on others to take care of them and they get treated poorly. During my time with her, we got to talk about God and she asked me how I am not worried and afraid of where the world is going, and I told her that I have trust in God’s plan, I know he is by my side and that this is not our permanent home, our home is in heaven with Jesus. Saying this to her and having this conversation appeared to brighten her spirits, and she asked me to pray for her, Which I do every night. Peace was evident in my clinical practice this week when I was caring for my patient. She was blind and relied on me to feed her and get her what she needed. Assisted Living Facilities abuse is a frequently occurring problem in our society (Hamilton). There are diverse categories of abuse that transpire in Assisted Living Facilities which are physical abuse, sexual abuse, emotional abuse, neglect, abandonment, and financial abuse. Samples of physical abuse would be hitting or beating the elders with an object or their hand, force feeding them or pulling their hands. Sexual abuse is the Assisted Living Facility employees having sexual acts with non-consenting patients. Emotional abuse is the employees saying things verbally to torment the patient. Neglect would be the employee does not take care of the patients such as providing hygiene. Abandonment occurs when leaving patients to fend for themselves. Financial abuse is when the patient’s family pays for the services that were not taken care of. “Elder abuse is fast becoming one of the uppermost law enforcement tasks of the next century, “said Paul Hodge who investigates crime against the elderly (Gonzalez). Since abuse occurs throughout assisted living facilities, state and federal governments should establish a type of punishment such as sending for employees to prison, ways to prevent abusing elderly’s is by inspecting employees ' criminal records, qualified staff, reporting injuries, having surveillance of the areas that do not affect patients privacy, promoting continuous family visits, and shortage of staffing.
As population ages, clinicians will care for an increasing number of elderly patients. Just as these patients may present unique and challenging medical dilemmas, so may they also present ethical ones. Ethical dilemmas are present in everyday practice. It provides a brief overview of the situations that may raise ethical concerns. Although, these are not the only ethical concerns that may arise during care of the elderly and are not unique to the population, they represent the most common scenarios that clinicians may encounter in their everyday course of practice. Ethics, according to (Mueller, Hook & Fleming, 2004), is the analysis and identification of the moral problems that arise in the care of patients. Ethical issues on geriatrics: a guide to clinicians (2004) reports that clinicians will care for an increasing number of elderly patients with challenging medical problems.
Deontology is an ethical theory concerned with duties and rights. The founder of deontological ethics was a German philosopher named Immanuel Kant. Kant’s deontological perspective implies people are sensitive to moral duties that require or prohibit certain behaviors, irrespective of the consequences (Tanner, Medin, & Iliev, 2008). The main focus of deontology is duty: deontology is derived from the Greek word deon, meaning duty. A duty is morally mandated action, for instance, the duty never to lie and always to keep your word. Based on Kant, even when individuals do not want to act on duty they are ethically obligated to do so (Rich, 2008).
This assignment will identify and evaluate the legal and ethical issues within the health and social care for elderly people with dementia and living in residential homes. It will address the difference between the legal and ethical issues and the impact it has on the person suffering from the disease, their family and the role that the professionals have in decision making for the individual’s wellbeing.
There have been problems within Long-Term Care and many of these abuses were turned over to the patients, there was hardly any direction on how to handle Long-Term Care. “Poor houses and Almshouses and developed in response to an impoverished, aging, and mentally and physically disabled population who lacked informal caregivers.” (Sarah Thompson, 2008 ) When Long-Term Care was in the infancy stage of developing there were many problems, issues that were created because there was not much direction. In developing in taking care of the elderly there were poorly trained nurses, medical workers and many of them were not qualified to work within the medical field. There were problems, many issues and multiple levels of abuse because of poorly trained medical workers where there was no direction.
Every nurse will be faced with a decision making dilemma at some point in his or her career. Being familiar with the nursing code of ethics, what is ethically and morally expected in society and how to approach the situations can help make dilemmas less of a nightmare. “The purpose of nursing ethics is to inspire questions and examine what would be the ethically right action in health care situations demanding a choice between at least two undesirable alternatives” (Toren & Wagner, 2010, p. 394). There are many different ways one can approach a situation to reach a resolution, finding a method that works best with the situation at hand is ideal.

