There poses a great conflict between the cyber security and human rights hence my sub topic will aim to argue that whether the right to protection from cybersecurity should be guaranteed to every individual as a human right under The Universal Declaration of Human Rights or not. I will put forward the arguments and show that how various features of internet can be use both positively and negatively. Therefore there is a need for an appropriate legal response or mechanism but these legal restrictions should be formulated in such a way that it does not hamper the human rights of the people at large. Just looking at the negative sides you cannot ignore the positive side, as there should be a balance between both of them. Both the parts are highly important, having only one feature may create unrest and tension between the people and the state. If the state do not regulate cyber world by monitoring or putting some restriction it may invite harmful threats to their state or to their people at large. And if the state does not provide protection against cyber security it will hamper the human rights of the people at large and it might result in clash between the state and its people leading to unrest in the country and people losing faith in the state and the system. Nevertheless, his leaks on the U.S. government surveillance program, PRISM, demand an explanation. Many American citizens have been enraged by the thought of the government tracing their telecommunication systems. They say it is an infringement on their privacy rights of the constitution. However, some of them don’t mind; they believe it will help thwart the acts of terrorists. It is difficult to define cyberculture because its boundaries are uncertain and applications to certain circumstances can often be disputed. The common threads of defining cyberculture is a culture which has evolved and continues to evolve from the use of computer networks and the internet and is guided by social and cultural movements reflective of advancements in scientific and technological information. It is not a unified culture but rather a culture that exists in cyberspace and is a compilation of numerous new technologies and capabilities, used by diverse people in diverse real – world locations. Cyberculture, a twentieth century phenomenon, has brought challenges unlike any other that the United States has seen in the areas of cyber security and its impact on our most critical institutions. This presentation will focus on the aforementioned three entities where national security is in jeopardy, in part due to cyberculture and its intentional use for disruptive and destructive purposes.
It has become a sad and upsetting fact that in today’s society the truth is that the right to one’s privacy in the I.T (information technological) world has become, simply a joke. In an electronic media article “No place to hide”, written by James Norman, two interesting and debatable questions were raised: ‘Are we witnessing the erosion of the demarcation of public and private spaces brought on by the networked economy and new technology?’ Also, ‘What roles do government, industry and citizens have in regard to censorship and privacy?’ These statements ultimately end with the fact that it is impossible for Net users to expect privacy online, because online privacy doesn’t exist. However, one must ask, ‘What will be done about the problem?’ while keeping in mind that yes, the thin line between public and private spaces has been severed as a result of new technology. It is vital that everyone as users of the internet, be it government, Internet Service Providers (ISP’s), or individuals, need take the issue of internet privacy very seriously, while basing all actions towards the issue with the moral statement of, ‘Rights aren’t free, they’re earned’.
Part of the allure of the Internet has always been the anonymity it offers its users. As the Internet has grown however, causing capitalists and governments to enter the picture, the old rules are changing fast. E-commerce firms employ the latest technologies to track minute details on customer behavior. The FBI's Carnivore email-tracking system is being increasingly used to infringe on the privacy of netizens. Corporations now monitor their employees' web and email usage. In addition to these privacy infringements, Internet users are also having their use censored, as governments, corporations, and other institutions block access to certain sites. However, as technology can be used to wage war on personal freedoms, it can also be employed in the fight against censorship and invasion of privacy.
