The Charter of Rights and Freedoms is the strong foundation for the diverse country of Canada. They uphold various beliefs and values Canadians may have. Under the constitution in 1982, the CRF (Charter of Rights and Freedoms) was entrenched by then Prime Minister Trudeau. The CRF has 4 rights; Equality, legal, democratic and mobility, there is also 4 freedoms; of Conscience and Religion, of thought, belief, expression and media, of peaceful assembly, and Association. If people feel that their right and/or freedom has been violated, they can go to court by using a “Charter Challenge. ” A charter challenge is when something inequitable or unfair has been done, the citizen can pursue the court case stating that something violated their rights and/or freedoms. Much like a young child growing up, they are prone to make mistakes. The same can be said about the United States after gaining independence from Great Britain. In 1778 the law of the land was the Articles of Confederation, where a majority of governmental power went to the 13 individual states in order to avoid a large, overbearing government like the one we recently fought against. Although it was great in concept, the Article of Confederation was not what the United States needed. With each state governing on their own the states were not united. But with the adoption of the U.S Constitution, that all changed.
The U.S. Constitution was written with a great vision to create a strong nation. Unlike the Articles of Confederation, the Constitution is a very well organized and well thought out document that holds a strong bases for the future of America. It was September 17, 1787 that the Constitution was created, just a few years after we broke away from England’s control. In 1777, America’s government operated under the Articles of Confederation. This allowed states to operate independently like little countries. America’s government was weak because people were afraid of the government having too much power.
Imagine being discriminated anyplace you went, with glares from many and you haven’t done anything to receive those judgments. Muslim Americans in the U.S. have to deal with that discrimination every day post the events that happened on 9/11. Some take drastic measures such as changing their birth name, in hopes that they can avoid being judged by others. Muslim teenager Alisha, told her story that while visiting Six Flags with her family, an American man yelled at her father with the racial comment, “F**k you Osama!” She would also get asked offensive questions, like if she hated Jews too. People who engage in relationships with someone from the Muslim population are harassed for having a romantic affiliation with someone who they would call a “terrorist”. Along with getting called horrific names, many have become objects of suspicion.
The Bill of Rights and Declaration of the Rights of Man and Citizen are based on the same principles of natural rights; therefore each document is similar in protecting the people's natural rights. However, despite their similarities, their differences are apparent due to the social situations in which they were adopted. The Bill of Rights stood to protect the freedoms of each individual by establishing a democratic government. The French Revolution eliminated the hierarchy of class and established equality among men with the Declaration of Rights of Man and Citizen. Several influences from past philosophers and documents assisted the frame work of the Bill of Rights and Declaration of Rights and Citizen.
Because of widespread accusations of terrorism and the general fear that Muslims are terrorists and the entire religion is at fault, Muslims are being treated like they’re less than human. Similarly, Jews were treated like they were less than human because many German citizens blamed their struggles on Jewish people. The only difference is that America hasn’t mass murdered millions of Muslim citizens, at least not yet. I am by no means saying that America will have a neo-Holocaust with Muslim people, but there are far too many similarities in the treatment of these people simply because of their religions. During his run for president, Donald Trump proposed a total ban on Muslims entering the United States. He also suggested that Muslims turn in other Muslims for acting suspiciously, and that all Muslims enter a national registry and wear some sort of identification. In 1791, the Bill of Rights, consisting of 10 amendments, was ratified into the constitution. The document’s purpose was to spell out the liberties of the people that the government could not infringe upon. Considered necessary by many at the time of its development, the Bill of Rights became the cause for a huge debate between two different factions: The Federalists and the Anti-Federalists. The Federalists were those who thought that there should be a new Union created with a strong centralized government and individual regional governments. They felt that it was not necessary for there to be a bill of rights because it was implied that those rights the Constitution did not specifically state would be handed down to the states. On the other hand, the Anti-Federalists were opposed to such a form of government on the grounds that the Constitution, in which it was outlined, lacked clarity in the protections of the individuals. The Anti-Federalists—whose memory of British oppression was still fresh in their minds—wanted certain rights and guarantees that were to be apart of the constitution (Glasser 1991). A clear demonstration of the Anti-Federalist attitude was performed by Samuel Bryan, who published a series of essays named the ‘Cenitnal Essays,’ which “assailed the sweeping power of the central government, the usurpation of state sovereignty, and the absence of a bill of rights guaranteeing individual liberties such as freedom of speech and freedom of religion (Bran 1986).” Of course, the freedoms stated above are a portion and not the whole of The Bill of Rights. Ultimately, The Bill of Rights was adopted to appease the Anti-Federalists, whose support was necessary to ratify the constitution, and who believed that without the liberties granted therein, the new constitution—that they thought was vague and granted too much power to the central government—would give way to an elite tyrannical government.
