On November 11, 2017, at approximately 0808 hours, I responded to McDonald’s, located at 150 Hickman Drive, Sanford Seminole County in reference to a lewd and lascivious incident. Upon arrival, I made contact with victim Luis Alfaro and his father Hernan Alfaro, who provided me with a sworn written statement. Hernan verbally stated, his son Luis went to McDonald’s to use the restroom and was inside longer than normal at which time he entered the establishment to check on his son. Hernan continued to state, once he departed the restaurant and began to drive away he noticed Luis tearing. According to Hernan, the Luis disclosed to him, someone with a camouflage cell phone was taking pictures or recording him as he utilized the restroom. Davis III, who advised he was in the restroom but did not see Luis or anyone else in the restroom. Davis voluntarily unlocked his mobile phone and showed Deputy Piorro and me the photo gallery which was empty, during which time Davis also stated he does not take pictures. While speaking with Davis, I noticed he began to breathe faster and deeper. I made contact with McDonald’s manager Jason, who assisted with reviewing the surveillance cameras. I reviewed the video recording starting at approximately 0739 hours I observed Hernan’s white pickup enter a parking space. During this same time, I observed Davis, leave the customer service counter and walk toward the restroom. Davis returned approximately twelve minutes later, the same time Luis and Hernan were seen leaving the restaurant. I read Davis his Miranda Warning, after which time he agreed to speak with me. Davis again denied placing his cell phone under the bathroom stall`s door to secretly record or take pictures of Luis. Davis provided Deputy Bryan Brown with a written consent to search his cell phone along with the phone
