Research has suggested that human beings may respond differently to moral issues in a way that is systematically related to characteristics of the issue itself (roufa, 2012). Such characteristics include the magnitude of social consensus, probability effect, temporal immediacy, and moral intensity (rodrigo, 2012). When criminal justice professionals apply ethics to everyday operations, they take out the risk of making poor judgement calls. The Moral Philosophy of Ethics as defined by Cyndi Banks is defined as “a branch of philosophy concerned with the study of questions of right and wrong and how we ought to live, Ethics involves making moral judgements about what is right and wrong, good or bad.(2).” Ethics in the criminal justice department is important because it justifies ones actions. In The Lucifer Effect by Phillip Zimbardo and Hard Measures by Jose A. Rodriguez, Jr. there are many scenarios of ethical dilemmas that need to be questioned.
The news reports crime daily. Crime is something that we cannot run from in today’s society; so we depend highly upon the justice system. Criminal Justice is a major concern. Criminal Justice consists of three areas: our police, courts and corrections department. The Criminal Justice system was put in place by these agencies, and established by the governments to help control the crimes and applies penalties to those that violate the law. Many people feel that the criminal justice system is there to protect and serve while others feel that the criminal justice system fails them daily.

Mass incarceration has caused the prison’s populations to increase dramatically. The reason for this increase in population is because of the sentencing policies that put a lot of men and women in prison for an unjust amount of time. The prison population has be caused by periods of high crime rates, by the medias assembly line approach to the production of news stories that bend the truth of the crimes, and by political figures preying on citizens fear. For example, this fear can be seen in “Richard Nixon’s famous campaign call for “law and order” spoke to those fears, hostilities, and racist underpinnings” (Mauer pg. 52). This causes law enforcement to focus on crimes that involve violent crimes/offenders. Such as, gang members, drive by shootings, drug dealers, and serial killers. Instead of our law agencies focusing their attention on the fundamental causes of crime. Such as, why these crimes are committed, the family, and preventive services. These agencies choose to fight crime by establishing a “War On Drugs” and with “Get Tough” sentencing policies. These policies include “three strikes laws, mandatory minimum sentences, and juvenile waives laws which allows kids to be trialed as adults.
The basis of criminal justice in the United States is one founded on both the rights of the individual and the democratic order of the people. Evinced through the myriad forms whereby liberty and equity marry into the mores of society to form the ethos of a people. However, these two systems of justice are rife with conflicts too. With the challenges of determining prevailing worth in public order and individual rights coming down to the best service of justice for society. The criminal justice system is a group of institutions that work together to protect a society, prevent and control crime, and maintain justice; enforcing the laws regulated by society. As the years have gone by and society has evolved; so have the criminal justice system and its methods to accomplish its role in society. This short analysis will evaluate the main facts that have been affecting the criminal justice system for decades and have influenced the evolution the justice system is enduring in a changing society (Muraski, 2009). My first exposure to the criminal justice system was while in high school when I was fortunate to be chosen for an internship with a District Judge John Vance in Dallas, Texas. Judge Vance made certain I had a rich and varied experience. He had me to sit in on several high profile cases in his court and to participate in preparing cases for trial with a prosecutor and defense attorney. In addition, he encouraged me to visit other courtrooms and courthouses to observe the proceedings. This along with him coordinating visits at local jails and law enforcement agencies gave me a broad and well-rounded perspective of the criminal justice system. In my undergraduate studies, I endeavored to further my knowledge and understanding up to the more advanced levels and achieved an outstanding result. As I started my CJ studies in the Spring of 2014, I became preoccupied by the systematic trainings that I received in the criminological theories, crime correction, and the relevant laws. More accurately, it is the study of crime as a social trend, and its overall origins, its many manifestations and its impact upon society as a whole. That makes it more a form of sociology than a law enforcement tool. But the trends it studies have a huge impact on the way the police do their jobs, the way society treats its criminals, and the way a given community goes about maintaining law and order. The Classical School of criminology is a theory about evolving from a capital punishment type of view to more humane ways of punishing people. Positivist criminology is maintaining the control of human behavior and criminal behavior. They did this through three different categories of Biological studies, which are five methodologies of crime that were mainly focused on biological theories, Psychological theories, which contains four separate theories, and the Sociological theories, which also includes four different methods of explaining why crime exists.