Since the beginning of American history, citizens who resided the country lacked the basic civil rights and liberties that humans deserved. Different races and ethnicities were treated unfairly. Voting rights were denied to anyone who was not a rich, white male. Women were harassed by their bosses and expected to take care of everything household related. Life was not all that pretty throughout America’s past, but thankfully overtime American citizens’ civil liberties and rights expanded – granting Americans true freedom.
We live in the 21st century, where most Americans mind their own business but take for granted our God given rights. Not only God given rights but also those established by our founding forefathers. This paper will illustrate and depict the importance of the original problems faced when adopting the Constitution and the Bill of Rights. It will discuss the importance of the first amendment, the due process of the 4th, 5th, 6th, and the 8th amendments. Last but not least the importance of what is known as the “second Bill of Rights” (14th amendment).
In America, there is a hatred lurking around in almost every corner of the nation; a discrimination and social bias that preys on the lives of innocent Muslims. Some people fear for their lives when they see a Muslim board a plane that they’re going to go on. Politicians are using that fear to fuel their popularity in elections. The Charter of Rights and Freedoms has fundamentally shaped Canadian society since its inception through the Constitution Act of 1982. Promising egalitarian, linguistic, religious as well as other basic rights, the Charter of Rights and Freedoms is one of the primary doctrines in which Canadian law is founded upon. Many have argued that the advent of the Charter has transformed Canadian society into one that is preoccupied with that of rights. The rise in social movements, specifically in areas of women’s rights, indigenous rights and homosexual rights, are indicative of this. The Charter has created a divide amongst those who believe that this rise in a “rights culture” is ultimately beneficial if not necessary for Canadian society, especially in preserving the voices of the marginalized citizenry who until recently remained invisible in the eyes of parliament, and those who believe that Canada as nation has become preoccupied with preserving the right of gays, lesbians, women and other minority groups that it has sacrificed its majoritarian values. The word preoccupation, especially used in this context, holds a negative connotation suggesting some sort of obsession, and to describe Canada as a nation “preoccupied” with rights is an overstatement. Canada’s recent Charter revolution has often been seen as a means by which minority groups enact their own changes which may or may not be seen as desirable by a majority of people. However, because the Charter is important in preserving the rights of marginalized or minority groups, this can ultimately be beneficial for those whose world views have historically been persecuted. The First Amendment to the Constitution states that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof," meaning that an American citizen would be able to practice his or her religion without any intervention or persecution from the government, be it Islam, Judaism, Mormonism or Catholicism. For a long time, Americans and immigrants have been discriminated against, because of their race or religion. In the United States, one can witness discrimination throughout politics, social and cultural views, and social media. One of the most discriminated groups in the United States, in both American and immigrant subgroups, are Muslims. Muslims suffer not only from physical abuse, but from mental and emotional abuse as well. Muslims are also more likely to be subjected to stereotyping and/or compared to terrorists than any other religion. In short, Muslims are unfairly discriminated against in the United States.
