For the longest time civil rights has been a battle of right and wrong, affecting the lives of many people around the world. Discrimination against gays denies them their civil rights with regards to their social roles in marriage work, and everyday life.
As of now, 17 states in North America have licensed and legalized same-sex marriage. The LGBT community has been fighting for marital freedom for a few generations now. Those opposing same-sex marriage are afraid they will lose their established pride as Americans. Although society looks down upon homosexuality, that hasn’t stopped gays from continuing to push for their rights as citizens of the state. Within America’s society today, 3.8 percent of the population is gay, lesbian, or bisexual. With only 17 of the 50 states legalizing and recognizing this type of relationship (“History…”), it puts a stronghold on same-sex couples to publicly declare their love with the promise of marriage. Same-sex marriages should be legalized because everyone has equal rights of freedom and liberty.
Abstract On June 26, 2015 a divided Supreme Court ruled in the landmark case Obergefell v. Hodges that same-sex couples could now marry nationwide. At the time of the split ruling there were 9 supreme court justices, 5 of the justices were Republicans, and the remaining 4 were Democrats. Even bringing up the other side’s argument may cause a debate in almost any environment. Today, Americans are easily offended by things that don’t agree with what they believe. America is full of passionate people who always have a cause to fight for or against. In recent years, there has been many law reforms recognising same sex relationships, which include changes to Medicare, tax, social security, superannuation, worker’s compensation, child support, and allowing people in same-sex relationships to adopt children. Gay rights, at the moment, are one of the most publicized and well known controversial subjects of this decade. The sides clearly drawn one fighting for rights as simple as being married the other stating that it defames their religion and goes against the definition of marriage, being between a man and a woman. The individuals who are fighting for their civil rights are fallowing the same path that African Americans and women have taken, but the change has started and in over 13 states gays have been given their basic rights and more state are joining in the fight both for and against the topic.
The world today is surrounded with many controversial issues. One such issue would be the topic of gay marriage. This country has grown around one major tradition, being the definition of marriage. It’s more-less looked at as a religious or legal commitment between a women and man, to express their love and compassion towards one another, being the last and final step there is to take with that significant other. Homosexual relationships are rapidly gaining acceptance in this country. However, the Defensive of Marriage Act, that former president Clinton signed in 1996, is holding many back from being able to marry what could be the significant other of their dreams. Homosexuality effects from 8% to 15% of all males, as well as females being slightly less than the male population. To put this in a more familiar context, there are as many gays and lesbians in America today as there are unemployed citizens. There are a few states which formed a type of commitment called a "civil union", which basically is marriage without using the word "marriage." Gay couples are denied significant rights when they are not allowed to marry, and these result in injustices within society. Most carry the burden of hiding their sexual identity for fear of being disrespected or mistreated by the general population who remain ignorant to the causes and circumstances of homosexuality. This puzzles many due to the excess amount of investigative work that has been done on the phenomenon, as well as puzzling the church as to who would want to look into the concept in such a sinful matter.
As a United States citizen who was born in the new millennium, I was brought up with the idea that, as stated in the Declaration of Independence, “all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.” This statement was one of the main sources of fuel for the Civil Rights Movements in the mid 1950’s/60’s in the United States. Minority groups have often been mistreated in the United States culminating in movements much like that of the women’s suffrage movement, civil rights movements and now a movement toward equality for the LGBTQIA. In the last few decades a new minority group, lesbians, gays, bisexuals, transgender, queer/questioning, intersex and allies, and their struggle to attain their right to the pursuit of happiness. This small makes up roughly 4 percent of the US population. Though many say that gay marriage will weaken the moral foundation of our country, it should be legalized, not only because banning it is unconstitutional, but also because strips people of their human rights
Marriage equality rights have come a long way over the last several year, however there is still more progress to be made. Achieving gay marriage rights across the nation has been a long fight and has caused quite a great deal of controversy. While more and more people, churches, organizations, businesses, etc. are all starting to support the movement, thousands of them still do not. Over the last years the topic of same-sex marriage has been of great importance to our society. The idea of the same gender being lawfully married is disturbing to a group of people but in the recent years the number of supporters has increased. The cases that argue for the legalization of same-sex marriage are focusing on the relationship of the individuals and do not see anything in same-sex marriage that could harm our society as a whole. The article “How the President go to ‘I Do’ on Same-Sex Marriage,” published by Joe Becker in April 2014, explains how Barack Obama started saying that he was undecided about the subject matter but is now leaning toward the legalization of same-sex marriage. The subject matter takes a lot of analyzing of what pros and cons are to come from the legalization of same-sex marriage. Same-sex marriage is a global argument that deals with unifying two individuals of the same gender under the law. The main reason that supporters give for justifying same-sex marriage is that it is for the same reason as straight people, to show love and commitment to each other. Furthermore, the argument of same-sex marriage is difficult to generalize because of the multiple factors that need to be taken in consideration when making any decision regarding this topic. Although Becker does have true premises, he lacks clarity in his terms which make his argument be false and invalid.
The dictionary defines discrimination as the unjust or prejudicial treatment of different categories of people or things, especially on the grounds of race, age, or identified sex and sexual orientation. The term LGBT stands for, lesbian, gay, bisexual and transgender. These terms refer to sexual orientation and also gender identity. Every day people of the LGBT community suffer wrongful terminations and oppression in their schools for their sexual orientation or identified gender.
If the constitution promises equality before the law, what justification can there be for clearing rights to any member of society? More specifically what justification can there be for clearing rights to gays and lesbians? Lots of questions come to mind when the topic of gays and lesbians having equal rights as any other citizen in society would have. Should gays and lesbians have equal employment opportunities? Should they have the right to adopt a child, and should they have the right to marry their own sex partner. Well of course they should have the right to do all of these things just because they are human beings also.
In conclusion I argue that banning same-sex marriage is discriminatory. It is discriminatory because it denies homosexuals the many benefits received by heterosexual couples. The right to marriage in the United States has little to do with the religious and spiritual meaning of marriage. It has a lot to do with social justice, extending a civil right to a minority group. This is why I argue for same-sex marriage. The freedom to marry regardless of gender preference should be allowed.
When one hears the words “LGBT” and “Homosexuality” it often conjures up a mental picture of people fighting for their rights, which were unjustly taken away or even the social emergence of gay culture in the world in the1980s and the discovery of AIDS. However, many people do not know that the history of LGBT people stretches as far back in humanity’s history, and continues in this day and age. Nevertheless, the LGBT community today faces much discrimination and adversity. Many think the problem lies within society itself, and often enough that may be the case. Society holds preconceptions and prejudice of the LGBT community, though not always due to actual hatred of the LGBT community, but rather through lack of knowledge and poor media portrayal.