It stands to reason that there is a large problem still rampant in society where others are taken advantage of, or mistreated. Hopefully more documented information and raising awareness of the issue amongst society will allow more people to understand this as a problem and the abusers to be caught. These obvious abuse of rights are something that should be protected, luckily people become more aware of these circumstances that is happening on a regular basis.

Ethical dilemmas are the issues that nurses have to encounter everyday regardless of where their workplaces are. These problems significantly impact both health care providers and patients. Patient safety is the most priority in nursing and it can be jeopardized by a slight mistake. Medication errors and reporting medication errors have been major problems in health care. Errors with medications have been found to be the most common cause of adverse drug effects (Brady, Malone, Fleming, 2009). Northwestern Memorial Hospital in Chicago conducted a research in 2012 that approximately forty percent of the hospitalized clients have encountered a medication error (Lahue et al., 2012). A nurse’s role is to identify and report these medication errors immediately in order to stop or minimize any possible harm to the patients. Ethical moral dilemmas arise when reporting the mistakes that have been made by one’s own colleagues, acquaintances, peers, or physicians.
It is important to preserve the dignity of all patients in the care of nurses and to not make them feel as though they are worthless. For example, when someone is incontinent and cannot care for themselves anymore, such as some residents in long-term care, it is important to help them remain dignified. The resident should be able to feel as though they are respected and are given the appropriate amount of privacy as we are working in their home. With this being said, it is very crucial for nurses to provide residents’ in long-term care, as well as patients in the hospital, with great care while still preserving their dignity and maintaining their privacy. It is important for the client to feel as comfortable as they would if they were in their own home. With this, Registered nurses must appreciate and respect each person in whom they care for. This respect is seen through the nurse as they explain to the patient what they will be doing as they are caring for them, as well as providing care within the wishes of the person. Patients in the hands of the Registered Nurse, appreciate caring as a core value during their stay in the hospital. This is proved as Davis (2005) states, “From a patient perspective, the caring presence that emanates from nurses, positively impacts patients’ hospital experience,” (p.127) As nurses, caring is the absolute root of nursing practice. Preserving patients’ privacy and dignity involves aspects such as closing doors or screens and making sure they are covered while doing so, (Royal College of Nursing, 2015). The Code of Ethics outlines the importance of Registered Nurses supporting the person, family, group, population or community receiving care in maintaining their dignity and integrity, (Canadian Nurses Association, 2008). Federal and State laws require that nursing homes develop a plan of care and employ sufficient staffing to provide all the care listed on the care plan. Most corporate owned nursing homes today are not sufficiently staffed, and they can not provide all the care listed on the care plan. Consequently, residents are not taken to the toilet when necessary; they’re often left lying in urine and feces. They also develop painful and life-threatening decubitus ulcers, and are not fed properly, they’re not given sufficient fluids. They are also over-medicated or under-medicated, and dropped causing painful bruises and fractures, are ignored and not included in activities, are left in bed all day, call lights not answered. These are all forms of negligence, performed daily in nursing homes.
An ethical dilemma is defined as a mental state when the nurse has to make a choice between the options and choices that he or she has at her disposal. The choice is a crucial task as the opting of the step will subsequently determine the health status of the concerned patient, hence it requires a great deal of wisdom along with proper medical and health training before any such step is opted as it is a matter of life and death. Strong emphasis should therefore be on the acquisition of proper knowledge and skills so that nurses do posses the autonomy to interact with patients regarding ethical issues involved in health care affairs and address them efficiently. It is normally argued that nurses are not provided sufficient authority to consult and address their patients on a more communicative or interactive level as a result of which they are often trapped in predicaments where their treatments of action and their personal beliefs create a conflict with the health interests of the patient. To understand ethics in the nursing field, you must first know what ethics is. A general explanation of ethics is the beliefs, values and morals that an individual has. These may not be that same for everyone and some may disagree with each others ethics. Ethics is dealing with what is right and what is wrong everyone has different views regarding what is. A nurse must understand and be clear about ones own beliefs, values and morals, before understanding others and being able to deal with the difference that one will encounter in the nursing field. Ethics in nursing, (Concepts pg.220), “The nurse is someone who has internalized the concept of what it means to be a human being and accepts personal responsibility for relationships with other human beings. A nurse has an obligation to do good and not harm anyone and is committed to providing the same high-quality level of nursing service to all human beings”.
