During the initial stages of this investigation, it was unclear if Bozena Czeremcha’s complaint contained any information worth pursuing; however after reviewing Christie’s page 6 response (which included bank statements) it does appear that there was a misuse of funds, as well as lack of supervision, and a potential conflict of interest.
On September 25, 2015, bar counsel received Christie’s response to the page 6 letter sent on July 21, 2015; Christie had requested an extension for his response due date while he sought counsel. It should also be noted that Christie was involved in a motor vehicle accident on June 26, 2015, and was out of the office from June 26, 2015 through August 3, 2015.

It appears as if he is making these accusations to not only diminish Bozena’s credibility, but to wash his hand of this situation. Even if these errors were the result of an employee’s mistake, Christie has a duty to oversee their work. The tone of his response doesn’t suggest he feels as if he is accountable for any of his employee’s actions, which is particularly worrisome given the amount of time he spends away from the office. Although we are waiting for the return of the bank subpoena, there is no indication that Bozena was responsible for handling any of the office finances. Additionally, despite the fact Christie framed his response in a way that implies Bozena intentionally had files shredded; she doesn’t appear to be directly responsible for the files being destroyed. According to Pamela and Bozena the shredding company accidently took boxes that had not been marked for shredding. Bozena asserts that the boxes taken in error most likely contained duplicate copies of documents and sensitive medical record, not entire case files. In addition to the outstanding subpoena, I have reached out to Sarah Burnham, the bookkeeper, to discuss what she recalls about the negative IOLTA account in February of 2015; to date she has not returned my phone
