James Patrick Nollan, et ux., Appellant v. California Coastal Commission.
Case Definition:
The case is Nollan versus the California Coastal Commission. The Nollans were the appellates against a decision made by the California Coastal Commission (CCC).
The Nollans had been leasing a property on the California coast with which they had an option to buy. The property lies directly at the foot of the Pacific Ocean and is a prime piece of real estate on the California Coast. The property had been used by the Nollans to rent out during the summer months to vacationers. At the end of the Nollans’ lease they took the option to purchase the land and began preparing for the terms of purchase by the previous land owner. Among those terms was the demolishing of the small deteriorating bungalow that the Nollans had been leasing. The Nollans had planned to expand the structure from the small bungalow that it was to a three bedroom house more complimentary to the surrounding homes and their needs. In order to begin destruction of the property and begin rebuilding the site the Nollans had to secure a permit from the California Coastal Commission. Upon submitting the permit application, the CCC found that the permit should be granted on the condition that the Nollans provide public access to the beach and to the local county park, which lay adjacent to the property. Years ago, there was once a small town called Chaves Ravine within Los Angeles, California and this town was a poor rural community that was always full of life. Two hundred families, mostly Chicano families, were living here quite peacefully until the Housing Act of 1949 was passed. The Federal Housing Act of 1949 granted money to cities from the federal government to build public housing projects for the low income. Los Angeles was one of the first cities to receive the funds for project. Unfortunately, Chavez Ravine was one of the sites chosen for the housing project, so, to prepare for the construction work of the low-income apartments, the Housing Authority of Los Angeles had to convince the people of the ravine to leave, or forcibly oust them from their property. Since Chavez Ravine was to be used for public use, the Housing Authority of Los Angeles was able seize and buy Chavez Ravine from the property owners and evict whoever stayed behind with the help of Eminent Domain. The LA Housing Authority had told the inhabitants that low-income housing was to be built on the land, but, because of a sequence of events, the public housing project was never built there and instead Dodgers Stadium was built on Chavez Ravine. Although Chavez Ravine public housing project was the result of the goodwill and intent of the government, rather than helping the people Chavez Ravine with their promise of low-income housing, the project ended up destroying many of their lives because of those in opposition of the public housing project and government mismanagement.
In “From Notes on the State of Virginia,” Thomas Jefferson includes some proposed alterations to the Virginia Laws and discusses some differences between blacks and whites. First, he describes one of the proposed revisions regarding slavery: All slaves born after the enactment of the alteration will be freed; they will live with their parents till a certain age, then be nurtured at public disbursement and sent out of state to form their own colonies such that intermarrying and conflicts can be avoided between blacks and whites. Next, Jefferson indicates some physical differences between blacks and whites, including skin color, hair, amount of exudates secreted by kidneys and glands, level of transpiration, structure in the pulmonary organ, amount of sleep, and calmness when facing dangers. As he notes, these differences point out that blacks are inferior to whites in terms of their bodies. In addition, Jefferson also asserts that the blacks’ reasoning and imagination are much inferior to the whites’ after he observes some of the art work and writings from the blacks. As a result, based on his observation, he draws a conclusion that whites are superior to blacks in terms of both body and mind. However, Jefferson’s use of hasty generalization, begging the question, and insulting language in his analysis is a huge flaw which ruins the credibility of his argument and offenses his readers.

The marketing approach of Southwest Airlines is built upon their strong business model. They have successfully managed to target two specific market segments of the airline industry while remaining profitable. Their strategy is simple, to offer frequent non-stop flights with the lowest costs which appeal to both the business and budget travelers. By segmenting their target audience to specific demographics and ticket pricing, passengers know exactly what they are getting for the price they pay.
In the airline industry, Southwest Airlines is considered a true innovator. By shaking up the rules of flying and improving upon inefficient industry norms, Southwest has quickly grown by leaps and bounds. From the very start, Southwest Airlines' goals were to make a profit, achieve job security for every employee, and make flying affordable for more people (Southwest,2007). Southwest has not strayed from these goals. It does not buy huge aircrafts, fly international routes or try to go head to head with the major carriers; and thanks to a great planning, Southwest airlines has become the most successful airline company in the U.S., if not the world.

Southwest Airline’s greatest strength is their financial stability. They are able to maintain profits even when the industry is in economic crisis. Their financial success is in large part due to their low operational costs. Short haul, point-to-point trips allow them to save time and money. This not only provides faster trips to customers with shorter wait time, but also increase the amount of customer turnover which provides more profitability. Southwest should continue to operate at low costs so they may continue to provide low prices to their customers, since cheap flights is one of the keystones of the company.
The airline industry has become more and more competitive over the years. It takes determination, preparation, knowledge, and recourses to start an airline company, and that is just what happened forty-five years ago in Dallas Texas. Southwest Airline is a very successful airline company serving around 100 million customers annually (Southwest Corporate Fact Sheet). Many things stick out about Southwest such as their satellite-based WIFI and free luggage. These accommodations appeal to the customers. The company describes its mission as “dedication to the highest quality of Customer Service delivered with a sense of warmth, friendliness, individual pride, and Company Spirit” (About Southwest). Although Southwest Airlines Co. takes only the sixth place in the ranking of Forbes magazine[1], SWA is the world 's largest low-cost carrier, has become the biggest domestic airline in the United States, by number of travelers carried. More than 70 million passengers fly SWA ewery year to over 60 destinations around the continental United States. Passengers have found that Southwest 's affordable tickets create almost a new type of transportation, more in competition with the automobile than other airlines. The potential customers are ready to refuse in-board meals, baggage transfers, and other traditional additions for economically affordable tickets.
“Unless humanity is suicidal, it should want to preserve, at the minimum, the natural life-support systems and processes required to sustain its own existence” (Daily p.365). I agree with scientist Gretchen Daily that drastic action is needed now to prevent environmental disaster. Immediate action and changes in attitude are not only necessary for survival but are also morally required. In this paper, I will approach the topic of environmental ethics from several related sides. I will discuss why the environment is a morally significant concern, how an environmental ethic can be developed, and what actions such an ethic would require to maintain and protect the environment.
