Chapter 2 was devoted to a literature review, which discussed both the concept of cultural relativism and interpretative methodologies in contemporary Islam. In the first part, I argued that cultural relativism is a serious challenge to women’s human rights because it violates these rights in the name of the culture or religion. Therefore, the conflict between universal human rights and cultural relativism has been discussed. Then, I provided suggested approaches which may address this problem effectively such as the dialogue between cultures and within cultures, human rights education and the mutual respect between human rights and cultural relativism.

Islam as a religion mandates justice and equality. Unfortunately, nowadays Islam being a factor of discrimination against women is endless. For example, many Muslim countries like Jordan put reservations on some articles of CEDAW, which establish women’s rights in child marriage, marriage in general, divorce, guardianship, custody and the ability to pass nationality to foreign spouses and/or children, because it contradicts with Islam. They argue that those Islamic laws cannot be changed because they are divine or based on the Qur’an. Muslims countries used to use these pretexts to limit women’s equality within their families and to deny and restrict women’s rights. In fact, these reservations have nothing to do with Islam and this thesis has shown that CEDAW is fully compatible with Islam. I argued that the Quran is “a living text and can be reinterpreted to meet contemporary needs of given Muslim societies” and accordingly will meet the international human rights standards. Research on women’s rights is equally vast and while countless efforts in academia have tackled and focused on different issues locally and globally, there still remain knowledge gaps and opportunities for research in the realm of women’s rights, especially the role of Islamic law and its influence over domestic law. Therefore, future research needs to be done on the issue of women's rights in Jordan. Such research should be based on reinterpreting the Quran with an emphasis on equality and what has been popularly called the rights of women. As a final recommendation, this thesis seeks to encourage further enquiry into the most controversial issues in Islam and women’s issues which could not be discussed in detail as they were not the main topic of discussion, such as women’s rights to inheritance, guardianship in marriage, domestic violence, polygamy, protection of honor, freedom of spousal selection and leadership.