Ever since day one, people have been developing and creating all sorts of new methods and machines to help better everyday life in one way or another. Who can forget the invention of the ever-wondrous telephone? And we can’t forget how innovative and life-changing computers have been. However, while all machines have their positive uses, there can also be many negatives depending on how one uses said machines, wiretapping in on phone conversations, using spyware to quietly survey every keystroke and click one makes, and many other methods of unwanted snooping have arisen. As a result, laws have been made to make sure these negative uses are not taken advantage of by anyone. But because of how often technology changes, how can it be known that the laws made so long ago can still uphold proper justice? With the laws that are in place now, it’s a constant struggle to balance security with privacy. Privacy laws should be revised completely in order to create a better happy medium between security and privacy. A common misconception of most is that a happy medium of privacy and security is impossible to achieve. However, as well-said by Daniel Solove, “Protecting privacy doesn’t need to mean scuttling a security measure. Most people concerned about the privacy implications of government surveillance aren’t arguing for no[sic] surveillance and absolute privacy. Society has become ever-increasingly dependent upon technology, more specifically, computers to conduct personal and business transactions and communications. Consequently, criminals have targeted these systems to conduct information and cyber warfare, which can include politically motivated attacks and to profit through ill-gotten means. In an article written by Koblentz and Mazanec (2013), cyber warfare is the act of disabling an enemy’s ability to use or obtain information, degrading its ability to make decisions, and to command its military forces. Additionally, information warfare is composed of cyber warfare and related to the protection, disruption, destruction, denial, or manipulation of information in order to gain a benefit through the technologies (Taddeo, 2012). Accordingly, as technology becomes readily available to various entities, the ability to conduct or perform warfare through technological means is multiplying.
In today’s society technology is used for everything. With the invention of computers and the internet this open doors to the cyber world. Today you can do almost anything without having to leave your home. The internet gives us the opportunity of shopping online, ordering food online, working from home and video chatting with friends and family across the world. Everyone has a computer and internet access in their homes. While the internet is really convenient it also opens doors for cybercrimes, loss of privacy and the need for computer security.
As the Internet has become more widely recognized and used by people all over the world, it has brought a new medium in which information can very easily be broadcast to everyone with access to it. In 1995 there was a projected 26 million Internet users, which has grown to almost 300 million today. One major problem with this is that everyone represents different countries and provinces which have different outtakes on certain types of freedom of speech as well as different laws about it. This proposes a new type of law that would need to be written in order to determine whether or not something is illegal on the Internet. A person in one country can express what they want to, but that expression may be illegal in another country and in this situation whose laws are to be followed? What I propose to do accomplish in this paper is to discuss the freedom of speech laws of the United States of America and those of France, China, and Canada. I will examine what about them is similar and what about them is different. The bringing of the Internet has brought many new types of businesses as well as ways in order to communicate with the world, but as with each new endeavor or invention, there needs to be a way in order to govern its use and policies. There must also be ways in order to punish those not following the new laws and policies of use, since that the country that the person is in may allow what they did, but it may not be allowed on the Internet or in a different country. In other words, there is the need for international laws governing the Internet.
As can be seen, from the information presented, the need for laws and restrictions concerning internet data collection is greatly needed. Moreover, the government can search private citizens data without warrant or cause. Also, companies are not only collecting internet user data but also selling it. The companies and agencies who commit such crimes should be fined or either closed down. In closing, the privacy and security of individuals on the internet should be upheld by the United States government.
The world is in another cold war, except this time countries are battling for cyber supremacy. Cyberspace is a massive land of ever-changing technology and personal interaction (McGuffin and Mitchell 1). Cyberspace is not only a place where people post pictures and update their profile, but it also plays an enormous role in running a country. Advanced countries use computers to guide their military, keep track of citizens, run their power grids, and hold plans for nuclear devices and nuclear power. With this said, one of the biggest issues concerning the Internet today is freedom of speech. The issue of free speech on the Internet has been a topic of discussion around the world within the past years. It is a unique communication medium and is powerful than the traditional media[2]. Because the Internet can not be compared equally to other mediums of communication, it deserves the utmost freedom of speech protection from the government. The restriction of speech on the Internet takes away from individual's rights and freedom from experiencing the Internet's benefits and uses. Information found on the Internet is endless and boundless and this poses the question, "should the government be allowed to regulate the information and content being transmitted or posted online?"
Accessing the cyberspace is the first right should be granted in order to have privilege of and exercise the rest of the human rights on the internet. The internet has a very big impact in people’s life and what they have become today, especially with all the opportunities this medium provide for them to exercise their basic human rights. It has allowed the freedom of many voices to be heard in ways that was merely impossible before this revolution. Not only it has given people the rights to express and associate, but also the right to education as it allows to access many educational materials. In fact, accessing this virtual place has become a necessity to fulfill many other human rights including the right to work, and the right to take part in country’s government. Therefore, internet access should be a public right that ensure information and internet accessibility, usability, and availability for all people regardless of gender, place, and income.
