On November 11, 2017, at approximately 0808 hours, I responded to McDonald’s, located at 150 Hickman Drive, Sanford Seminole County in reference to a lewd and lascivious incident. Upon arrival, I made contact with victim Luis Alfaro and his father Hernan Alfaro, who provided me with a sworn written statement. Hernan verbally stated, his son Luis went to McDonald’s to use the restroom and was inside longer than normal at which time he entered the establishment to check on his son. Hernan continued to state, once he departed the restaurant and began to drive away he noticed Luis tearing. According to Hernan, the Luis disclosed to him, someone with a camouflage cell phone was taking pictures or recording him as he utilized the restroom. Davis III, who advised he was in the restroom but did not see Luis or anyone else in the restroom. Davis voluntarily unlocked his mobile phone and showed Deputy Piorro and me the photo gallery which was empty, during which time Davis also stated he does not take pictures. While speaking with Davis, I noticed he began to breathe faster and deeper. I made contact with McDonald’s manager Jason, who assisted with reviewing the surveillance cameras. I reviewed the video recording starting at approximately 0739 hours I observed Hernan’s white pickup enter a parking space. During this same time, I observed Davis, leave the customer service counter and walk toward the restroom. Davis returned approximately twelve minutes later, the same time Luis and Hernan were seen leaving the restaurant. I read Davis his Miranda Warning, after which time he agreed to speak with me. Davis again denied placing his cell phone under the bathroom stall`s door to secretly record or take pictures of Luis. This case is about a 15 year old kid, along with a friend, who made an erotic call to a neighbor's house. The alleged incident took place on June 8, 1964 by Gerald Gault and Ronald Lewis. Mrs. Cook, the neighbor, filed a complaint which resulted in Gerald Gault’s arrest. Gerald was indeed on probation for something he had done prior to this incident. On June 26, 2006, a Sheriff Officer of the State of Florida, William Wheetley and his drug detection dog, Aldo, were on patrol. Ms. Dollree Mapp and her daughter lived in Cleveland, Ohio. After receiving information that an individual wanted in connection with a recent bombing was hiding in Mapp's house, the Cleveland police knocked on her door and demanded entrance. Mapp called her attorney and subsequently refused to let the police in when they failed to produce a search warrant. After several hours of surveillance and the arrival of more officers, the police again sought entrance to the house. Although Mapp did not allow them to enter, they gained access by forcibly opening at least one door. Once the police were inside the house, Mapp confronted them and demanded to see their warrant. One of the officers held up a piece of paper claiming it was a search warrant. Mapp grabbed the paper but an officer recovered it and handcuffed Mapp ?because she had been belligerent.? Dragging Mapp upstairs, officers proceeded to search not only her room, but also her daughter?s bedroom, the kitchen, dinette, living room, and basement.

The case of Miranda v. Arizona (384 U.S. 436 [1966]) is one of the most important cases in history. It brought about prominent rights that are still existent today in 2015 regarding interrogations and custody. The results of this case are still seen in the current criminal justice system. However, even though the rights that were given to the system by the court, there are still instances today in which these Miranda rights are violated. The concept of Miranda has evolved a lot from a court case to a code used by law enforcement during custodies and investigations.

The Miranda warnings stem from a United States Court’s decision in the case, Miranda v. Arizona. There are two basic conditions that must be met for Miranda warnings to be required: the suspect must be in official police custody and the suspect must be under interrogation. The suspect goes through a booking process after an arrest. The suspect will have a bond hearing shortly after the completion of the booking process or after arraignment. The arraignment is the suspect’s first court appearance to officially hear the charges filed against him or her and to enter a plea. The preliminary hearing or grand jury proceeding determines if there is substantial evidence for the suspect to be tried for the crime charged. In this essay, I will identify and describe at least four rights afforded criminal defendants at the arrest stage and during pretrial. I will analyze the facts presented and other relevant factors in the scenario provided. I will cite legal authority to support my conclusions.
Over the years the way law enforcement officers have been able to investigate cases has been drastically changed over the years. Investigations used to be a very prying, and vindictive matter. Now it is very delicate. Since the Miranda case, law enforcement has been very open and aware of defendants’ rights.
In 1966, American police procedure was changed by what is known today as the Miranda Rights. In 1963, Ernesto Miranda, a twenty three year old Hispanic American with an eighth grade education was arrested for kidnap and rape. (Paddock) He was identified by the victim of the crime in a police lineup. After he was identified, he was taken into police interrogation for two hours. When he was arrested, he was not informed of his Fifth Amendment right to not incriminate himself. He was also not informed of his Sixth Amendment right to have the assistance of an attorney. In the first part of his interrogation, Miranda denied having any involvement in the crime, but after two hours he confessed to the crime in writing. (Street Law)
The forward-tracking movement as used in Ernie's restaurant suggests the forward-tracking shot that is used throughout the film to show Madeleine has an allure for Scottie. Ernie's scene evokes the backward-tracking shot used throughout the film to show how Scottie is bonded to his object of desire. Together they bring out the character that an individual is playing in the film. The camera movement in Ernie’s Restaurant brings out forward and backward tracks that defines the point-of-view structure, but here the camera movement does not straight forwardly articulate a point of view. Instead, the camera is self-consciously sets up to show the relationship between the elements of the point-of-view structure that the rest of the film enacts.
In tutorial #4, we explored the different types of population around the globe and how each population is affected by its own culture in the video, World in the Balance – The Paradox People. The video examined the human population of India, Japan, United States and Africa. In particular, the continued and rapid aging population of Japan was highlighted, and the video emphasized the consequences of Japan’s future for each age group. Through this video, I recognized the impact of a growing population and could reflect on how it would impact my own actions for the future.
